Writ of scire facias, to the sheriff of Stafford, 3 May, 1 Edward III. | |
Whereas the late king, 7 September, 12 Edward II, had out of the two-third parts of the lands and tenements late of Theobald de Verdoun, who held of the said king in chief, then in his hands, assigned to Thomas de Furnivall, de Furnyvall or de Fournivall, the younger, and Joan his wife, the eldest of the daughters and one of the heirs of the said Theobald, who had completed her age, the castle and manor of Alveton, with its members of Bredeleye, Farlegh, Coton, Wotton, Denston, Staunton, Stromgeshulle, Buckenhale, Fenton and Barderdeleye, which were extended at 29l. 11s. 4d. yearly, to hold as the pourparty of the said Joan of the said two parts, and having taken fealty of the said Thomas, had commanded the said pourparty to be delivered to them, as by the rolls of the chancery appears; and whereas Bartholomew de Burghessh, who took to wife Elizabeth, daughter of the said Theobald, and William le Blount, who took to wife Margery, the third daughter of the same Theobald, and the said Elizabeth and Margery, who have proved their ages, have brought suit that the reasonable pourparties of the said Elizabeth and Margery out of the said lands and tenements late of the said Theobald, which were taken into the hand of the late King Edward II, should be assigned to them, asserting that in the said castle and manor of Alveton with its members there are more than 60l. of yearly rent and divers lands and tenements, of which no mention is made in the extent or assignment; wherefore they have prayed the king to resume into his hand the said castle, manor and hamlets and all other lands and tenements of the said Theobald, which upon his death were taken into the hand of the late King Edward [II], and thus are in the present king’s hand, and to cause them to be extended according to their true value, and reasonable pourparties to be made in three equal parts, and assigned and delivered to the said Joan, Elizabeth and Margery:—the king commands the sheriff to warn the said Thomas and Joan to be in the king’s chancery on the morrow of Holy Trinity, which day the king has also given to the said Bartholomew and Elizabeth and William and Margery to show cause why the said castle, manor and hamlets should not be resumed into the king’s hand and be again extended, and to receive judgment.

Whereas the late king in the partition of the lands and tenements late of Theobald de Verdon, tenant in chief, according to the extents made on his death, into four parts between the heirs and co-parceners of the said Theobald, viz.—Joan the wife of Thomas de Furnivall, the younger, and Elizabeth and Margery, her sisters, daughters of the said Theobald by his first wife and Isabel, daughter of the same Theobald by Elizabeth, who was the wife of John de Burgo, his second wife, had at the suit of the said Thomas and Joan after her proof of age, 7 September, 12 Edward II, assigned to the said Thomas and Joan the castle and manor of Alveton with its members of Bredeleye, Farlegh, Coton, Wotton, Denston, Staunton, Strongeshulle, Bukenhale, and Fenton and Barderdeleye, co. Stafford, which were extended at 29l. 11s. 4d. yearly, as the pourparty of the said Joan, and commanded the same to be delivered to them; and whereas William le Blount, who took to wife the said Margery, another daughter and heir of the said Theobald, and the said Margery, who has proved her age, have asserted that the said extent was erroneous and to the disherison of the said Elizabeth, Margery and Isabel, because in the said castle and manor with its members there are more than 60l. of yearly rent, and divers lands and tenements, of which no mention is made in the extent, and have prayed the king to resume into his hand the said castle and manor with its members and all other lands and tenements in England and Wales, late of the said Theobald de Verdon, which by reason of his death were taken into the hand of the late king, the lands and tenements held in dower by the said Elizabeth, late the wife of the said Theobald, only excepted, and to cause them to be extended according to their true value and to be divided into four equal parts according to such extent, and to cause her pourparty to be delivered to the said Margery:— the king, as well for himself and for the said Isabel, who is within age and in his wardship, as for the other heirs and parceners of the said inheritance, having commanded the sheriff of Stafford to warn the said Thomas de Furnivall and Joan to be present in his chancery from the day of the Nativity of St. John the Baptist next in three weeks, which day is also given to the said William and Margery, to show cause why the king should not cause the said castle, manor and hamlets, and other lands and tenements to be resumed into his hand and again extended and divided among the said heirs and parceners and to receive judgment therein; and having commanded the sheriff of Salop to issue the like writ to Bartholomew de Borugherssh, who took to wife the said Elizabeth, and the said Elizabeth to be present in the chancery on the same day; empowers John le Blount to receive the attorneys of the said Thomas and Joan. | |

Commanding him to warn Thomas de Fournivall, the younger, and Joan his wife to be present as abovesaid. The king has also commanded the sheriff of Salop to warn Bartholomew de Burghessh and Elizabeth his wife.
Endorsed by the sheriff, that he has warned the said Thomas and Joan accordingly. At which day the said Joan came by John de Tamworth her attorney, and a protection until Michaelmas next was offered on behalf of the said Thomas, under date 1 July, setting forth that he had set out for Scotland on the king’s service &c. with a clause that he should be quit until the feast of St. Michael next, which date is allotted to him for taking the lands &c. into the king’s hand, but because it has been determined that the lands and tenements, late of Theobald de Verdon, dower excepted, should be again extended, the said parceners were told to sue writs for re-extending the lands &c. |

After recital of the partition of the lands and tenements late of Theobald de Verdon into four parts, the assignment, 7 September, 12 Edward II, of the castle and manor of Alveton with its members, extended at 29l. 11s. 4d. yearly, as before set forth, the allegation by William le Blount and Margery his wife that the extent, according to which such partition had been made, was erroneous and their prayer that a new extent and partition might be made; and further recital of the issue to the sheriff of the king’s writ, commanding him to warn the said Thomas de Fournivall and Joan his wife, and also William le Blount and Margery his wife, to be present in the chancery in three weeks from the Nativity of St. John the Baptist to show cause why the castle, &c. should not be resumed into the king’s hand and a new partition made, of the appearance of the said William and Margery, and of the said Joan by their attorneys, and of the production of letters of protection for Thomas de Furnivall, dated 1 July last, until Michaelmas next following, he being about to set out for Scotland on the king’s service, and of the judgement of the court to postpone the taking the lands, &c. into the king’s hands until further order, and that in the meantime the said castle and manor with its members, and also all other lands of the said Theobald de Verdon in England and Wales, the lands assigned in dower to Elizabeth, late his wife, excepted, should be extended; and further recital that by the extent, so ordered to be made, the castle, manor and members were extended at 80l. 16s. 9d. yearly, and that thereupon the said William and Margery prayed the king that upon the expiration of the protection he would cause the lands and tenements, &c. to be resumed into his hand, and their proper pourparties to be delivered to the heirs and parceners:—the king, as well for himself and the said Isabel, a minor in his wardship, as for the other heirs and parceners, commands the sheriff to warn the said Thomas and Joan to be present in the chancery on the morrow of St. Lucy the Virgin, to show cause why the said castle, manor, and members, lands and tenements should not be resumed into the king’s hand and a new partition be made thereof. The sheriff is also to warn the said Bartholomew de Burghersh and Elizabeth his wife to be present on the same day.

Whereas lately, at the suit of William le Blount and Margery his wife, who had asserted that Thomas de Furnivall, the younger, and Joan his wife had received as the pourparty of the said Joan of the lands and tenements late of Theobald de Verdon, more than belonged to them, the king commanded the sheriff of Stafford to warn the said Thomas and Joan to be present in the chancery on the morrow of St. Lucy the Virgin, which day the king had given to the said William and Margery to show cause why the said lands, the lands assigned in dower to Elizabeth, late the wife of the said Theobald, alone excepted, should not be resumed into the king’s hand, on which day the parties came, and by adjournment until the octave of St. Hilary last past; and because the said Thomas and Joan said nothing to the contrary, the court declared the partition so erroneously made should be held of no effect, and that all the lands as abovesaid of the said Theobald should be resumed into the king’s hand, and parted between the heirs and parceners:— the king commands the escheator to resume all the said lands into his hand, and because inquisitions taken at another time and returned into the chancery have been challenged, to cause all the said lands, excepting the said dower, to be extended in the presence of the heirs and parceners, and to return that extent into the chancery on this side the quinzaine of Easter next. | |
