That they have delivered the Bill concerning the vacating the Fines of Sir Edward Powell and his Lady.
L. Byron's Order.
ORDERED, and Declared, That it was their Lordships Intentions, that the last Year's Profits of the Rectory of Ratzdale and Saddleworth, in the Counties of Lancaster and Yorke, shall be answered to the Lord Byron or his Assigns; and all such Bonds as have been taken by Rob't Stockdale, for these Profits.
Sir W. Wray's Bill.
Hodie 2a vice lecta est Billa, "An Act to enable Sir Wm. Wray to sell Lands, for Payment of his Debts, and raising Portions for his younger Children."
ORDERED, That the Consideration of this Bill is referred to the same Committee as the Earl of Huntingdon's Bill stands committed (fn. 2) to; to meet To-morrow in the Afternoon.
Faunt's Bill.
Hodie 2a vice lecta est Billa, "An Act to enable George Faunt to sell and convey Part of his Lands, for Payment of Debts, &c."
ORDERED, That the Consideration of this Bill is committed to the same Committee as the Earl of Huntingdon's Bill stands committed to; to meet To-morrow in the Afternoon.
Sir T. Grymes' Bill.
Next, the House heard the Cause of Sir Thomas Grymes, by Counsel, at the Bar, touching the Matter contained in his Bill depending in this House.
And it is ORDERED, That the Consideration of the said Bill is re-committed to the former Committee; with this Direction, That a Proviso be added to the Bill, for the saving any Right which Doctor Wedderborne hath, either in Law or Equity; and that the said Committee do meet this Afternoon; and Mr. Justice Tyrrell is to assist their Lordships: And the Lord Vaughan is added to that Committee.
Bill to attaint the Murderers of the late King.
Next, the House was adjourned into a Committee of the whole House, to proceed further in the Consideration of the Bill of Attainder of the Murder of the King.
And after Debate, the House was resumed.
And the Lord Chamberlain reported to the House, "That the Committee have considered of the said Bill of Attainder; and the Committee have agreed to all in the Bill, without any Alterations, except in the Proviso concerning the Marquis of Worcester; to which their Lordships have thought fit to offer some Alterations therein."
Which Alterations, being read Twice, (fn. 3) were agreed to by the House.
"And that the Judges have been heard touching those Particulars referred to them on Wednesday last; to which they delivered their Opinions to the Committee, That the Salvo was full as to all those supposed Delinquents Lands which were in the Possession of any attainted by this Act."
This being reported, it was moved by a Member of this House, "That this Opinion of the Judges might be entered in the Journal Book of this House."
And it was ordered accordingly.
Hodie 3a vice lecta est Billa, "An Act for the Attainder of several Persons, guilty of the horrid Murder of His late Majesty."
And the Question being put, "Whether this Bill shall pass, with the Alterations now read, as a Law?"
It was Resolved in the Affirmative.
Message to H. C. with it.
A Message was sent to the House of Commons, by the Lord Chief Baron and Mr. Justice Atkins:
To deliver to them the Bill for Attainder; and to let them know, that their Lordships do agree to the said Bill, only with some small Alterations to the Proviso, concerning the Marquis of Worcester and the Lord Herbert, which Alterations are with the Consents of the Parties.
Hatfield Level Bill.
ORDERED, That the Bill concerning Hatfeild Levell shall be read the Second Time To-morrow Morning; and the Report of the Bill concerning College Leases is then to be reported.
Rodney versus Cole.
ORDERED, That the Cause between Rodney and Cole shall be heard on Tuesday Morning next, at this Bar, by Counsel.
L. Byron's Order, concerning the Rectory of Ratzdale and Saddleworth.
It is ORDERED and Declared, &c. That it is their Lordships Meaning, by their Order of the 13th of August last past, That the last Year's Profits of the Rectory of Ratzdale and Saddleworth, in the Counties of Lancaster and Yorke, shall be answered unto the Lord Byron, or his Assigns; or otherwise that Mr. Robert Stockdale, late Receiver to the Trustees, or William Bardslay his Deputy, do deliver up to the said Lord Byron, or his Assigns, all such Bonds, or other Assurances, as were by either of them taken of any Person, for Money concerning the Tithes for that Year's Profits of the Rectory aforesaid, remaining in the Hands of either of them; and that this Order shall be a sufficient Discharge unto the said Stockdale and Bardslay, and either of them, for the delivering up the said Bonds and Assurances to the said Lord Byron, or his Assigns, as aforesaid.
