Sir Robert Welsh to be attached, and his Papers seized.
ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Gentleman Usher of the Black Rod, or his Deputy, do immediately go and seize the Person of Sir Robert Welsh, with what Papers are about him, and also such Papers as are in his Study, and bring him and them in safe Custody to the Bar of this House, to answer such Things as shall be objected against him; and this shall be a sufficient Warrant on that Behalf.
To Sir Edward Carteret, Gentleman Usher of the Black Rod, his Deputy and Deputies.
Sir Robert Welsh to remain in Custody, and be examined.
This House being informed, "That Sir Edward Carteret, Gentleman Usher of the Black Rod, hath, according to Order, seized the Person and Papers of Sir Rob't Welsh:"
It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said Sir Robert Welsh shall remain in the Custody of the said Gentleman Usher till further Order; and that he be brought; with his Papers, before the Lords Committees appointed to examine Papers concerning the horrid Design against His Majesty's Person, to be examined by their Lordships, To-morrow at Eight of the Clock in the Forenoon; for whose Custody, this shall be a sufficient Warrant.
To Sir Edward Carteret Knight, Gentleman Usher of the Black Rod, his Deputy and Deputies,
Lord Howard of Escr. to have a Writ of Summons to Parliament.
Upon reading the Petition of William Lord Howard of Escrick; shewing, "That his Father Edward Lord Howard, by Letters Patents of King Charles the First, was created Baron of Esc. to him and Heirs Males of his Body lawfully begotten, which Heir Male the Petitioner is; upon whom is developed, by Force of the said Letters Patents, the Title, Honour, and Dignity of Baron of Esc. and Peer of the Kingdom of England: And his Lordship, apprehending it to be his Duty, as well as his Privilege, to attend the Service of this House, doth humbly acquaint their Lordships, that he is waiting at the Door; and prays that he may be admitted to his Place as a Member of this House, according to the ancient Laws of this Realm, to serve His Majesty and the Kingdom:"
It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said Lord Howard shall have a Writ of Summons granted him to sit in this House, according to the Limitation of the First Patent.
Armstrong to be discharged.
Whereas William Armstronge, Servant to Sir Francis Leake, is committed to Prison, by Ellis Lloyd Esquire, One of His Majesty's Justices of Peace, for some Words by the same William Armstrong uttered; which Words, as this House is informed, were not denied, but were by the Witnesses misunderstood, and applied otherwise than was intended and meant by him:
It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said Ellis Lloyd may, and is hereby, authorized and required to discharge the said William Armstronge out of Prison; taking Bail of him, to appear to answer for the said Words, whensoever he shall be therefor summoned.
Address for a Guard in the Vaults near this House.
ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Lords with White Staves do, from this House, attend His Majesty, humbly to desire, "That His Majesty would be pleased to give Order that Guards of Soldiers, with trusty Officers over them, may be appointed to be and watch, Day and Night, during the Sitting of the Parliament, in the Cellars and Vaults under and near the Parliament House, which are sitted for that Purpose."
Mrs. White to give Security to appear against R. Langhorne.
ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That Mary White, who hath formerly appeared at the Bar as a Witness against Richard Langhorne Junior, be, and is hereby, required to give Security, before some One of His Majesty's Justices of Peace, to be returned into the Court where the said Richard Langhorne shall be brought to Trial, that she will appear to give Evidence at the Trial; and also where she shall be found from Time to Time, till after the said Trial.
Mrs. Coleman to be examined.
ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That Mrs. Coleman, Wife of Edward Coleman now Prisoner in Newgate for Treason be, and is hereby, required to appear before the Lords Committees, appointed to examine Papers concerning the horrid Design against His Majesty, To-morrow, at Eight of the Clock in the Forenoon, in the Prince's Lodgings, near the House of Peers.
R. Langhorne to be brought to the Bar.
ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Keeper of the Prison of Newgate be, and is hereby, required to bring the Body of Richard Langhorne Junior (now a Prisoner in his Custody) to the Bar of the House of Peers, To-morrow, at Ten of the Clock in the Forenoon; and for so doing, this shall be his sufficient Warrant.
Mrs. Langhorne, &c. to appear at the Bar.
ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That Mrs. Langhorne, Wife of Mr. Langhorne, now Prisoner in Newgate, Mary Planner, and Mary White, be, and are hereby, required to appear at the Bar of this House, To-morrow, at Ten of the Clock in the Forenoon.
Bishop of Exeter to print his Sermon on 5th November.
ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Thanks of this House be, and are hereby, given to the Lord Bishop of Exeter, for his Pains in preaching before the House of Peers Yesterday, being the Anniversary Thanksgiving-day for the Deliverance of this Kingdom from the Gunpowder Treason; and his Lordship is hereby desired to cause his Sermon then preached to be printed and published.
Translation of the Proclamation into French, to be examined.
This House being moved, "That some Notice may be taken of the Translation of the Proclamation for banishing Papists from London and Westm. published in the French Gazette, in which it differeth from the Proclamation published in the English Gazette:"
It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That it be, and is hereby referred to the Lords Committees appointed to examine Papers relating to the horrid Design against His Majesty's Person, to consider thereof, and send for and examine the Translator and Licenser thereof, and make Report to the House.
Attorney General examined about wording the Proclamation.
Master Attorney General being advised with about the Proclamation issued out for Removal of Papists from the Cities of London and Westm.; the Lords were satisfied that the said Proclamation was according to the Address of both Houses of Parliament, and the Directions which he received from His Majesty.
The Lord Holles is added to the Committee for examining of Papers for the Discovery of the horrid Design against the Person of His Majesty.
The Lord Bishop of Sarum and the Lord Byron are added to the Committee for the Journal Book.
Lords of the Council to grant Licenses to certain Persons to stay in Town.
The House being moved, "That the granting of Licenses by the Lords of the Council to Persons to stay in Town might be explained:"
It was proposed, "That Persons not being Traders, and Foreigners Merchants Traders, and such Persons as the Lords of the Council shall for prudential Reasons grant Licenses to, to stay in Town, should not have the Oaths mentioned in the Proclamation for banishing Papists from London and Westminster, &c.tendered to them:"
Which was ordered accordingly; and that the Commissions to be issued to the Justices of the Peace for tendering the said Oaths be limited to that Purpose.
Peers Wives and Widows, Privilege.
Then the House declared, "That all Peers, Peers Widows (who have not since married to Commoners), and the Wives of Peers, ought to enjoy the Privilege of Parliament, and not be comprehended within the Penalties enjoined by the Proclamation for banishing Papists from London and Westminster."
Pursuant to which last Declaration, the House being moved on the Behalf of the Marchioness Dowager of Worcester, the ensuing Declaration was granted to her:
Marchioness Dowager Worcester, Privilege, to stay in Town.
"The Lords Spiritual and Temporal in Parliament assembled do declare, That Margaret Marchioness Dowager of Worcester, as she is a Peeress of this Realm, ought to enjoy Privilege of Parliament, and not to be comprehended within the Penalties enjoined by the Proclamation for banishing Papists from London and Westminster."
No Papist to come to Court.
The House further ORDERED, That no Licenses be granted to Papists, to come into the King's Presence or Court.
Some Boys of The Charter House to be examined concerning the Plot.
The House being moved, "That some Boys belonging to The Charter House, in London may be examined, in order to a further Discovery of the horrid Design against His Majesty's Person:"
It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That it be, and is hereby, referred to the Lords Committees appointed to examine Papers concerning that Matter, to send for and examine such Boys and other Persons, from The Charter House and elsewhere, as their Lordships shall think fit, and make Report thereof unto the House.
Adjourn.
