I.
Endorsed: That they could find nothing in the books or rolls of the exchequer to certify and therefore have caused inquisition to be made in the exchequer, the tenor whereof they send. And because it is found in this inquisition that the tenements in question are held of the king by the like services by which William de Kendale lately deceased held his lands in Derleye, they also send a transcript of the inquisition lately taken before them concerning the lands which were of the said William.
Transcript from the records before the barons of the exchequer contained in the roll of Memoranda of the year 30.
DERBY. The sheriff was commanded to cause 12 jurors to come and certify the barons concerning the contents of the writ in three weeks from the day of the Purification, when they came not, wherefore the sheriff was commanded to distrain them to come in fifteen days from Easter, when they came and said, that in the time of King Henry III, when the bailiwick of High Peak was in the hand of the present king, one Henry de Derleye died, who held that moiety of Derleye which was of Robert de Derleye now deceased, and had a son and heir Henry a minor, and the bailiff of the Peak took the said moiety with the body of the heir into the present king’s hand; and afterwards Robert de Derleye, who then dwelt with the said Sir Edward, sued to him so that he rendered to the said Robert the said land and heir, and had a bovate of land of the gift of the heir for his aid. The said Henry had a son and heir Henry called Le Clop, who was of full age when his father died in the reign of the present king, when the bailiff of the Peak seized the said land into the king’s hand; the said Henry Le Clop gave the bailiff 10 marks for his aid, who then restored the land to him. The same Henry had two sons, Robert and John, and died when they were under age; and the bailiff again seized into the king’s hand the said land and the body of Robert the heir, and afterwards delivered the same to Ranulph de Snyterton for 10 marks. Afterwards the said Robert son of Henry died, without heir of his body, and the said moiety descended to John his brother, and because he is under age the escheator seized the same into the king’s hand and holds it. It is held of the king by service of rendering 1 mark yearly at the castle of the Peak, the same service as that by which the other moiety is held which is in the king’s wardship by the minority of the heir of William de Kendale, except that that moiety renders 2s. yearly more than this; the wood, fishery and a mill in Derleye pertain as well to one heir as the other, undivided.
From the records contained in the roll of Memoranda of the year 27. At the quinzaine of St. Hilary, 27 [Edw. I] was taken an inquisition before the barons concerning the lands &c. which William de Kendale held in Derleye, whereby it was found, that in the time of King Henry III, the bailiwick of High Peak was for a time in the hand of William de Scropton then (fn. 1) earl of Ferr[ars] (sic), but how the jurors know not; at which time one William, son of Robert son of Nicholas de Derley, who held the said moiety of Derleye, died, Andrew his son and heir being under age; and the said earl seized the same into his hand, and conferred the wardship, with the marriage of the said Andrew, on Thomas de Endesore then his steward of the said bailiwick; which Thomas married the said Andrew to Amice his daughter who survives, and the said Andrew died, Hugh his son and heir being under age. Afterwards King Henry by his bailiff of the Peak seized the said land into his hand and conferred the wardship, with the marriage of the said Hugh, upon one William de Grey for his good service; who sold the same to one Richard de Launcecoumbe, parson of the church of Derleye, who married the said Hugh to Juliana daughter of Roger de Bucmynstre, of whom he begat a daughter Isabel, who was under age when he died; whereupon the steward of the Peak under Edward, now king, then by the assignment of his father holding the bailiwick of the Peak for his maintenance, seized the said land into the said Edward’s hand and sold the wardship with the marriage of the said Isabel to Richard de Launcecombe, who sold them to Thomas de Gratton, who married his son William to the same Isabel: she died without heir of her body, and the land descended to Thomas de Kendale her kinsman and heir, and he gave the same to William de Kendale his son, father of Alice now a minor and in wardship. Wherefore it is judged that the king ought to have the wardship of the moiety late of William de Kendale.
