ORDERED, That the Consideration of this Bill is committed to these Lords following:
Their Lordships, or any Five; to meet on Monday next, at Three of the Clock in the Afternoon, in the Prince's Lodgings.
Ld. Vaughan, Leave to be absent.
ORDERED, That the Lord Vaughan, Lord President of the Marches of Wales, hath Leave to be absent from this House; he being to go, by His Majesty's Leave and Command, to attend his Charge there.
Smith, Under Sheriff of Norfolk's Contempt.
This Day Roger Smith, late Under Sheriff of the County of Norfolke, being sent for as a Delinquent, upon the Complaint of the Inhabitants of the Town of Loestoft, for speaking scandalous Words against the Honour and Dignity of this House, and not giving Obedience to a Judgement of this House made in the Cause between the said Town and the Town of Yarmouth, was brought to the Bar, as a Delinquent.
And the Narrative containing the Matter of Charge against him, attested upon Oath by Sir Henry Bacon and Sir John Pettus at this Bar, was read unto him.
And then the Lord Chancellor demanded of the said Roger Smith, "what he could say for himself?"
His Answer was, "He denied that he used any such Words; but what he said was but by Way of Argument."
Hereupon it is ORDERED, That both Sides shall be heard, at this Bar, To-morrow Morning, concerning this Business of the Contempt, and speaking the dishonourable Words of this House.
Committee for Highways, &c.
ORDERED, That the Committee appointed to con sider of putting into Execution the Bills for mending Highways and the Streets, and for Relief of the Poor, shall meet on Monday next, at Three of the Clock in the Afternoon.
Ricar, Lord Craven's Servant, Privilege.
Whereas Richard Page, a Serjeant at Mace, is attached, by Order of this House, of the Ninth Instant, for arresting of Lewis Ricar, a menial Servant of the Lord Craven; and also George James is attached, at whose Suit he was arrested, knowing the said Ricar to be the Lord Craven's Servant:
The said Page and James were this Day brought to the Bar; and, after they had kneeled as Delinquents, they were charged by the Lord Chancellor with the Offences aforesaid, and were demanded what they could say for themselves.
The said James said, "He did not know the said Lewis Ricar to be Servant to the Lord Craven;" and Page pretended, "that he was ignorant at first that he was the Lord Craven's Servant; but as soon as he did understand him to be so, he did set the said Ricar at Liberty."
James and Page to be heard, concerning their arresting him.
Hereupon the House ORDERED, That the said George James and Richard Page shall appear at this Bar Tomorrow Morning; and then such Witnesses as can prove the Charge against them shall appear, to give in their Testimony, that so this House may the better proceed to Justice.
Herbert, E. Middletex's Servant, Privilege.
The House being this Day informed, by the Oath of William Wells, sworn at the Bar, "That Daniell Herbert (being owned by the Earl of Midd. a Peer of this Realm to be his menial Servant) was arrested, and is imprisoned, by Francis Grimes, Under Sheriff of the County of Warwick, and Hugh Meades his Deputy, Thomas Rownd and Josias Rogers Bailiffs, contrary to the Privilege of Parliament:"
Grymes, Meades, et al. to be attached for arresting him.
It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Serjeant at Arms attending this House shall attach the Bodies of the said Francis Grimes, Hugh Meades, Thomas Rownds, and Josias Rogers, as Delinquents, and forthwith bring them before the Lords in Parliament, to answer their said Offences; and that the said Danyell Herbert shall be permitted by the said Francis Grimes to make his Appearance in this High Court at the same Time: And this to be a sufficient Warrant in that Behalf.
Adjourn.
