Saturday, 25th February, 1659.

Genl Monck, Commander in Chief.

A BILL, ingrossed, for constituting George Monck Esquire Captain-General, and Commander in Chief, under the Parliament, of all the Land-Forces, in England, Scotland, and Ireland, was this Day read the Third time.

Resolved, That this be the Title of this Act; viz. An Act constituting George Monck Esquire, Captain-General, and Commander in Chief, under the Parliament, of all the Land Forces in England, Scotland, and Ireland.

A Clause, ingrossed in Parchment, was tendered to this Bill, in these Words; viz. "Whether it be by Pretence or Colour of Authority from Charles Stuart, Son of the late King, or from any other Single Person or Persons, whatsoever; or otherwise;"

And the Question being put, That this Clause be read;

It passed with the Negative.

And the said Act, being put to the Question, passed.

Ordered, That Sir Wm. Wheeler, Sir John Temple, and Mr. Ralegh, do carry this Commission to his Excellency General George Monck.

Mr. Weaver reports A Bill for settling the Honour and Manor of Hampton-court, and other Lands, upon General George Monk, and his Heirs: Which was this Day read the First time.

Ordered, That this Bill be read the Second time on Monday Morning, the first Business.

Council of State.

A Bill, ingrossed, constituting a Council of State, and Instructions, given to the said Council; was this Day read the Third time.

Resolved, That these Words, "and are hereby constituted a Council of State," be added, next after the Words "shall be:" And that these Words; viz. "before they act;" be added, next after the Word "ensuing."

Resolved, That this be the Title of this Act; viz. An Act for constituting a Council of State.

A Clause was tendered to the said Act, in these Words; viz. "And it is lastly Enacted and Declared, That the Act, with the Instructions for the Council of State, passed the Second Day of January One thousand Six hundred Fiftynine; with all the Powers, Clauses, Articles, and Instructions therein contained; be, and hereby are repealed; made null and void:" Which was read the First and Second time, in Paper; and after, ingrossed in Parchment, and read the Third time; and, upon the Question, agreed unto, and ordered to be Part of the Bill.

And the said Act, being put to the Question, passed.

Customs and Excise.

A Bill, ingrossed, for Continuance of the Customs, and Excise, was this Day read the Third time.

Resolved, That Wm. Love, Alderman and Sheriff of London, upon his own Desire and Request, be, and is hereby, discharged from being one of the Commissioners for the Customs: And that Edward Wingate Esquire be, and is hereby, consituted one of the Commissioners for the Customs, in the place of the said Wm. Love.

Resolved, That Colonel John White be discharged from being a Commissioner for the Customs; and that Mr. John Swinfyn be, and is hereby, constituted a Commissioner for the Customs, in the place of the said John White.

Resolved, That Mr. Harrington be, and is hereby, discharged from being one of the Commissioners for the Customs: And that Mr. Samuell Vassall be, and is hereby, constituted one of the Commissioners for the Customs, in the place of the said Mr. Harrington.

And the said Bill, so amended, being put to the Question, passed,

Ordered, That this Act be forthwith printed and published.

Circuits.

Resolved, That all the Circuits for the Lent Assizes for the several Counties of this Commonwealth be, and are hereby, put off.

Ordered, That Commissions of Oyer and Terminer, and Gaol-Delivery, do issue, under the Great Seal, to the Justices of the Peace of the respective Counties of this Commonwealth: And that the Lords Commissioners for the Great Seal do issue forth Commissions, accordingly.

Invalid Soldiers, &c.

The humble Petition of the poor maimed Soldiers, Widows, and Orphans, at Ely-house and the Savoy was read.

Ordered, That this Petition be referred to Mr. Trenchard and Sir Wm. Wheeler, to examine the Business; and to consider, How the Case stands with the Petitioners; and how the Two thousand Pounds formerly granted unto them, and their Pensions for the future, may be paid and satisfied; and report their Opinion therein on Monday Morning.

Serjeant at Arms, &c.

Ordered, That it be referred to the Council of State, to give Order, That the Arrears of the Fees and Salaries due to Edward Birkhead Esquire, Serjeant at Arms attending the Parliament, and the Doorkeepers, and his Fourteen Servants, attending the Parliament, and the several Committees thereof, and the Marshals attending the Speaker, and his Servants, be forthwith paid and satisfied: And that their respective Salaries and Wages, from time to time, for the time to come, be duly paid and satisfied: And their respective Acquittances, testifying the Receipt thereof, shall be a sufficient Discharge in that behalf.

Circuits.

Ordered, That Mr. Serjeant Maynard and Mr. Solicitor-General do prepare a Proclamation, declaring the Grounds and Reasons for the putting off the Circuits for this Time.

Militia.

Ordered, That Mr. Grove, Mr. Bulkley, Colonel Thisslewaite, Lord Wainman, Sir Thomas Dacres, be added to the Committee for the Militia.

Whitehall Streets.

Ordered, That it be referred to the Council of State, to give Order, That the Streets before Whitehall be repaired: And that they see, that the Surveyor be paid and satisfied the Disbursements for the Repair thereof.

Prisoners discharged.

Ordered, That Peter Brooke, Colonel Holland, Henry Brooke, and Colonel Charles White, be discharged of their Imprisonment: And that the Sequestration of their Estates be suspended: And that the Commissioners for Sequestrations be, and are hereby, required to forbear any further Proceedings touching the Sequestration of the Estates of them, or any of them.

Persons pardoned.

A Pardon for James Piper, Samuell Eden, Richard Jackman, Winifride Jones Wife of Edward Jones, William Love, Henry Warner, Jane Odford, Wm. Ackland, Wm. Hele, John Christopher, Agnes Hake Widow, John Norris, Samuell Warring otherwise Pulling, Joane Skynner Wife of Wm. Skynner, John Broadrip, Henry Sansome otherwise Chippett, Gregory Sansome otherwise Chippet, John Hunt, Richard Greene, Nicholas Watts, and John Watts; and the Judges Certificates of the Crimes of which they were convicted; were read; and the said Pardon, upon the Question, agreed unto. And It is

Ordered, That the Lords Commissioners for Custody of the Great Seal do pass the said Pardon for them, and every of them, under the Great Seal of England.

Resolved, That the Sheriffs and Justices of Peace of the respective Counties, wherein the said Wm. Jones, Wm. Love, John Christophers, John Broadrip, Heny Sansome, otherwise Chippett, Gregory Sansome otherwise Chippet, John Hunt, Richard Greene, Nicholas Watts, and John Watts, do inhabit, do take care, that they, and every of them, be transported into Foreign Parts or Plantations, according to the Judges Certificate.

Ordered, That Justice Newdigate do give Order for the Execution of Edward Weekes, convicted for Robbery, according to Law.

Circuits.

Mr. Serjeant Maynard reports A Proclamation, shewing the Grounds and Reasons for putting off the Circuits.

Militia.

Ordered, That the Bill for the Militia be reported on Monday Morning, the first Business.

Members Qualifications.

Ordered, That the Committee touching Qualifications, be revived; and sit this Afternoon: And that they consider of Qualifications, as well of the Persons that are to give Voices in Elections, as of the Persons to be elected.

Clerk of the House.

Ordered, That it be referred to the Council of State, and the Council of State are hereby authorized and required to give Order for the present Payment and Satisfaction of the Sum of Three hundred Seventy-and-five Pounds, Three Quarters of a Year's Arrears of the Salary of Five hundred Pounds a Year, due to Thomas St. Nicholas Esquire, as Clerk of the Parliament, on the 18th Day of February 1659; and also to pay and satisfy the said yearly Salary unto the said Thomas St. Nicholas, as Clerk of the Parliament, by quarterly Payments, as the same shall from time to time, become due and payable: And the Acquittance of the said Thomas St. Nicholas, testifying the Receipt thereof, shall be a sufficient Discharge in that behalf.

Clerk Assistant.

Ordered, That it be referred to the Council of State, and the Council of State are hereby authorized and required to give Order for the present Payment of the Sum of Three hundred Pounds of lawful Money of England, for one Year and a Half's Arrears of the Salary of Two hundred Pounds a Year due to Ralph Darnall Esquire, as Clerk-Assistant to the Parliament, on the 25th Day of December 1659, unto the said Ralph Darnall, or his Assigns; and also to pay and satisfy the said yearly Salary unto the said Ralph Darnall, or his Assigns, as ClerkAssistant to the Parliament, by quarterly Payments, as the same shall, from time to time, become due and payable: And the Acquittance and Acquittances of the said Ralph Darnall, testifying the Receipt thereof, shall be a sufficient Discharge in that behalf.

Revenue Commissioners.

Ordered, That one Peny in the Pound, out of the Receipts of the Duties of Customs and Subsidies, and the like Sum of one Peny in the Pound out of the Receipt of the Excise and New Impost, be paid unto Colonel William White, Luke Robinson, Adam Baynes, Doctor Wm. Parker, and John Jackson Esquire, Commissioners for bringing in the Arrears of the Revenue due to the Commonwealth, for their Salary and Pains from the Twenty-sixth of May last past: And that the Commissioners for the Excise and Customs, respectively, do forthwith pay the same, and the Arrears thereof, unto the aforesaid Commissioners; whose respective Receipts shall be unto the said Commissioners of Excise and Customs, and every of them, respectively, a sufficient Discharge for the same.
