Hodie 3a vice lecta est Billa, "An Act for the better enabling the Trustees of Sir Thomas Cave Knight and Baronet, deceased, for the selling of Lands, for the Performance of the Will of the said Sir Thomas Cave, and likewise for the vesting and settling of other Lands."

The Question being put, "Whether this Bill shall pass?"

It was Resolved in the Affirmative.

Hodie 2a vice lecta est Billa, "An Act for granting a Supply to His Majesty, for enabling Him to pay and disband the Forces which have been raised since the 29th of September last."

ORDERED, That the Consideration of this Bill is committed to a Committee of the whole House; to be proceeded in To-morrow in the Afternoon.

Cottington's Appeal from the Court of Delegates dismissed.

According to the Order of the 12th of this Instant June, this House took into Consideration the Report from the Committee for Privileges, concerning the Appeal of Charles Cottington from the Commissioners Delegates, whether the said Apeal be properly brought before this House; the Opinion of the Committee being, "That the said Appeal did not come properly "before this House."

After Debate and Consideration of Precedents;

The Question being put, "Whether to agree with the Committee in their Report?" It was Resolved in the Affirmative.

And it is thereupon ORDERED, That the Petition and Appeal of the said Charles Cottington be dismissed the House of Peers.

Protest against it.

Upon some Words which passed in Debate this Day, between the Earl of Peterborough and the Earl of Essex; which the House taking Notice of, directed the Lord Chancellor to lay the Injunction of this House upon both their Lordships, to acquiesce, and not to resent any Thing upon this Occasion.

Which their Lordships submitted to.

Clerk of Assize to return Posteas, no Breach of Privilege.

It being moved, "That forasmuch as the Clerk of Assize for Rutland, making some Scruple of returning a Postea upon a Judgement obtained against a Hundred for Robbery-money, because a Peer lives in the said Hundred out of which the said Money is to be raised, for Fear of violating the Privilege of the Peers, this House would therefore give some Directions in the Case:"

The Lords Spiritual and Temporal in Parliament assembled do not think it any Breach of Privilege; but direct that the Clerks of Assize do proceed, according to their Oath and Duty of their Places, in making Returns of Posteas after Judgement.

Benyon, King's Servant, Privilege: Dodson discharged from Attendance.

Whereas George Dodson, Clerk of the Assizes for the County of Rutland, was (amongst others) ordered to appear at the Bar, for a Breach of Privilege, set forth in the Petition of George Benyon Esquire, One of the Gentlemen in Ordinary of His Majesty's Privy Chamber; the House being satisfied that the said George Dodson (as Clerk of the said Assizes) did no other than what the Duty of his Place required of him in the Case complained of:

It is thereupon ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said George Dodson be, and is hereby, discharged from any further Attendance concerning this Matter.

The Earl of Huntingdon and the Earl of Powis are added to the Committee for the Heralds Bill.
