Message from H. C. with the Bill to regulate Oaths to be taken by Land Officers.
A Message was brought from the House of Commons, by Mr. Gwyn and others:
Who returned, "An Act to regulate the Administration of the Oaths required to be taken by Commission or Warrant Officers, employed in Their Majesties Service by Land, by virtue of an Act made this present Session of Parliament, intituled, An Act for the abrogating of the Oaths of Supremacy and Allegiance, and appointing of other Oaths;" to which the Commons do agree, without any Amendment.
Attainting Persons, Bill.
Hodie 2a vice lecta est Billa, "An Act for attainting several Persons now in Rebellion against Their Majesties."
ORDERED, That the Consideration of this Bill is committed to these Lords following:
Their Lordships, or any Five of them; to meet on Tuesday next, at Eight of the Clock, in the Prince's Lodgings; and, having heard such Persons as they shall think fit, and considered whether it be necessary to address to His Majesty for a Proclamation pursuant to this Bill, are to report to the House.
Ly. Brandon versus E. Maclesfield, for waiving Privilege.
A Petition of the Lady Brandon, Wife of the Lord Brandon, was read; desiring, "That the Earl of Maclesfeld might waive his Privilege, and be sued by her Trustees."
The House left it wholly to the Earl of Maclesfeld.
Bill concerning the Succession of the Crown, &c.
The House went upon Consideration of the Amendments to the Bill for settling the Succession of the Crown:
"Their Lordships insist upon their own Amendment, 7 Skin, 25 Line, concerning the House of Hanover.
"Line 2d of the Clause (A). The Lords agree to the Commons Amendment; but disagree to their Amendment in Line 28 of the said Clause, marked (A).
"In 8 Skin, Line 25, the Proviso is postponed."
Heads to be prepared, to support the Lords Reasons concerning the House of Hanover.
And, after some Debate, the House nominated a Committee, to draw up Reasons for to support their Lordships Reasons concerning the House of Hanover, and to consider of the last Paragraph of the Bill concerning Non obstantes, and draw up Reasons according to the Debate of the House; and make Report thereof: It is further ORDERED, That all the Judges in Town are to assist the Lords Committees.
The Names of the Lords Committees are these:
Their Lordships, or any Three of them; to meet on Monday Morning, at Eight of the Clock, in the Prince's Lodgings.
ORDERED, That the Earl of Derby hath Leave to go into the Country, for Fourteen Days.
Sir A. Blair and Dr. Gray to be brought to the Bar.
The House being informed, "That Sir Adam Blair and Robert Gray Doctor in Physic, who stand impeached by the House of Commons for High Treason, and other high Crimes and Offences, are now in the Hands of a Messenger:"
It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Messenger, in whose Custody they are, be, and is hereby, required to bring the said Sir Adam Blair and Robert Gray to the Bar of this House, on Monday Morning, at Ten of the Clock; and this shall be a sufficient Warrant on that Behalf.
Sir T. Pilkington & al. versus late King, in Error:
After hearing Counsel this Day, at the Bar, to argue the Errors, upon a Writ of Error brought into this House, wherein Sir Thomas Pilkington and others are Plaintiffs, and His late Majesty Defendant:
Judges, who tried the Cause, to attend.
It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That Sir Francis Withins and Sir Thomas Jones do attend this House on Tuesday next, at Ten of the Clock in the Forenoon, to give the Grounds and Reasons for their Judgement given against Sir Thomas Pilkington and others, upon the Riot in London.
