Mildmay and Cheeke, concerning the Barony of Fitzwalter.

Whereas Mr. Attorney Mountague on His Majesty's Behalf, and other Counsel, have this Day been heard at the Bar, in the Matter of Fact, on the Behalf of Robert Cheeke Esquire, who pretendeth a Claim to the Title of the Barony of Fitzwalter; as also on the Behalf of Benjamin Mildmay Esquire, in Answer thereunto:

This House being unsatisfied concerning the Issue of Egremond Radcliffe mentioned in the Pedigree [ (fn. 1) by which the said Parties do make out their Claim]:

It is ORDERED, That Counsel shall be heard, at the Bar, on Tuesday the 14th Instant, at Ten of the Clock in the Forenoon, to make out the Matter of Fact concering the Issue of the said Egremond, and at what Time they failed.

Sir D. Gawden and Stephens heard, concerning Paston's and Tenants of Horton Bill.

Whereas Counsel should have been this Day heard at the Bar, on the Behalf of William Paston Esquire, in Defence of a Bill (now under Consideration) to confirm an Agreement between him as Lord of the Manor of Horton, and the Tenants of the said Manor, for the Enclosure of Part of the Wastes of the said Manor, for the Preservation and Growth of Wood and Timber, and also on the Behalf of Sir Denis Gawden and Sir Thomas Stephens, Petitioners, on the Behalf of themselves and others, against the said Bill:

It is this Day ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Counsel of the said Parties, as well for as against the said Bill, shall be heard, at this Bar, on Friday the 10th Instant, at Ten of the Clock in the Morning.
