ORDERED, That Mr. Speaker do issue out his Warrant to the Clerk of the Crown, to make out a Writ for electing a new Member to serve for the City of Bath, in the County of Somersett, in the room of Col. Popham, deceased.
Excise.
A Petition of several Distillers within the City of London, and Parts adjacent, was read.
Resolved, &c. That this Petition be referred to the same Committee to which the Petition of the Farmers of Excise on Brandy, and the Petition of the Merchants trading therein, with other Petitions, was committed; to take the Matter of this Petition also into Consideration; and report it, with their Opinions therein, to the House.
Lady Lee's Estate.
Ordered, That the Bill for settling Differences between the Lady Lee, and the Daughters and Coheirs of Sir Thomas Pope, be read the Second time To-morrow Morning, between Nine and Ten of the Clock.

Privilege- Petition from a Person in custody.
A Petition on the Behalf of Jonathan Ball, now in the Custody of the Serjeant at Arms, for his Misdemeanor in joining in the false Return for the Borough of Agmondesham, was read:
And the Matter being debated;
The said Ball being called in to the Bar, and being upon his Knees; Mr. Speaker told him, The House had received a Report, from the Committee of Privileges and Elections, of a great Fault and Miscarriage in him, in making a false Return for the Borough of Agmondisham, which had caused a great Trouble to the House; but, upon his Submission, they did discharge him, paying his Fees: But with this Direction, that he do attend the Committee of Elections on this Day Sevennight, when the Cause touching this Election, is to be heard.
Old Sarum Election.
Sir Job Charlton reports from the Committee of Election, the State of the Case in the Election for the Borough of Old Sarum, between Sir Eliab Harvey, and Sir Wm. Salkeild; that * * * *
Resolved, &c. That the House doth agree with the Committee, that Sir Eliab Harvey was duly elected for the Borough of Old Sarum, and ought to sit.
Tolls on the Medway.
A Petition of James Bradley, Isaac Clarke, Richard Tippendon, and others, was read; being subscribed by the said Bradley and Tippendon only; complaining of a Grievance, and Exacting of a Toll for Hoys and other Vessels coming and going from the River Medway in Kent, by Gravesend Fort:
And the said Bradley being called in; and owning the Petition;
Resolved, &c. That the Petition be referred to the Committee of Grievances: And that the Committee do sit on Wednesday next; and every Wednesday after: And that no other Committee sit that Day, or upon any Day when that Committee sits: And that both Parties, the Petitioners and the Governor of Gravesend Fort, do then attend to be heard: And the Committee are to examine the Matter; and report it, with their Opinions therein, to the House.
Pearle's Estate.
Ordered, That the Petition of Richard Pearle be read To-morrow Morning.
Publick Accounts.
The House then resumed the Consideration of the Report of the Commissioners of Accounts:
And the Commissioners being called in; and asked, whether they had any further Matter to offer or report to the House; the Lord Brereton declared, that they had received from Sir Geo. Carteret the Copies of Two several Warrants; one from his Majesty to the Lord Treasurer, and the Lord Ashley, Chancellor of the Exchequer, dated the 20 of November 1665: and another from them to Sir Robert Long, and other Officers of the Exchequer, dated the 21 of the same November: Which he delivered in at the Clerk's Table, together with the Commissioners further Report and Observations thereupon.
The Commissioners being withdrawn; and Sir Geo. Carteret afterwards, in his Place, answering to the whole Matter, did also withdraw.
Upon the Debate of all which;
The Question being put, That Sir George Carteret is guilty of a Misdemeanour within the First Observation of the Commissioners for Accounts;
The House was divided.
