Money for the E. of Northumb. for the King's Children.

In respect of the great Sums of Money disbursed by the Earl of Northumberland, for the King's Children:

It is Ordered, That the Monies now in the Hands of the Commissioners of the Old Customs shall be paid unto the said Earl, or his Assigns, towards the satisfying of his Lordship what he hath disbursed for the Use of His Majesty's Children; and the Concurrence of the House of Commons to be desired herein.

Answer from the H. C.

Dr. Aylett and Mr. Eltonheade return with this Answer from the House of Commons:

That they agree to the Alterations in the Instructions to be given to the Commissioners that are to go to the King, in the Isle of Wight, and (fn. 1) likewise to the Pass for Uriah Babbington to go to the King: To the rest, they will send an Answer by Messengers of their own.

Capt. Titus to go to the King.

Ordered, That Captain Titus shall have a Pass, to go with the Commissioners into the Isle of Wight.

Hooke to be Receiver of the First Fruits.

Ordered, That Mr. John Hooke shall execute the Receiver's Place of the First Fruits, which Mr. Sweetenham lately deceased enjoyed; and the Concurrence of the House of Commons to be desired herein.

Message to the H. C. about it;—for the E. of Northumb. to have Monies;—and to remind them of Petitions.

A Message was sent to the House of Commons, by Dr. Heath and Mr. Eltonheade:

1. To desire their Concurrence in the Order concerning the Earl of Northumb. to have the Monies paid him which he hath disbursed for the Use of the King's Children, out of the Monies now in the Hands of the Commissioners of the Old Customs.

2. To desire their Concurrence in the Vote concerning Mr. Hooke.

3. To put them in Mind of Sir Frederick Thynn's Petition.

4. To put them in Mind of Captain Jessop's Petition.

Ordered, That the Lord Allington's Son, with his Tutor Mr. Harrison, shall have a Pass, to go into France, with Two Horses and their Necessaries.

Perchard and Rowland.

Ordered, That the Cause between Perchard and shall be heard, by Counsel on both Sides, at this Bar, on Thursday come Fortnight.

Knipe & al. a Pass.

Ordered, That Isaac Knipe, Nath. Knipe, Charles Reade, and Samuell, shall have a Pass, to go to Callais.

An Order for One Thousand One Hundred and Thirteen Pounds to be paid to Captain Parsons, out of Malignants or Rebels Estates in Ireland, and the Interest of Two Thousand One Hundred and Eighty-five Pounds, as by the former Orders is expressed, was read, and Agreed to.

An Order for paying Seven Hundred and Thirty Pounds, Four Shillings, to be paid to Colonel Wm. Herbert, was read, and Agreed to. (Here enter it.)

An Order for adding Wm. Dingley Esquire, and others, to the Committee of Sequestrations for the County and City of Worcester, was read, and Agreed to.

Ld. Bruce versus Butt & al. for a Riot in Gillingham Forest.

Upon reading the Petition of John Phillips, Thomas Greene, John Reade, Thomas Butt, and Thomas Greene Junior, being committed for disobeying the Orders of this House, in disquieting the Possession of the Lord Bruce, in Gillingham Forrest, in the County of Dorsett:

It is Ordered, That they shall be released of their present Imprisonment; receiving an Admonition to give better Obedience to the Orders of this House, and to carry themselves peaceably and quietly, and to do what they do for Trial of their Right in a legal and just Way.

Message from the H. C. with Instructions for Martial Law at Sea;—and with Orders.

A Message was brought from the House of Commons, by Mr. Greene; who brought up divers Particulars, wherein their Lordships Concurrence is desired:

1. Instructions for Martial Law to be given to the Lord Admiral, for better ordering and governing of the Fleet.

Read, and committed to the whole House; to be taken into Consideration the next Time the House sits.

2. An Order for a Hundred Pounds to be paid to the Commissioners that are to go to the King, in the Isle of Wight. (Here enter it.)

Agreed to.

3. An Order for the Committee of the County of Lync. to collect the Arrears of the Army in that County.

Order to raise Forces in Lincoln.

4. An Order for Commissions to be granted to such as the Gentlemen in the County of Lync. shall desire.

The Order for the Committee of the County of Lyncolne, was read, and committed to these Lords following:

That this House agrees to the Order for the One Hundred Pounds for the Commissioners, and to the Order for One Thousand Pounds apiece for Colonel Carter and Lieutenant Colonel Twisleton: To the rest, they will send an Answer by Messengers of their own.

Baron Atkins to be a Justice of the Common Pleas:

Ordered, That Mr. Baron Atkins be translated from the Place of a Baron of the Exchequer, and to be made One of the Justices of the Common Pleas, in the room of Mr. Justice Godbold, lately deceased; and that His Majesty's Solicitor do prepare a Patent for the said Place accordingly; and that the Commissioners of the Great Seal do pass a Patent in usual Form: And this to be a sufficient Warrant. The Concurrence of the House of Commons (fn. 3) to be desired herein.

Morgan's Order.

An Order for Anthony Morgan to have Indemnity, was read, and Agreed to; and ordered to be sent to the House of Commons for their Concurrence.

E. of Thanet exempted from Imposition of Horse, &c.

Ordered, That the Earl of Thanett shall be exempted from any Imposition of any Committee of Horse and Arms, without special Order of this House; his Lordship being a Peer of this Realm.

Capt. Carter to have a Troop in Cheshire.

"Ordered, by the Lords and Commons assembled in Parliament, That it be referred to the Committee of Derby House, to grant a Commission to Captain William Carter, according to the Desires of Colonel Robert Duckenfeild, expressed in his Letter of 17 Junii, 1648, directed to the Speaker of the House of Commons."

Order for 1113 l. to Capt. Parsons.

"Ordered, by the Lords and Commons in Parliament assembled, That the Sum of One Thousand One Hundred and Thirteen Pounds, due to Captain William Parsons, for Interest for Two Thousand One Hundred Eighty-five Pounds, Five Shillings, appeared to be disbursed by him for the Service of the Parliament, shall be satisfied and paid to the said Captain William Parsons, or his Assigns, out of Malignants or Rebels Estates in the Kingdom of Ireland, whereof Colonel Jones, and all and every other the Governors and Commanders in Chief of the Parliament's Forces in the several Parts of the Kingdom of Ireland now being, and which hereafter for the Time shall be, and the Chief Governor or Governors of the Kingdom of Ireland which for the Time shall be, and such Commissioners and other Person or Persons as shall be intrusted for, or any Way concerning, the said Malignants or Rebels Estates in Ireland, and all others whom it may concern, are to take Notice, and to take Care that the said Captain William Parsons, or his Assigns, do receive the full Fruit and Benefit of this Order, out of the said Malignants or Rebels Estates in Ireland, by Way of Custodiam, Sequestration, or otherwise, as may be most for the speedy Payment of the said Money, and the Advantage and Satisfaction of the said Captain William Parsons."

Order for 730 l. 4s. 10 Col. Herbert.

"Be it Ordered and Ordained, by the Lords and Commons in Parliament assembled, That the Sum of Seven Hundred and Thirty Pounds, Four Shillings, due unto Colonel William Herbert, being Monies long since disbursed by him for the Service of the Parliament, and Interest grown due for the same, be charged upon the Receipts of the Grand Excise, in Course, with Interest after the Rate of Eight Pounds per Centum, payable every Six Months, to be paid unto the said Colonel Wm. Herbert, his Executors, Administrators, or Assigns; whose Acquittance or Acquittances shall be a sufficient Warrant and Discharge unto the Commissioners of Excise, for the Payment of the said Sum of Seven Hundred and Thirty Pounds, and Interest, or any Part or Parcel thereof, accordingly."

Committees for Sequestrations in Worcester.

"Ordered, by the Lords and Commons assembled in Parliament, That William Dingley, Henry Bromley, John James, Jervas Buck, Esquires, and Edward Elvins Gentleman, be added to the Committee for Sequestrations for the County and City of Worcester."

Order for 500 l. for victualing Garrisons.

"Ordered, by the Lords and Commons assembled in Parliament, That the Sum of Five Hundred Pounds be forthwith provided, for victualing some Garrisons that are of special Consequence; and that this Sum of Five Hundred Pounds be charged upon the Monies brought in by the Committee usually sitting at Habberdash'rs Hall, out of the First Monies that shall arise upon the Payment of the Fifth and Twentieth Parts; and that the said Five Hundred Pounds be paid to such as the Committee of Lords and Commons sitting at Derby House shall appoint to receive the same; and that their Receipts for the same Monies shall be a sufficient Discharge to the Treasurers at Habberdash'rs Hall; and that the said Monies be laid out by the Direction of the said Committee."

Order for raising Forces in South'ton.

"Ordered, by the Lords and Commons assembled in Parliament, That it be referred to the Committee of Derby House, to grant Commission to the Mayor of South'ton, for listing and raising such Forces under the Governor of South'ton, of the well-affected in the said Town, as he shall think fit, for the Defence and Safety of the said Town."

Committees for Sequestrations in Surry.

"Ordered, by the Lords and Commons assembled in Parliament, That Sir Wm. Brereton, Thomas Scott Esquire, Mr. John Beauchampe, Mr. John Fenwick, Major Lewes Audley, Mr. James Jordan, Mr. Thomas Moore, Mr. Edmond Moore, and Captain Riche of Chepsted, be added to the Committee of Sequestrations for the County of Surrey."

Order for 100 l. for the Commissioners going to the King.

"Ordered, by the Lords and Commons assembled in Parliament, That Mr. George Wilmer, Customer of the Petty Customs in the Port of London Inward, do pay unto the Committee appointed to go to His Ma jesty, about a Treaty for a Peace with His Majesty, or to such Person as they shall appoint, the Sum of One Hundred Pounds, towards the defraying the Charges of the said Committee, whose Receipt, with this Order, shall be his sufficient Discharge; and that the said Committee be allowed and paid the Residue of their Charges to be expended in the said Journey, by the Committee of Revenue, upon Accompt."

Order for 1000 l. apiece to Col. Carter and Lieut. Col. Twisleton.

"Ordered, by the Lords and Commons assembled in Parliament, That One Thousand Pounds apiece be advanced, upon Accompt, unto Colonel John Carter and Lieutenant Colonel George Twisleton, or their Assigns, towards their Disbursements and Arrears, to be paid out of such Delinquents Estates, Fines, or Compositions, in North Wales, as joined with Sir John Owen in his late Insurrection there, or endeavoured the Surprize of Denbigh Castle, which they, or either of them, shall nominate and present to the respective Commissioners for Sequestrations there, or the Committee at Gouldsmiths Hall."
