Halsham. The said John le Conestable, on Thursday after the Exaltation of the Holy Cross last, being of good memory but afflicted with great weakness and languishing in extremis, about an hour (spacium unius leuce) before the hour of vespers, made his charter touching the said manor, except a certain chamber, to the above William, John, and William, and, on the same day, about the hour of vespers, he died. The said William, John, and William were seized, before the said John’s death, of the said manor, except the aforesaid chamber, and the attornment and services of the free tenants there, but received no issues or profits thereof; and the said alienation was not made by any one’s procurement. The said John Conestable, when he made this alienation was not sound and unimpaired (sanus et incolumis), made it in fear of imminent death that the feoffees might, after his death, enfeoff Aubrey (Abbredam) his wife for her life, with reversion to his right heirs. Immediately after his death, the said William, John, and William did so enfeoff the said Aubrey (Albredam) with remainder to the said right heirs. Afterwards John Sturmy, now husband of the said Aubrey, enfeoffed of the said manor Henry fitz Henri, knight, and John Coursy, to hold for the said Aubrey’s life, and on Thursday, 11 March last, whilst the said Henry and John Coursy so occupied the said manor, Peter de Grymesby, the escheator in Holderness, delivered, in pursuance of the king’s writ, two parts of the said manor to Thomas Ughtred, knight, to whom the king had committed the custody of the said John le Conestable’s lands until the lawful age of his heir. By virtue of which commission and livery, the said Thomas holds two parts of the said manor, and the said escheator has the custody of the third part to the king’s use. The said escheator, on the day of the said John’s death, seized the said manor into the king’s hands.

Halsham. To the same effect as above, adding that the said John afflicted with great weakness for four days preceding, at the time of the mortality then raging (vegetantis) in those parts, languishing in extremis, about that hour of the day called ‘Midovernone,’ made a charter touching the said manor to the above said William, John and William, and died on the same day about the hour of vespers. Before his death, the said William, John and William had seisin in the manor, except a certain chamber in which the said John died, and the attornment, rents and services of the free tenants, whereof they were not seized on account of the shortness of time between the hour of the feoffment and the hour of the death; and they received no issues or profits either before or after the death except that the said William de Holm had a mare and John Coillour a mare and a foal in the common of pasture of the said manor during the life of the said John le Conestable, by his licence, which used the said common of pasture a fortnight after the said John’s death. All the said John’s goods and chattels in the manor at the time of the said feoffment and seisin and for some time after his death, remained there.
YORK. | Memorandum that John Coillour of Halsham, vicar of the church of Aldeburgh, and William Vescy, chaplain, whom John le Conestable, of Halsham, enfeoffed of the manor of Halsham, which the king seized into his hand by reason of the minority of John, son and heir of the said John Conestable, have put in their place William de Houeden and John Courcy, to sue against the king for the removal of the king’s hand. Undated. |
YORK. |
Memorandum that Henry son of Henry, who, together with John Courcy, was seized of the manor of Halsham, which manor the king seized into his hand by reason of the minority of John, son and heir of John le Conestable of Halsham, of which manor the said John le Conestable, the elder, enfeoffed in his lifetime John Coilliour, William Vescy, and William de Holme, puts in his place William de Houeden and John Courcy, to sue against the king, for the removal of the king’s hand. Undated.
Indenture made between the king of the one part and Thomas Ughtred, knight, of the other part, witnessing that whereas the king has committed to the said Thomas the custody of the lands, &c. late of John le Conestable of Halsham in the parts of Holdernesse, until the lawful age of John, the son and heir, rendering 100 marks yearly into the king’s chamber; and also has granted to him the marriage of the said heir, rendering into the said chamber 400 marks, to wit, 100 marks each Easter and Michaelmas until fully paid, the said Thomas binds himself, to pay 200 marks for each 100 marks unpaid within fifteen days after the said terms; 24 November, 23 Edward III. French. Copy of grant to the aforesaid Thomas Ughtred of the custody of the above lands, &c., as above; 22 November, 23 Edward III. By writ of secret seal. Copy of grant to the said Thomas Ughtred of the custody of a third part of the manor of Halsham, rendering yearly to the king 20 marks; 3 March, 25 Edward III. By letter of the Griffoun. Petition of Thomas Ughtred to the Council. As Henry de Greystok has granted to John Sturmy and Aubrey his wife, a third part of the manor of Halsham, parcel of the aforesaid tenements, by reason whereof the petitioner has been hindered from taking the said third part granted to him by the king at a rent of 20 marks yearly, which 20 marks and the above 100 marks he has already paid for three years, he craves allowance for these payments. French. Undated. Endorsed: Let this petition be remitted to the Chancery, and let the steward of the king’s chamber be called thereupon, and what has been done in this business be viewed and shown, and returned into the Chancery; let right be done therein, as well for the king as for the said Thomas. Petition of Henry son of Henry, of Ravensworth, and John Courcy to the king and council. John le Conestable of Halsham was seized of the manor of Halsham, and held it of the king in chief, as of the honour of Aumale, which manor, except one chamber, the said John gave to John Couliour, vicar of the church of Aldeburgh, and William Vescy, chaplains, and William de Holme: and died the same day, at the time of the pestilence in those parts: the said John, William, and William afterwards gave the said manor, with the above exceptions, to Aubrey, late the wife of the said John le Conestable, for her life, and afterwards to the right heirs of the said John; which Aubrey afterwards took to husband (a baroun) one John Stourmy. After an inquisition taken upon a writ of diem clausit extremum, Sir Thomas Ughtrid, to whom the king had committed the wardship &c., came and stated in the Chancery that the said John died seised of the entire manor of Halsham, and had a writ to the escheator ad melius inquirendum (de meultz enquere), whereupon it was found that the said John enfeoffed the aforesaid John, William and William of the said manor, who were to enfeoff the said Aubrey in form aforesaid. (Inquisition of 21 November, 23 Edward III.) Afterwards John Sturmy gave the manor to the petitioners, whereupon the said Thomas prayed for a commission ad melius inquirendum (de meltz enquer), and had the same made to himself and Sir Henry Graystok and Sir Robert de Hilton, who made two inquisitions and found that the said John le Conestable enfeoffed the said John, William and William, &c., as above. (Two inquisitions of 1 April, 24 Edward III.) In the meantime the said Sir Thomas had a writ from the Chancery to the escheator to deliver to him all the lands &c. of the said John &c.; by virtue whereof the escheator delivered to him two parts of the whole manor, and retained the third part in the king’s hand, thereby depriving the said Henry son of Henry and John Courcy of the entire manor, whereof they pray restitution, except as above excepted, and for removal of the king’s hand, for there is nothing found in the inquisitions, by which the manor ought to remain in the king’s hand. French. Undated. Endorsed: Referring the matter to the Chancery where issue has already been joined. |
