PRAYERS.

Nicholls and Faulkner versus

Upon the Petition of Francis Nicholls and John Fawkner, read this Day:

March and Sherborn, about Offices in the Ordnance.

ORDERED, &c. That the Order of the 17th of this Instant for Rich. March and Edw. Sherbourne, touching the Office of the Ordnance, and the keeping of His Majesty's Stores, (fn. 2) be suspended; and the said Nicholls and Fawkner shall execute the said Places until His Majesty's Pleasure be farther known.

Dorrell, a Protection, to attend his Cause.

ORDERED, That Marmaducke Dorrell Esquire shall have the Protection of this House, to come and go forth and back to the Lords Committees for Petitions, so long as the Cause between him and Char. Lee Esquire shall depend before their Lordships; in which Time he is to be freed from Arrests.

Writings, &c. belonging to the Crown and L. Craven, to be secured.

ORDERED, &c. All Writings, Evidences, Books, Court Rolls, Surveys, and Papers, that are at Worcester House, Gourney House, and Drury House, belonging to the late King, Queen, the Crown of Engl. and the Lord Craven, shall be secured, by Sir Edm. Sawyer and Sir Char. Harbert Knights, in the Places where they are; and they are to take Inventories of them: Nevertheless, all Purchasers may have Recourse unto them.

Ordinance for a Monthly Assessment.

The Ordinance for Assessments for Seventy Thousand Pounds a Month for Three Months, was read in Part.

Answer from H. C.

Mr. Rich and Mr. Escourt, Two of the Masters of the Chancery, that were sent to the House of Commons Yesterday, returned this Answer:

That they will give the Lords a Conference, in the Painted Chamber, this Day at Eleven of the Clock, concerning the Votes sent up, with the List of Names as is desired.

Conference about the Votes, and List of the late King's Judges, in which the Judicature of this House is concerned.

The Earl of Lincoln, the Lord Viscount Say, and the Lord Roberts, who were formerly employed by the House touching the Votes, were directed to prepare Reasons, to be offered at the Conference, touching the said Votes and List brought up with them; who returning into the House brought in the same.

Which were read, and approved of; and were delivered to the Earl of Manchester, who managed the Conference.

The House was adjourned during Pleasure; and the Lords went to the Conference.

To let the House of Commons know, "That their Lordships do not agree to these Votes as they were brought up, in respect they do intrench upon the ancient Privileges of this House; Judicature in Parliament being solely in the Lords House: And the Votes brought up were such.

"That, notwithstanding, their Lordships were so careful of the Matter, as they would not lose Time for the Manner; and therefore have issued out an Order of their own, for doing that which was desired; in which Order Colonel Tomlinson is omitted, according to the Desire of the House of Commons.

"That the Third Vote relates to a Council of State, which the Lords conceive not in Being; and therefore have Resolved, That such Emergencies as shall necessarily arise during His Majesty's Absence, and until His Pleasure be further known, for His Majesty's Service and the Peace of the Kingdom, shall be transacted henceforth by the Committee of Lords and Commons appointed for the Reception of His Majesty; wherein their Lordships desire the Concurrence of the House of Commons."

The House being resumed;

L. Lisle, concerning Pictures, &c. of the late King's.

The Lords were informed, "That the Lord Viscount Lisle conceiving that some Pictures and Statues are in his Custody which might be the late King's Majesty's, that he would keep them in Safety, and be ready at His Majesty's Command, or at the Command of this House, to deliver them as he shall be directed."

Order concerning Fellows of New College.

Upon Report of the Committee for Petitions, an Order was brought into the House; and, after some Debate had thereabouts, it was committed presently to a select Committee; (videlicet,) the Earl of North'ton, Earl Bridgewater, Lord Viscount Say, and the Lord Roberts; who returning it with some Alterations, (fn. 1) were read, and passed with the said Order, which concerned the Admission of some Fellows into New Colledge in Oxon.

E. of Suffolk concerning Somersham.

ORDERED, That no Waste be committed in Somsham, and other Places in Soaken, whereof the Earl of Suff. hath a Patent to keep to His Majesty's Use; and that the said Earl shall have the Possession thereof as formerly, until the Pleasure of the King be farther known.

Order to secure Records, &c. belonging to the King, Queen, and L. Craven.

It is ORDERED, by the Lords in Parliament assembled, That all such Writings, Evidences, Surveys, Books of Contracts, Receipts, and Payments, Court Rolls, Registers, Books, Papers, and other Transactions, touching or relating to the Sales of the Lands or Estates belonging either to the King's Majesty, Queen's Majesty, or Crown of England, or to the Lord Craven, which are now remaining either in Worcester House, Gurney House, and Drury House, or any of them, be inventoried, by Sir Charles Herbert and Sir Edmond Sawyer, Knights, or such as they shall appoint, for the doing of the same; and that all Purchasers may (as their Occasions shall require) have Liberty to view any of the said Books, Writings, &c. as may respectively concern them: And for so doing, this shall be their sufficient Warrrant in that Behalf.

Order to restore Fellows of New College to their Fellowships.

ORDERED, That Robert Grove, John Lamphire, John Geeres, Thomas Grent, John Grent, John Gardiner, Wm. Barker, John Beesely, John Price, and Robert Bowman, late Fellows of New Colledge in Oxford (and all others), who were unjustly ejected out of their Fellowships, be forthwith restored to their respective Fellowships, by the Warden and Fellows, according to the Statutes of the said College; and that all such Fellows as have been admitted into any Fellowships contrary to the Statutes be forthwith ejected; and that no new Fellow may be admitted contrary to the Statutes of the said College.
