Wycherly & al. Inhabitants of Clyve versus Mayor of Shrewsbury & al.

Upon reading the humble Petition of Daniel Wycherly Esquire, on the Behalf of himself and others the Inhabitants of Clyve and Sansawe, in the County of Salop, and of John Hughes, William Turner, Samuell Orppe, and Thomas Anchors, late Curates of the Chapel of Clyve, in the County of Salop, against an Order of Dismission, made the One and Twentieth Day of November last past, in Chancery, upon an Information there prosecuted, in the Name of the Attorney General, at the Relation of the Petitioner, against the Mayor, Aldermen, and Burgesses, of Shrewsbury, and against Andrew Tayler and Robert Forster, since deceased; and praying the Reversal of the said Order:

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Mayor, Aldermen, and Burgesses, of Shrewsbury may have a Copy of the said Petition and Appeal; and be, and they are hereby, required to put in their Answer or respective Answers thereunto, in Writing, on Monday the Eight and Twentieth Day of this Instant November, at Ten of the Clock in the Forenoon.

Irregularities in and near the the House to be prevented.

The House this Day taking Notice, that several Disorders and Irregularities have of late been in and near the House of Peers:

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Lords Committees for Privileges do consider of Ways and Means for Redress thereof for the future, and report their Opinions thereupon to this House; for which Purpose, their Lordships are to meet on Monday next, at Four of the Clock in the Afternoon.

Order for the Streets leading to the Houses to be kept clear during their Sitting.

Upon Complaint made to this House, "That there is such an Interruption, by Hackney Coaches, Carts, and Drays, in King's-street, and the Passages in The Old Pallace Yard, Westm'r, that the Lords and others are frequently hindered from coming to this House, to the great Inconveniency of the Members of both Houses:"

It is thereupon ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the High Steward of the City of Westminster, or his Deputy, together with the Justices of the Peace of the said City, shall, by their Care and Directions to the Constables and other Officers within the said Limits, take special Order, that no empty Hackney Coaches be suffered to make any Stop between Whitehall and The Old Pallace Yard, in Westm'r, from Ten of the Clock in the Forenoon until Two of the Clock in the Afternoon of the same Day, during the Sitting of this Parliament; and that no Carriages, Drays, or Carts, be permitted to pass through the said Streets and Passages, between the Hours aforesaid, during the Sitting of this Parliament; and herein special Care is to be taken, by the said Deputy Steward, Justices of the Peace, Constables, and all other Officers herein concerned, as the contrary will be answered to this House.

Hungerford versus Pollard.

Upon reading the Petition of Jane Hungerford and others; praying a Day for hearing Counsel upon the Equity reserved in this Cause; as also upon reading the Petition of Thomas Pollard, praying, "That this Cause may be re-heard before this House, upon the Merits of the same, and of the Affidavits annexed:"

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Petitions abovesaid shall be, and they are hereby, referred to the Lords Committees for Petitions, to consider of these Petitions and what hath been done in this House in this Cause, and report to the House.

Moore & Ux. versus Coote.

Upon reading the Petition and Appeal of William Moore Esquire and Elizabeth Countess of Meath his Wife, from and against a Decree in the Court of Chancery, made the Seven and Twentieth Day of January last, in a Cause there depending, wherein Sir Phillips Coote Knight and the Lady Elizabeth his Wife were Complainants, against the Petitioner and others Defendants:

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said Sir Phillip Coote Knight and the Lady Elizabeth his Wife may have a Copy of the said Petition; and be, and they are hereby, required to put in their Answer or respective Answers thereunto, in Writing, on Monday the Fourteenth Day of this Instant November at Ten of the Clock in the Forenoon.

Hale versus Dashwood.

Upon reading the Petition of Thomas Hale; shewing, "That he hath an Appeal depending in this House, to which Sir Samuel Dashwood Knight and Francis Dashwood, Executors of Francis Dashwood Esquire, are Respondents; and praying a Day for hearing thereof:"

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That this House will hear the said Cause, by Counsel on both Sides, at the Bar, on Tuesday the Fifteenth Day of this Instant November, at Ten of the Clock in the Forenoon.

Frauds by clandestine Mortgages to prevent, Bill.

Hodie 2^a vice lecta est Billa, intituled, "An Act for preventing Frauds by clandestine Mortgages."

ORDERED, That the Consideration of this Bill be referred to these Lords following:

Their Lordships, or any Five of them; to meet on Wednesday next, at Four of the Clock in the Afternoon.

E. Huntingdon and Marlborough under Bail, upon Warrants of Commitment for Treason, and E. of Scarsdale's Papers searched.

A Debate arising, concerning some Lords being under Bail in the King's Bench, upon Warrants of Commitment for High Treason:

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Matter of this Debate shall be, and is hereby, referred to the Lords Committees for Privileges; who are to meet To-morrow, at Ten of the Clock in the Forenoon, and to report to the House; whose Lordships have Power to send for Persons, Papers, and Records.

Lieutenant of The Tower to produce the Warrants.

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Lord Lucas Chief Governor of Their Majesties Tower of London do send to the Lords Committees for Privileges, To-morrow, at Ten of the Clock in the Forenoon, in the House of Peers, the Warrants for Commitment of the Earl of Huntingdon and the Earl of Marleborough.

To the Lord Lucas, Chief Governor of Their Majesties Tower of London, or the Deputy Governor there.

Clerk of the Rules to send Copy of Affidavit against them.

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Clerk of the Rules in the Court of King's Bench do send to the Lords Committees for Privileges, To-morrow, at Ten of the Clock in the Forenoon, a true Copy of the Affidavit of Aaron Smith, against the Earl of Huntingdon and others, in the King's Bench, in Trinity Terme last.
