Brooke versus Marshal.

The House being moved, (fn. 1) of the Behalf of Sir Rob't Brooke, "That the Cause appointed to be heard the 18th Instant, wherein he is Plaintiff, and Mary Marshall and others are Defendants, may be put off for some Time longer; he being infirm, and far distant from London:"

It is thereupon ORDERED, That this House will hear the said Cause, by Counsel on both Sides, at the Bar, on Monday the 27th Instant, at Ten of the Clock in the Forenoon; whereof Sir Robert Brooke is to cause timely Notice to be given to the said Mary Marshall and other Defendants.

Ly. Smith versus Blight.

Whereas there is an Appeal depending in this House, wherein Dame Anne Smith Widow is Plaintiff, and Francis Blight is Defendant; the House being moved this Day, "That Francis Courtney Esquire may enter into Recognizance for the said Lady Smith, to answer such Costs as this House shall think fit to give, in case they dismiss the said Appeal:"

It is ORDERED, That Mr. Cou'tney enter into a Recognizance for the Lady Smith, as is desired.

Fountain versus Coke.

The House being moved, "That the Cause which was appointed to be heard To-morrow, wherein Andrew Fountain is Plaintiff, and Edward Coke Esquire Defendant, upon the Sum of £. 542 Backwell's Debt, may be put off; the Counsel of Edward Coke Esquire being not able to attend To-morrow:"

It is ORDERED, That this House will hear the said Cause, by Counsel on both Sides, at the Bar, on Monday next, at Ten of the Clock; the same Time when Mr. Coke's Appeal is to be heard.

Jervas versus Preston.

After hearing Counsel this Day at the Bar, upon the Petition and Appeal of Francis Jervis, from a Decree in the Court of Chancery, made the 16th of May, 1685, in a Cause wherein the said Francis Jervis was Defendant, at the Suit of John Preston Complainant; as also upon the Answer of the said John Preston put in thereunto:

After due Consideration had of what was offered by Counsel on either Side thereupon, it is ORDERED and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the said Petition and Appeal of Francis Jervis be, and is hereby, dismissed this House; and that the Decree from which he appealed be, and is hereby, affirmed.

Additional Land Tax Bill.

Upon Report from the Committee of the whole House, of the Bill, intituled, "An Act for a Grant to Their Majesties of an Aid of Twelve Pence in the Pound, for One Year:"

It is ORDERED, That the said Bill shall be read the Third Time To-morrow, at Ten of the Clock in the Forenoon.

Edon's Bill.

Hodie 1^a vice lecta est Billa, "An Act to enable Thomas Edon to sell Lands, for the Payment of his Debts, and making Provision (fn. 2) for his Wife and Children, in case they shall have any."

Duty on Coffee, Tea, &c. Bill.

The House was put into a Committee of the whole House, to consider of the Bill for charging and collecting the Duties upon Coffee, Tea, and Chocolate, at the Custom-house.

The House was resumed.

And the Lord Cornwallis reported, "That the Committee have read over the said Bill; and think it fit to pass as it is."

To which the House agreed.

Message from H. C. with a Bill.

A Message was brought from the House of Commons, by Sir John Guise and others.

Who brought up a Bill, intituled, "An Act for preventing vexatious Suits against such as acted in order to the bringing in Their Majesties, or for Their Service."

Duty on Coffee, Tea, &c. Bill.

Hodie 3^a vice lecta est Billa, "An Act for charging and collecting the Duties upon Coffee, Tea, and Chocolate, at the Custom-house."

The Question being put, "Whether this Bill shall pass for a Law?"

It was Resolved in the Affirmative.

Message to H. C. that the Lords have passed it.

A Message was sent to the House of Commons, by Sir Miles Coke and Sir Adam Oateley:

To acquaint them, that this House hath passed the Bill for collecting the Duties upon Coffee, and Tea, and Chocolate, at the Custom-house.

Additional Land Tax Bill.

Hodie 2^a vice lecta est Billa, "An Act for a Grant to Their Majesties of an Aid of Two (fn. 3) Shillings in the Pound, for One Year."

The House was presently put into a Committee, to consider of the aforesaid Bill.

The House was resumed.

And the Earl of Bridgewater reported, "That the Committee of the House have considered of the Bill for a Grant to Their Majesties of an additional Aid of Two (fn. 3) Shillings in the Pound for a Year; and the Committee desires it may be ordered to be read the Third Time To-morrow Morning."

And it was ordered accordingly.

Wortley, alias Montague's Bill.

Hodie 2^a vice lecta est Billa, "An Act providing Maintenances for the Children of Sidney Wortley, alias Mountagu, during his Wife's Life, in case she survive him."

ORDERED, That the Consideration of this Bill is committed to these Lords following:

Their Lordships, or any Three; to meet Tomorrow, at Nine of the Clock in the Forenoon, in the Prince's Lodgings.

L. Culpeper's Conveyances, &c. to Willis, alias Welden, &c. to vacate, Bill:

Hodie 1^a vice lecta est Billa, "An Act for making null and void all Conveyances and Wills made, or pretended to be made, by Tho. Lord Culpeper, for the Benefit of Susanna Willis, otherwise Welden, otherwise Laycock, and her Two Natural Daughters."

Rejected.

The Question being put, "Whether this Bill shall be rejected or not?"

It was Resolved in the Affirmative.
