Province of Yorke, Inhabitants of, to dispose of their Personals by Will, Bill.

The Lord Marquis of Halifax reported the Bill, intituled, "An Act, that the Inhabitants of the Province of Yorke may dispose of their Personal Estates by their Wills, notwithstanding the Custom of that Province."

The Question was put, "Whether this Bill shall pass?"

It was Resolved in the Affirmative.

Message to H. C. with it.

A Message was sent to the House of Commons, by Sir Miles Cooke and Sir Adam Ottley:

To let them know, that this House hath agreed to the said Bill, without any Amendment.

Pitt's Bill.

Hodie 2^a vice lecta est Billa, intituled, "An Act to enable Trustees to sell Part of the Lands and Tenements of Mathew Pitt Esquire and Robert Pitt Gentleman, for the Payment of Debts; and to settle the rest of their Lands upon the said Mathew and Robert, and the Wife of the said Robert, and their Issue."

ORDERED, That the Consideration of this Bill be committed to the Lords following:

Their Lordships, or any Five of them; to meet on Thursday next, at Nine of the Clock in the Forenoon, in the Prince's Lodgings near the House of Peers; and to adjourn as they please.

Smyth, D. of Northumb.'s Servant, arrested.

Upon Oath made, at the Bar of this House, "That John Smyth, Hunting Groom of the Stables to the Right Noble his Grace the Duke of Northumberland, was arrested, and detained in Prison, at the Suit of John Sawyer, by John White an Attorney, and Richard Best and Thomas Bishop Bailiffs, contrary to the Privilege of Parliament:"

Sawyer, White, & al. to be attached.

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Gentleman Usher of the Black Rod attending this House, his Deputy or Deputies, do forthwith attach the Bodies of the said John Sawyer, John White, Richard Best, and Thomas Bishop, and bring them in safe Custody to the Bar of this House, to answer for their said Offence; and this shall be a sufficient Warrant on that Behalf.

To Sir Thomas Duppa, Gentleman Usher of the Black Rod attending this House, his Deputy and Deputies, and every of them; and to all Mayors, Sheriffs, Bailiffs, Constables, and other Their Majesties Officers, to be aiding and assisting in the Execution hereof.

Seymour's Bill.

The Earl of Bridgewater reported the Bill, intituled, "An Act for the better Assurance of the Manor of Woodlands and Hundred of Knolton unto Edward Seymour Esquire," as fit to pass, with some Amendments.

Which were read Twice, and agreed to; and the Bill ordered to be engrossed, with the said Amendments.

River Neene to make navigable, Bill.

Hodie 2^a vice lecta est Billa, intituled, "An Act for making the River Neene, in the County of North'ton, navigable from Peterborough to Oundle, in the said County of North'ton."

ORDERED, That the Consideration of this Bill be committed to the Lords following:

Their Lordships, or any Five of them; to meet on Wednesday next, at Nine of the Clock in the Forenoon, in the Prince's Lodgings near the House of Peers; and to adjourn as they please.

Davy & al. versus Courtney, Ly. Smith, & al.

Upon reading the Petition of Dorothy Davy and others, Appellants, in a Cause wherein the Lady Smith and others were Respondents, concerning an Order of this House, made the Fifth Instant, upon hearing of the Appeal, wherein it is ordered that the Petitioners may be at Liberty to try the Will in Question, in what Court they please, before the End of next Term; and praying, "that the said Order may be amended; and that they may be at Liberty to try the Cause next Lent Assizes in Cornwall; or at Bar, in any Court, before the End of Easter Terme:"

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the House will hear One Counsel on either Side, in relation to this Matter, To-morrow, at Ten of the Clock in the Forenoon.

Sir J. Wentworth's Bill.

A Message was brought from the House of Commons, by Sir Jonathan Jennings and others:

To return the Bill, intituled, "An Act to enable Sir John Wentworth Baronet, an Infant under the Age of One and Twenty Years, to make a Jointure out and Settlement of his Manors and Lands, in the Counties of Yorke, in the County of the City of Yorke, and Westmorland," to which they have agreed, with some Amendments; and desire their Lordships Concurrence thereunto.

Which were read Twice, and agreed to; and ORDERED, That the Commons have Notice thereof.

Message from H. C. to return Ld. Villiers' Bill.

A Message was brought from the House of Commons, by Sir Robert Cotton and others:

Who returned the Bill, intituled, "An Act for the clearing and removing of some Doubts which may arise in an Act of Parliament, intituled, An Act for the vesting several Manors, Lands, and Rents, in the Counties of Lincolne, Berks, and Devon, in Trustees, to be sold, for the buying other Manors and Lands, to be settled for the same or the like Uses as those to be sold are now settled;" to which they have agreed, without any Amendment.

Claim to the Title of E. of Banbury.

After hearing Counsel this Day, at the Bar, upon the Petition of the Person that claimeth the Title of Earl of Banbury, and Their Majesties Attorney General; and Debate thereupon:

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Consideration of this Business shall be, and is hereby, adjourned to Saturday next, at Twelve of the Clock; and that the Two Inquisitions taken formerly concerning this Case shall be then brought; and that the Heralds do then attend; and bring with them all such Papers and Evidence as are in their Office relating to this Matter; and that Their Majesties Attorney General be then further heard on Their Majesties Behalfs, and all others that may be any Ways concerned.

Williams versus Reade.

Upon reading the Petition of Walter Williams Esquire, against Richard Reade:

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That Mr. Justice Gregory shall have a Copy thereof, and do attend this House thereupon To-morrow, at Ten of the Clock in the Forenoon.

Stone versus Bourne.

The House being this Day moved, "That John Hutchins may enter into a Recognizance for Susan Stone Appellant in this House, to which Thomas Bourne is Respondent; and that a Day may be appointed for hearing of the said Cause:"

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said John Hutchins may enter into a Recognizance, as desired; and that this House will hear the said Cause, by Counsel on both Sides, at the Bar, on Friday the Twentieth Day of this Instant January, at Ten of the Clock in the Forenoon.
