Inquisitions Post Mortem, Edward III, File 128

180. ANASTASIA, DAUGHTER OF WILLIAM DE HARDENE.
Writ to Thomas de la Ryvere, escheator, to enquire as to the lands and heir of the said Anastasia, 1 October, 28 Edward III.
WILTS. Inq. taken at Erchesfonte, Saturday after St. Denis, 28 Edward III. Wyke. The manor, viz. a messuage and three carucates of land, held of the king in chief.
Schaldeborne. A messuage and a carucate of land held of the king in chief, in the hand of John Malewayn by reason of a bond for 200l. made to him by the said Anastasia; a messuage and three carucates of land held of Ralph, earl of Stafford, as of the inheritance of Margaret late his wife, one of the heirs of Gilbert de Clare, earl of Gloucester; whereof one carucate of land is in the hand of Sibyl, sometime the wife of John Lilebon, by way of dower.
Covenholte. 40s. rent held of the abbot of Hyde, whereof she pays to the said abbot 20s.
She died on 4 May, 27 Edward III. John, son of John Lilebon, aged 12 years, is her heir.
Writ of certiorari super causa capcionis to John Everard, escheator, touching four messuages, a carucate of land and 3a. meadow late of William Chaunpion, and 8a. meadow and 60s. rent late of Robert de Bilkemor and Anastasia his wife, in Wyke, Middelton, Fyfyde and Mulcote, taken into the king’s hand by Thomas de la Ryvere, late escheator. 10 November, 28 Edward III.
Endorsed by John Everard that he cannot certify the cause, as the aforesaid lands &c. were taken into the king’s hand by Thomas de la Ryvere, his predecessor, who delivered them not to him, except the manor of Wyke, which is in the king’s hand by reason of the minority of John, son of John Lillebon.
Writ of certiorari to John Everard touching the forestership of the west bailiwick in the forest of Savernak, held of the king in chief, of which there is no mention in the inquisition taken by Thomas de la Ryvere. 13 November, 28 Edward III.
Endorsed by the said John Everard that, by another inquisition which he has taken ex officio, he has found that the said Anastasia held of the king in chief by grand serjeanty a virgate of land called ‘Boneclyve’ by the covert (juxta coopertum) of the forest of Savernak, which is in the hand of lady Philippa, queen of England, and a virgate of land by (desuper) the covert of Iwode in the same forest; which virgates, by reason of the said inquisition, he has taken into the king’s hand.
WILTS. HUNDRED OF KYN’. Inq. taken at Marlebergh, Saturday after St. Scolastica, 29 Edward III.
She did not hold the forestership of the westbailiwick in the said forest, but Thomas de Bourne, sometime deputy of Bartholomew de Burgherssh, late keeper of the king’s forest on this side Trent, on Monday before the Nativity of the Blessed Mary, 16 Edward III, for causes unknown to the jurors, took into the king’s hand the said bailiwick, which was of the inheritance of the said Anastasia; and since then the said bailiwick has always remained in the king’s hand, and in the custody of Simon Symeon, keeper of the forest of Savernak. The said Anastasia and her ancestors, who held that bailiwick, used to render yearly to the king by the hands of the constable of the castle of Marlebergh 52s.
Heir as above.
Writ to John Everard, escheator, 12 February, 29 Edward III.
Writ of certiorari to the same John Everard, the king understanding that the said Anastasia held the office of forester of the westbailiwick in the forest of Savernak and divers other lands &c. of the king in chief not mentioned in the above inquisition. 20 February, 29 Edward III.
WILTS. Inq. taken at Marlebergh, Friday after the Annunciation, 29 Edward III.
She did not hold the forestership of the westbailiwick of Savernak because, long before her death, viz. on Monday before the Nativity of the Blessed Virgin Mary, 16 Edward III, the said bailiwick was taken into the king’s hand for certain causes unknown to the jurors by Thomas de Borne, deputy of Bartholomew de Bourghersh, then keeper of the king’s forest on this side Trent, and it is still in the king’s hand.
Iwode. A virgate of land under the covert of Iwode held, as of her right and inheritance, of Philippa, queen of England, by grand serjeanty, viz. being forester (ad custodiendum forestariam) of the said westbailiwick and by rendering yearly to the said queen 26s. by the hands of the keeper of the castle and barton of Marlebergh.
Shaldeborne. The manor of Westcourt, with the advowson of the chapel, held jointly with Robert Bilkemor, her husband, by fine levied in the king’s court, of the king in chief by knight’s service.
Est Wyke. The manor, with its appurtenances in Wotton, Mydelton, Fyfhyde, Mulcote, Peuesy and Clench, held jointly as above, of the lord of Wotton Ryvers and divers other lords, services not known.
Robert de Bylkemor had nothing in the above virgate of land under the covert of Iwode except as husband of Anastasia. Simon Symeon, keeper of the forest of Savernak, has been in possession of the said bailiwick since the time it was taken into the king’s hand, and all the other lands &c. Robert de Bilkemor occupied from the time of the said Anastasia’s death until they were taken into the king’s hand by Thomas de la Ryvere, late escheator. The said westbailiwick, before it was taken into the king’s hand, was held of Philippa, queen of England, as of the castle of Marlebergh and of the aforesaid forest.
Date of death as above. John, son and heir of John Lyllebon, son and heir of the said Anastasia, aged 12 years and more, is her heir.
Endorsed: Memorandum that the plea on this matter is sent before the king.
Pleas in the chancery at Westminster of the quinzaine of St. Martin, 28 Edward III.
It was found by an inquisition taken by Thomas de la Rivere, escheator in co. Wilts, that the said Anastasia held the manor of Wyke, viz. a messuage and three carucates of land and a messuage and a carucate of land in Shaldebourn of the king in chief, and 40s. rent in Covenholte of the abbot of Hide, and that John, son of John Lillebon, aged 12 years, is her next heir; so that the said manor, messuage, land and rent were taken into the king’s hand by reason of the said heir’s minority. Robert de Bilkemore, who married the said Anastasia, comes and says that a fine was levied whereby John de Ellerker, parson of the church of Tyd, and Alan de Somersham granted the premises to the said Robert and Anastasia for their lives, so that the said Robert held them jointly with the said Anastasia, and he seeks that they should be restored to him by virtue of the said fine. William de Skipwyth, for the king, says that long before the levying of that fine a fine was levied on the octave of St. Michael, 10 Edward II, between the said William de Harden and Maud his wife, plaintiffs, and Margaret, sometime queen of England, deforciant, touching a messuage, a mill, three carucates and a virgate of land and 100s. rent in Estwyk and Wotton, and the office of forester of the king’s forest of Severnak, whereby the said William and Maud acknowledged the premises to be the right of the said Margaret, who granted them to the said William and Maud and the heirs of their bodies (fine recited), with remainder to the right heirs of Maud. Anastasia, daughter and heir of the said William and Maud, was married to one William Lillebon, and they had issue John Lillebon, who begat a son and heir John, now a minor in the king’s wardship. After the death of William Lillebon the said Anastasia was married to the abovesaid Robert de Bilkemore in the lifetime of William de Harden and Maud, after whose death the said Robert and Anastasia entered in her right in the tail, and after her death the king caused the said tenements to be seized into his hand by reason of the minority of her heir, denying that the said John de Ellerker and Alan ever had anything in the said tenements. The said Robert, not acknowledging that the said John son of John, now a minor in the king’s wardship, is the heir of the said Anastasia in tail, says that except a messuage and a virgate of land only in the manor of Wyke, [the said manor] with the bailiwick of the forest of Sevemak and the messuage and carucate of land in Shaldebourn are held of the king in chief, and that the said John de Ellerker and Alan were seised of the said manor of Est Wyk, a messuage and carucate of land in Shaldebourn and the said 40s. rent in Covenholte at the time of the levying of the said fine between them and the said Robert and Anastasia; and this he is prepared to prove by the country. Likewise William de Skipwyth. Thereupon a day is given to the said Robert before the king on the quinzaine of St. Hilary. As to the bailiwick of the said forestership, not contained in the said fine between John de Ellerker and Alan and the said Robert and Anastasia; he seeks a writ for the king of diem clausit extremum touching the death of the said Anastasia, to inquire &c. because in the inquisition (in officio) taken after her death there is no mention of the said bailiwick; and it is granted him. The tenors of the feet of the fines between the said Robert and Anastasia and the said John de Ellerker and Alan, levied in this behalf, are sent before the king annexed to this record.
