E. of Londonderry & others Executors of Sir H. Ford, versus Dormer, Guardian of H. Ford.

The House being this Day moved, on the Behalf of Henry Ford an Instant, Respondent to the Petition of the Earl of Londonderry and others Executors of Sir Henry Ford; praying a short Day for hearing the Appeal of the said Earl and others depending in this House:

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That this House will hear the said Cause, by Counsel, at the Bar, on Wednesday the Sixth Day of December next, at Ten of the Clock in the Forenoon.

Finch versus Ditcher.

Upon reading the Petition of John Finch, Respondent to the Petition and Appeal of Nicholas Ditcher and others Appellants; shewing, "That he hath endeavoured to serve Nicholas Ditcher with the Order of this House, for answering to his Petition of the Seventeenth of November Instant; and praying that the Service of an Order upon the Appellants Clerk in Chancery may be good Service:"

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said Nicholas Ditcher and other the Appellants shall and they are hereby required to put in their Answer to the said Petition of the Seventeenth of November Instant, on Monday the Fourth Day of December next; and that the Service of this Order upon the Appellants Clerk in Chancery shall be good Service.

Ashley versus Jemmatt.

Upon reading the Petition and Appeal of Henry Ashley Gentleman, against a Decree made in the Court of Chancery, the Second Day of July, in the Year of our Lord One Thousand Six Hundred and Ninety, in a Cause wherein John Jemmatt Gentleman and Anne his Wife were Plaintiffs, against the Petitioner Defendant; and praying the Reversal of the said Decree:

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said John Jemmatt and Anne his Wife may have a Copy of the said Appeal; and shall and they are hereby required to put in their Answer thereunto, on Tuesday the Twelfth Day of December next, at Ten of the Clock in the Forenoon.

Marq. of Carmarthen, Privilege:

The Earl of Bridgewater reported from the Lords Committees for Privileges, "That, upon Perusal of Precedents, and hearing the Witnesses produced by the Lord President, their Lordships are of Opinion, That, in the Case referred to them, his Lordship's Privilege hath been broken by Samuel Beekes, Robert Russell, John Mason, Sebastian White, Humphry Buckland, Thomas Gill, John Langford, John West, Charles Palmer, George Richmond, and Elias Upton, by their disturbing his Lordship's Possession in his Warren at Wimbledon, in a riotous Manner."

To which the House agreed; and ORDERED as followeth:

Beeks and others attached, for entering his Warren.

"Upon Oath made at the Bar of this House, and Report from the Lords Committees for Privileges, That Samuell Beekes, Robert Russell, John Mason, Sebastian White, Humphry Buckland, Thomas Gill, John Langford, John West, Charles Palmer, George Richmond, and Elias Upton, have, in a riotous Manner, under Pretence of Right, entered into the Warren of the Right Honourable the Lord President, a Peer of this Realm, contrary to the Privilege of Parliament: It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Serjeant at Arms attending this House, his Deputy or Deputies, do forthwith attach the Bodies of the said Samuell Beekes, Robert Russell, John Mason, Sebastian White, Humphry Buckland, Thomas Gill, John Langford, John West, Charles Palmer, George Richmond, and Elias Upton, and bring them in safe Custody to the Bar of this House, to answer for their Offence; and this shall be a sufficient Warrant on that Behalf.

"To Roger Charnock Esquire, Serjeant at Arms attending this House, his Deputy and Deputies, and every of them, and to all Mayors, Sheriffs, Bailiffs, Constables, and other Officers, to be aiding and assisting in the Execution hereof."
