Monday, the 13th of February, 1659.

Prayers.

Sir H. Vane.

RESOLVED, That the Serjeant at Arms attending the Parliament be, and is hereby, commanded and required forthwith to put in Execution the former Order of this House for carrying Sir Henry Vane to his House, called Belew, in the County of Lyncolne.

Col. Lambert.

A Proclamation requiring Colonel John Lambert to render himself to the Council of State, to give an Account of his Contempt of the Order of Parliament; or, in default thereof, That his Estate, real and personal, be sequestered; was read the Second time.

Resolved, That the Words "at his" in the Fourth Line, before the Word "Request," be omitted; and that the Word "upon" be inserted, instead thereof.

Resolved, That the Words "and instance," after the Word "Request," in the same Line, be omitted; and that the Words "made on his behalf" be inserted, instead thereof.

Resolved, That the Words "doth, or did lately," be added in the Seventh Line, next after the Word "but," and before the Word "lie;" and that the Word "violently," in the Eighth Line, be omitted; and the Word "vehemently" inserted, instead thereof.

Resolved, That the Words "Mutiny and" be inserted next after the Word "late," in the Ninth Line.

Resolved, That these Words; viz. "the said John Lambert do render himself, by Thursday next, to the Council of State, to give an Account of his Contempt of the Order of Parliament; and, in default thereof;" be added, next after the Word " that," in the Eleventh Line, instead of the Clause touching his giving Security.

And the said Proclamation, so amended, was, upon the Question, agreed unto.

Ordered, That this Proclamation be forthwith printed and published; and proclaimed, this Day, by the Serjeant at Arms attending the Parliament, or James Norffolk Esquire, Serjeant at Arms, in Westminster-hall, the New Palace-Yard, and at the Old Exchange, in London.

Pretended Committee of Safety.

Ordered, That on this Day Sevennight, the Members of this House, who have acted at the pretended Committee of Safety, do appear in Parliament: And that the Serjeant at Arms attending the Parliament do forthwith give them Summons to attend, accordingly: And that the Business concerning the said Members be then taken into Consideration, the first Business; nothing to intervene.

Ordered, That it be referred to a Committee, to send for Henry Scobell Esquire, and Mr. Robinson, late Clerk to the pretended Committee of Safety; and to examine, What Books or Papers of the said Committee, or touching Businesses before them, they, or either of them, have or know of; and where, and in whose Hands, the same are: and to send for all such Books and Papers; and also for all Papers, touching the Draught of a Government, presented to, or before, the said Committee; and to consider What things, in the said Books or Papers, are fit for the Consideration of the Parliament; and present their Opinion therein to the Parliament; Viz. unto Colonel Hutchinson, Mr. Robinson, Sir Peter Wentworth, Mr. Ralegh, Mr. Oldsworth, Colonel Dove, Sir Anth. Ashley Cooper, Mr. West, Mr. Robert Goodwin, Lord Commissioner Lisle, Mr. Love, Mr. Garland, Colonel Harvey, Mr. Dormer; or any Three of them: And are to meet this Afternoon, at Three of the Clock, in the Speaker's Chamber.

Army Pay.

Ordered, That the former Order, for Payment of One Month's Pay to the Officers and Soldiers of the Army, now in Town, by the Committee of the Army, be, and is hereby, renewed: And that the said Committee be, and are hereby, impowered to charge any Treasury of this Commonwealth towards the Payment thereof, except Customs and Excise.

Ordered, That the Commissioners of the Admiralty and Navy be, and are hereby, impowered, by their Warrant, to issue forth all such Monies out of the respective Treasuries of this Commonwealth, which are or shall be appropriated to the Use of the Navy, by Order or Act of Parliament.

Members Qualifications.

The House this Day proceeded in the Qualifications.

And this Clause; viz. "or that, after the First of January 1659, shall advise, promote, or abet, any Single Person to the Supreme Magistracy of England, Scotland, or Ireland, or any or either of them, shall be uncapable to be elected to serve in this Parliament;" . . . . .

Resolved, That, instead of the Words "advise, promote, or abet," these Words; viz. "have advised, promoted, or abetted;" shall be inserted.

And the said Clause, so amended, was, upon the Question, agreed unto.

The next Clause; viz. "That the Persons that shall be elected to serve in Parliament, be such as are Persons fearing God, and of good Conversation, and above the Age of One and-Twenty Years;" was read; and, upon the Question, agreed unto.

The next Clause; viz. "and not such as are disabled by any Act of this present Parliament, of the Seventeenth Year of the late King, intituled, "An Act disenabling all Persons in Holy Orders to exercise any temporal Jurisdiction or Authority; nor such as are publick Ministers or Preachers of the Gospel;" was read; and, upon the Question, agreed unto.

The next Clause; viz. "nor such as are guilty of any of the Offences mentioned in an Act of Parliament, bearing Date the Ninth of August 1650, intituled, An Act against several atheistical, blasphemous, and execrable Opinions, derogatory to the Honour of God, and destructive to human Society;" was read; and, upon the Question, agreed unto.

The next Clause; viz. "no Person that hath married, or shall marry, a Wife of the Popish Religion; or hath trained, or shall train up his Child or Children under his Tuition or Government, in the Popish Religion; or shall permit or suffer such Child or Children to be trained up in the said Religion; or that hath given, or shall give, his Consent, that his Son or Daughter shall marry any of that Religion;" was read; and, upon the Question, agreed unto.

The next Clause; viz. "no Person that shall deny the Scripture to be the Word of God, or the Sacraments, Prayer, Magistracy, and Ministry, to be the Ordinances of God; no common Profaner of the Lord's Day; no profane Swearer, or Curser; no Drunkard, or common Haunter of Taverns or Alehouses; shall be capable of being elected;" was read.

Resolved, That the Word "common" be inserted before the Word "profane," and also before the Word "Drunkard."

The Question being put, That these Words, "or common Haunter of Taverns or Alehouses," do stand;

It passed with the Negative.

And the said Clause, so amended, was, upon the Question, agreed unto.

Ordered, That the Debate upon the Qualifications be adjourned until To-morrow Morning, the first Business; nothing to intervene.

Army.

Resolved, That a Month's Pay be forthwith provided and paid to Colonel Charles Fairfax, and the Companies in the Garison of Hull: And that the Committee for the Army do take care to provide and pay the same, accordingly.

Resolved, That Major Sylent Callent be, and is hereby approved to be, Major in Colonel Reade's Regiment.

Ordered, That a Month's Pay be forthwith paid unto all the Garisons and Forces in England: And that it be referred to the Committee for the Army, forthwith to provide and pay the same, accordingly.

Resolved, That Colonel Anthony Rowse be, and is hereby approved of to be, Governor of Pendennis Castle, and Captain of a Company of Foot there: And that a Month's Pay be paid to the Garison and Forces there: And that the Committee of the Army do provide and pay the same, accordingly.

Army Appointments.

A List of Names of Officers in Colonel Bethell's Regiment were read; and is as followeth; viz.

Ordered, That Gustavus Boynton be re-committed.

The Question being put, That Thomas Lilburne be Major and Captain in this Regiment.

And the Question being put, That that Question be now put;

The House was divided.

The Noes went forth.

And Mr. Speaker declared himself a Noe.

So it passed with the Negative.

Resolved, That Captain Pockley be re-committed.

Resolved, That Captain Waterhouse be re-committed.

And all the rest of the Officers, being put to the Question, were approved.

Army Commissions.

MR. Speaker, according to former Order of Parliament, did deliver the Commissions following, before the sitting of the House; viz.

To George Fines, his Commission to be Major and Captain in Colonel Lillingston's Regiment, in Dunkirk:

To Lieutenant Thomas Mitchell, his Commission to be Lieutenant of Captain Cooke's Company in that Regiment:

To John Crosley, his Commission to be Ensign of Colonel Lenthall's Company in his Regiment.
