Commissions of the Peace
1. COMMISSIONS OF THE PEACE 1509 TO 1514. | ||
* The Patent Roll references to the following will be found under their several dates in the Calendar. The names are generally given in the order which follows, but there are occasional changes, some of which are noted below. | ||
[N.B.—The commission of the peace since the first year of Edward IV. had run as follows:— | ||
A. The commissioners shall enforce the statutes of Winchester, Northampton and Westminster, for conservation of the King's peace, the statutes made there and at Cambridge concerning hunters, workmen, artificers, servants, innkeepers, beggars and vagabonds, and other begging men who call themselves 'travelyngmen,' the statutes of Westminster 1 and 2 Hen. IV. against liveries, and all other ordinances for the quiet rule of the people; and shall punish delinquents and bind over such as use threats. B. They are assigned to enquire of all trespasses, negligent officials and indictments still pending; and to present indictments. C. They, and especially certain of them, named, of whom (quorum) one shall always be present, are assigned to hear and determine trespasses. D. They shall enforce statutes of Henry V. made at Leicester against Lollards and at Westminster against persons tampering with the coinage. E. The quorum above mentioned are assigned to enquire of felonies. F. The quorum are assigned to hear and determine felonies. G. Difficult cases are to be reserved for the judges, and amercements to the King, &c. | ||

Ball of Isham, found a true bill against Richard Emson late of Estneston, Ntht., knight, viz.:—That, perceiving on 12 March last that the King's illness would prove fatal, he resolved to seize the government of the young King and realm for himself and others of his affinity and opinion, and, on 20 March, wrote to his son Thomas Emson at Estneston to prepare men; whereupon Thomas wrote, 24 March, to Rob. Saunders of Stouton, John Harrys of Kyngesthorpe, John Thorne of Abthorpe, John Grendon of Calcote and Benedict Davy, Henry Barker and Wm. Norton of Toucestre; and afterwards, down to the day of the King's death on 22 April, Harrys retained John Stalworth, Robert Warwick and others unknown for 1d. each; and afterwards, speaking with Stalworth and Warwick on 16 April, asked them "Will ye be the same men that ye were?" They replied, "We will keep our promise that we have made." Davy and one John Kyssylbury with four or five others rode towards London on 12 April in fulfilment of Emson's wish. On the late King's death, 22 April, Sir Richard wrote to his son and the persons retained to come to London by separate companies; whereupon Thomas Emson sent out letters and he and 9 others (named, one chaplain, one gentleman, and the rest yeomen) rode to London on 24 April, as also did Saunders and his servant on the 25th and Thorne and four others (named) on the 26th. A petty jury, consisting of John Tresham, Ralph Lane, Miles Worsley, Wm. Lynne, Th. Palmer, John Foxley, Ric. Russell, Edmund Huntwade, John Byrde, Ric. Aleyn, Wm. Holcote and John Hertwell, brought in a verdict of guilty and that Emson possessed lands and money (specified) in the county. Verdict as usual. | ||

Begs that Jerome Friscobaldi may have licence to send over certain silver plate which he is having made in Flanders. Understands she is busy making an agreement between the said Jerome and those who "donnoient empeschement aux allums qui furent admenez de Turquye," and begs that Englishmen concerned with the said alum may be included in the agreement and be absolved like the rest. If the Venetians declare themselves ready to restore the Emperor's cities and lands, they should be accepted into the League. If they refuse, Ferdinand has ordered 400 men at arms from Naples to join the Emperor's army before the end of April and will also send six galleys; but he can do no more, considering the payments he has to make to the Emperor and France and against the Infidels in Africa. Has written to Caroz to promote peace between England and France. | ||

Understands from her letter dated Ghent, 8 April, that she blames him for the King of England's making alliance and his people taking pensions of the King of France, in the way which her secretary Marnyx has explained. This alliance has been made so soon that whatsoever answer he might have made, as she advised, to the King of Aragon, his messenger could never have returned to England in time to break the alliance. The alliance is not against us, considering our peace with the King of France, and if that King wishes to do harm to his (England's?) brothers-in-law, our children, it is always in his power to help his friends and oldest allies. The news helps us greatly in our war undertaken against the Venetians. Refutes her charge that he writes rude and strange letters to her. 15 April. | ||

Borgo wrote on the 6th inst. of the coming of Dr. Motte and expected coming of the bp. of Gurk.* * *. Two English ambassadors have arrived, viz., the Great Prior of the Order of Jerusalem and Dr. Suester, being met four leagues from hence by the bailly of Amiens and Darisoles, and welcomed by the brothers of the dukes of Savoy and Lorraine, the bp. of Paris and all the gentlemen at the Court. Three days ago the King gave them their first audience, in presence of the writers; and the Doctor's speech, in which he said that his King would always be like a son to the Most Christian, gave great satisfaction. Afterwards the writers visited them, with the ambassador of Aragon. They said that, within three years, the bride should be brought and the marriage made; which hardly agrees with recent news that an embassy of the Emperor and Margaret was now prepared to fetch her. Banquets have been given daily to the English ambassadors and yesterday, by the King's wish, M. d'Angoulême and the Duke of Savoy's brother, with others, made a tourney in which Angoulême bore himself well, the King riding about on a Spanish jennet in the midday sun like a youth of 25 years. The following is a translation of the German portions of No. 2173:— | ||
"Of the honourable and sumptuous reception and friendly courtesy shown by the King of England to the Emperor Maximilian in Picardy; and of the attack and defeat which took place there before Terouenne. Also what and how many people there were slain and captured. Also the siege of the town of Tournay and other strange histories." | ||
[On the 11th Aug. the Emperor rode out from the town of Aire and met the King of England.] | ||
"The King of England is a proper man of very good figure, a merry, handsome (well coloured, § 2) face, well spoken, popular and intelligent; and, as befits his youth, bold and warlike, and not yet 33 years old. He rode clad in his armour without the helmet, wearing a surcoat of cloth of gold; his hair bound in a rich golden cap in which were set many rich precious stones. It was covered with a red shaggy hat with many red feathers. He sat a beautiful brown stallion, the bridle and harness laid with pure beaten gold plates. There hung to the martingale (furbiegen) and the harness (geschmeid) many golden bells, each about 2oz. in weight, some of which were so loosely fastened that when he made his stallion bound one or other of the golden bells fell off and he called to a German to pick it up and keep it, and none of his own people might pick up any. After him went 14 beautiful stallions of all colours, their reins and harness laid with beaten silver, and also thereto fastened silver bells which rang out as they rode. On them sat fourteen boys, each clad in a golden coat and, over it, because of the rain, a scarlet mantle edged with green velvet. And at the halt, if they saw a German admiring their stallions, they would pull off a bell and give it him, each of which weighed one and a half or two oz. of good silver. Of these bells many were thus given to the Emperor's people, especially the footguards. Of the King of England's servants and lords riding with him many wore coats completely covered with gold and silver plates bound together with rings instead of seams, others cloth of gold, velvet and rich clothing; and they were provided with beautiful stallions. He was reckoned to have about 2,500 horse in his pay (in the field, § 2) that day. The Emperor, too, had with him from the town 1,000 horse. | ||
"Afterwards, on the 14th, the Emperor again rode out; and, when he came about halfway to the English camp, the King with certain of his lords and gentlemen came to meet him and again received him with great courtesy. He had not many mounted men, but had his footguards or halberdiers with him, of whom about 300 all clad in one colour ran with him on foot. [From a tower the King showed the Emperor] what belonged to the town ? (what battery he had made, § 2). Whilst both lords were on the tower the King had placed all his people who were in camp in lines (in gassen weisz) everywhere three or four deep. He conducted the Emperor through to inspect this. They are really big strong men having a captain to every hundred, and their pennon on a long spear as our horsemen carry them. It is carried with both hands in front against the breast. Some have English bows, some crossbows, certain of them maces with long handles and certain of them long spears; and almost all are clad in long white coats edged with green cloth and wear breast plates, and steel caps on their heads. For their field music they have a fluteplayer (schalm) and a bagpiper (sackpfeiffer) who play together (and certain of them a trumpet, § 2). | ||
"When the Emperor had ridden through the men (through all the lines of men, § 2) the King conducted him into his camp. There were certain tents together hung throughout with white cloth and in the entry of the tents guards stood here and there and one with a naked sword; and the arrangement of the tents looked like a castle or little town. Entering the gateway, one passed into the tents, first a tent then a passage between, then another tent covered here and there with gold until one came to the King's tent, which was of a handsome size. Inside, all over from the ground to the roof, it was covered with red florins and pure drawn ducats and gold ornaments (covered with rich cloth of gold of pure drawn gold thread § 2). There is also therein here and there a beautiful gilded sideboard of very large vessels and flagons, among them some drinking cups all of gold, which are looked after by certain persons who are thereto appointed. And whosoever came in was presented with wine and English beer. The outside of the tent was likewise from the ground to the summit overlaid with good cloth of gold (with good rich cloth of gold overlaid and covered) an ell of which, as the Emperor's tailor estimated, was worth 33 florins. That was the value of every ell up to the summit. Above it stood a lion all of gold holding the arms of England in its paws (claws, § 2) and more than two span in length over all. In that tent the Emperor ate his supper, which was always prepared by his cook. Out of the tent one goes through a passage, covered within and without with cloth of gold, into a council house which puts together and takes to pieces again. It is painted red outside, and within is hung with golden tapestry. Therein stood the King's bed, hung round with a curtain of very precious cloth of gold, the gilt woodwork being carved and very well finished. A similar tent and sideboard the King of England presented to the Emperor with great courtesy. And when the Emperor had eaten and advised about the matter in hand until 11 o'clock at night his Majesty went back to the town. | ||
"On the 16th the Emperor went again to the field and by his persuasion the King, in the night, with his camp and the camp of the German soldiers, crossed the river and pitched his tent and camp on a hill there; and, that it might be pitched safely, he put his men in order and marched to another hill some two hours before daybreak. About twelve o'clock the French in three divisions appeared upon another hill (for here and there are little hills and valleys); and as soon as the Emperor knew it he got up and sent for the German horsemen, numbering scarcely 1,050, and the Burgundians, about 1,000 (or 2,000), and commanded to muster the troops and to keep the Germans by him. The French united in one division amounting to 10,000 (or 7,000) cavalry in array and fired guns at the Emperor's horsemen, but all went too high and did no hurt. Thus the Burgundians and certain English struck [them], and as they turned and the Emperor saw the Burgundians hard pressed, he at once ordered the German horsemen to attack on the flank; but before they struck the French had turned about and fled. Our horsemen pursued them until within a short mile of their camp and brought back the prisoners and banners hereafter indicated. When the Emperor saw that no more harm could be done them, and they were near their camp wherein were yet 20,000 foot, he retired all the men in good order and marched to the camp, remaining all night in the field. In this skirmish the English used no other cry than Burgundia." | ||
