Message from the H. C. with an Ordinance.

A Message was brought from the House of Commons, by Mr. Vassall, &c.; who brought up an Ordinance for reimbursing Four Thousand Pounds by the City of London, for the further carrying on of the Treaty, wherein their Lordships Concurrence is desired.

That this House agrees to this Ordinance now brought up.

Message to the H. C. to revoke the Bp. of Exeter's Leave to go to the King;—and with the Ordinance concerning Contractors for Bishops Lands.

A Message was sent to the House of Commons, by Doctor Heath and Mr. Eltonbeade:

To let them know, that this House, considering that Doctor Brownrigg late Bishop of Exeter is under Restraint, and so uncapable to go to the King, in regard that there is a Vote of both Houses that no Person under Restraint shall attend the King; therefore this House thinks it fit to revoke his Leave formerly given him, and desire their Concurrence therein.

2. To deliver to them the Ordinance concerning Contractors of Bishops Lands, and desire their Concurrence in the Addition.

Ely to be instituted to Shrewsbury.

Ordered, That Doctor Aylett give Institution and Induction unto Ro. Ely Clerk, to the Vicarage of Sb'ew'bury, in Com. Salop; salvo Jure cujuscunque: Great Seal.

Jennings' Petition.

Upon reading the Petition of Francis Jennings:

It is Ordered, This House leaves the Business to the Proceedings in the Chancery.

Barley to be attached, for using his Brewhouse in Long Acre.

Upon reading the Affidavit of John Blewett; shewing, "That one Barley goes on in brewing, in the newerected House which he lately built in Long-acre, in Contempt of the Order of this House:"

It is Ordered, That the said Barley shall be attached as a Delinquent, and brought before the Lords in Parliament forthwith, to answer his said Contempt.

King's Answers to the Propositions.

The House was adjourned into a Committee during Pleasure, to consider of the King's Answer to the Propositions, to see how far the King hath given Satisfaction, and wherein not.

The House being resumed;

It is Ordered, To have a Committee; and to send to the House of Commons, that they would appoint a Committee of their House to join, to peruse all the King's Papers, and see where the Difference is. And the Speaker to draw up the Heads of the Powers against To-morrow, to be offered at a Conference.

"Some Offers having been made to the Contractors, in the Beginning of their Sitting, by immediate Tenants (fn. 1) "

Order to reimburle 4000 l. to the City lent by them for the Treaty.

"The Lords and Commons assembled in Parliament, being desirous to borrow of the City of London the Sum of Four Thousand Pounds, to be employed for the further carrying on of the Treaty, do hereby ordain and declare, That all and every Person and Persons that shall advance the same, or any Sum or Sums of Money towards the Raising thereof, shall be re-paid (so much as he or they shall lend) out of the Grand Excise, in Course, and out of the Moiety of all Compositions made or to be made with Delinquents at Gouldsmiths Hall, or either of them which shall first happen, in Course; that is to say, out of the Moiety not engaged to the City of London for the Four Hundred Thousand Pounds by them formerly lent (the Engagements thereupon already being first discharged), together with the Interest to be due thereupon, after the Rate of Eight Pounds per Cent. per Ann. from the several Times of the Lenders paying thereof; which said Interest shall be paid, by the Commissioners of the said Grand Excise, to the several and respective Lenders, their Executors, Administrators, or Assigns, every Six Months, until the Principal be fully discharged; whose Receipts shall be sufficient Discharge to the said Commissioners of the Excise, and Treasurers of the said Compositions, for the several Sums of Money by them paid by virtue of this Ordinance, for Principal and Interest as aforesaid: And be it further Ordained and Declared, by the said Lords and Commons, That the said Commissioners of the Excise for the Time being, and the Treasurers for the Compositions of Delinquents Estates as aforesaid for the Time being, shall and are hereby severally and respectively required and authorized to pay the said Principal and Interest to the said Lenders, their Executors, Administrators, or Assigns, in Manner and Form aforesaid: And the said Lords and Commons do hereby constitute and appoint Gilbert Harrison, Chamberlain of the City of London, to be Treasurer for the receiving of the said Four Thousand Pounds, or so much thereof as shall be brought unto him; and he to give Receipts to such Person and Persons as shall advance the same, the which Receipt or Receipts shall be a sufficient Ground to such Person and Persons to whom the same are or shall be given, their Executors, Administrators, and Assigns, to require and receive the Money so by them lent as aforesaid; and that the said Chamberlain, hereby appointed Treasurer, shall pay and issue forth the Monies so by him received, unto Thomas Falkonbridge Esquire; and that his Receipt shall be a sufficient Discharge to the said Chamberlain for Payment thereof: And the said Thomas Falkonbridge is hereby further authorized and required to pay over the said Sum of Four Thousand Pounds, as it shall come in, to Francis Cressett, to be employed for the Uses aforesaid; and that the Acquittance or Acquittances of the said Francis Cressett shall be from Time to Time a sufficient Discharge to the said Thomas Falconbridge for the Payment of the said Sum of Four Thousand Pounds, or any Part thereof, accordingly."

Bromrigg, Bp. of Exeter's Leave to go the King, revoked.

"Whereas, by former (fn. 2) Order of both Houses, Doctor Bromrigge was voted to go to the King, to the Isle of Wight: It is now Ordered, by the Lords and Commons assembled in Parliament, That the said former Order be, and is hereby, recalled; the said Doctor Bromrigg being under Restraint."
