Message from H. C. with a Bill;-and that they agree to the one for taking away the Writ de Hæretico comburendo.

A Message was brought from the House of Commons, by Sir Thomas Meares and others; who brought up a Bill passed by the Commons, intituled, An Act for the more easy Recovery of small Tithes;" to which their Lordships Concurrence is desired.

Also to acquaint their Lordships, that the Commons have agreed to the Amendments made by their Lordships in the Bill for taking away the Writ de Hæretico comburendo.

Bill for better Observation of the Sabbath.

Hodie 3^a vice lecta est Billa, "An Act for the better Observation of the Lord's-day."

The Question being put, "Whether this Bill shall pass?"

It was Resolved in the Affirmative.

Baptizing Children Bill.

The House was adjourned into a Committee, to consider of the Bill for baptizing and catechizing of Children.

The House was resumed.

And the Lord Bishop of Sarum reported, "That the Committee have gone through the said Bill, and considered the Clauses worded according to the Direction of the House Yesterday; and, having agreed to them, do offer the same to the Consideration of the House."

Which Amendments and Clauses, being read Twice, were Agreed to; and ORDERED, That the said Bill be engrossed accordingly.

A Message was brought from the House of Commons, by Sir Thomas Stringer and others; who brought up a Bill, passed the House of Commons, intituled, "An Act to enable Trustees to sell Lands, for the Payment of the Debts of Edward Standish Esquire;" to which they desire their Lordships Concurrence.

Standish's Bill.

Unlicensed Books for suppressing, Bill.

Hodie 3^a vice lecta est Billa, "An Act for the more effectual suppressing of unlicensed Books and Pamphlets."

The Question being put, "Whether this Bill shall pass?"

A Message was sent to the House of Commons, by Sir Miles Cooke and Sir John Francklyn; to deliver them Two Bills passed this House, to which their Concurrence is desired:

1. The Bill for the better Observation of the Lord'sday.

2. The Bill for the more effectual suppressing of unlicensed Books and Pamphlets.

Message from H. C. for a Conference on Supply Bill for building Ships of War.

A Message was brought from the House of Commons, by Sir Richard Temple and others:

To desire a Conference, concerning the Matter of the last Conference, about the Amendments made by their Lordships in the Bill for raising the Sum of Five Hundred Eighty-four Thousand Nine Hundred Seventy-eight Pounds, Two Shillings, and Two Pence Halfpenny, for the Building of Thirty Ships of War.

Answer.

The Answer returned was:

That this House agrees to a Conference; and appoints the same to be presently, in the Painted Chamber.

Then these Lords following were appointed to be Reporters of this Conference:

A Message was brought from the House of Commons, by Sir John Trevor, and others; who presented a Bill, passed by the Commons, intituled, "An Act for an additional Excise upon Beer, Ale, and other Liquors, for Three Years;" to which they desire their Lordships Concurrence.

Further, to put their Lordships in Mind of a Bill sent up from the House of Commons, to prevent the Growth of Popery.

Cobham-house Bill.

Hodie 2^a vice lecta est Billa, "An Act to enable Trustees to raise Money upon Cobham House and Parke."

ORDERED, That the Consideration of this Bill is committed to these Lords following:

Their Lordships, or any Five of them; to meet To-morrow Morning, at Nine of the Clock, in the Prince's Lodgings; and to adjourn as they please.

Additional Excise Bill.

Hodie 1 vice lecta est Billa, "An Act for an additional Excise upon Beer, Ale, and other Liquors, for Three Years."

ORDERED, That this Bill be read again To-morrow Morning.

Report of the Conference on the Supply Bill for building Ships of War.

The House being informed that the Commons were in the Painted Chamber, ready for the Conference, the House was adjourned during Pleasure, and the Lords went to the Conference; which being ended, the House was resumed.

And the Lord Chancellor reported the Effect of the Conference; "which was chiefly managed by Sir Thomas Meares, who read what he said in a Paper, and refused to deliver it to the Lords. He said, The Commons desired the Continuance of the good Correspondence between the Two Houses; but they could not agree with their Lordships Reasons for making good the Amendments in the Bill for raising the Money for building Thirty Ships of War, for several Reasons: Amongst others, he said, That the granting and limiting of all Aids and Supplies did wholly belong to the House of Commons; and that the Lords might, by their inherent Authority, command the proper Officer of the Exchequer to bring before them the Accompts of Monies granted in Parliament, though such Power were not particularly inserted in the Act.

Free Conference ordered.

After Consideration hereof, it is agreed, to have a Free Conference with the House of Commons To-morrow Morning.

And these Lords following were appointed to meet To-morrow Morning, at Eight of the Clock, to consider of what Heads are fit to be insisted upon at the Free Conference, and offer the same to this House:

D. York's Privilege;-Allen & al to be attached for arresting Underhill his Servant.

Upon Complaint to this House, and Oath made at the Bar, by Henry Harris and Thomas Butler, "That Cave Underhill, Servant to his Royal Highness the Duke of Yorke, is arrested and detained in Prison, at the Suit of William Allen, by James Wytham, Walter Wilson, and Andrew Haman, Bailiffs, now sitting the Parliament, contrary to the Privilege of Parliament; which William Allen and Bailiffs refused to release the said Cave Underhill, notwithstanding the Protection of his Royal Highness granted to the said Underhill was shewed to them:"

It is thereupon ORDERED, That the Serjeant at Arms attending this House, or his Deputy, shall forthwith attach the Bodies of the said William Allen, James Wytham, Walter Wilson, and Andrew Haman, and bring them in safe Custody to the Bar of this House, for their said Offence: And this shall be a sufficient Warrant on that Behalf.
