Hodie 2a vice lecta est Billa, "An Act to prevent the Disturbances of Seamen and others, and to preserve the Stores belonging to His Majesty's Navy Royal."
ORDERED, That the Consideration of this Bill be committed to these Lords following:
Their Lordships, or any Five; to meet on Thursday Morning next, at Nine of the Clock, in the Prince's Lodgings; and the Commissioners of the Navy to attend their Lordships, to give them what Information they can.
L. Byron versus Sir W. Juxon, Privilege.
The House taking into Consideration the Complaint of the Lord Byron against Sir William Juxon, for not obeying the Order of this House, dated the Fourth Day of February last:
And, after Debate thereof,
The Question being put, "Whether Sir William Juxon be in Contempt to this House?"
It was Resolved in the Negative.
Upon this, the House made this ensuing Order:
"Whereas, upon Complaint made to this House, by the Lord Byron, That he being in the Possession of the Tenths, Tithes, and Profits, of the Rectory and Parsonage of Rochdale, and Chapels of Saddleworth and Butterworth, in the Counties of Yorke and Lancaster, during this Session of Parliament, Sir William Juxon Knight and Baronet, pretending Title to the Premises, hath, in Violation of the Privilege of Parliament, proceeded to Trials with divers Persons, at the last Summer Assizes at Lancaster, for Recovery of the said Tenths, Tithes, and Profits, from the Lord Byron; this House, having heard Counsel at the Bar, as well for the said Sir William Juxon, as for the Lord Byron, concerning the Possession of the said Tenths, Tithes, and Profits, of the said Rectory and Parsonage of Rochdale, and Chapels of Saddleworth and Butterworth aforesaid, did order, on the 6th Day of December last, That the Lord Byron should be restored to, and continued in the Possession of, the said Tenths, Tithes, and Profits, of Rochdale, Saddleworth, and Butterworth aforesaid, during this Session of Parliament; since which Time, further Complaint being made that the said Sir William Juxon hath not yielded Obedience to the said Order, although some of his Agents have received of some of the Parishioners of Rochdale, Saddleworth, and Butterworth aforesaid, or some or One of them, some Monies, in Lieu or Composition for some of the Tenths, Tithes, and Profits aforesaid, since the Time of Privilege, as the said Sir William Juxon at the Bar of this House on the 4th Day of February last acknowledged; upon which it was ordered, That, upon Demand to be made thereof by the Lord Byron, or his Agents to be employed in that Behalf, the said Sir William Juxon should pay back and restore unto the said Lord Byron all such Monies, or other Profits, as he or his Agents have received of the Parishioners of Rochdale, Saddleworth, and Butterworth aforesaid, for the Tithes and Tenths thereof, since the Time of Privilege of Parliament; which hath not hitherto been performed: Now, to the End that the said Order of the 4th of February last may not be eluded by the said Sir William Juxon, and that the said Lord Byron may have that Effect thereof which was intended by this House, the Lords Spiritual and Temporal in Parliament assembled do adjudge, order, and direct, That it be, and is hereby, referred to the Court of Chancery (which Court is hereby empowered and required thereunto), to see that an Accompt be stated, between the said Lord Byron and the said Sir William Juxon, of all such Monies and other Profits of the Tenths and Tithes of Rochdale, Saddleworth, and Butterworth, as the said Sir William Juxon or his Agents have received within the Time of Privilege of Parliament aforesaid; and that Execution may be thereupon had, by the Power of that Court, in Pursuance of the aforesaid Order of this House, made on the Fourth Day of February last."
