Friday, January 27th, 1659.

Privilege Case of Nevill and Stroode.

ORDERED, That the Cause between Mr. Nevill, a Member of Parliament, and Wm. Stroode Esquire, late Sheriff of the County of Berkes, touching a false Return heretofore depending in the Court of Common Pleas; and a Transcript of the Record delivered in to Parliament for their Resolution therein; be remanded into that Court: And that the said Court do transmit the said Cause into the Exchequer-Chamber, forthwith to be heard and determined there, by the Judges and Barons of the Exchequer: And that such Determination shall be final.

Army Committee.

Colonel White reports Amendments to the Bill for settling a Committee for the Army, and Treasurers at War; and the Names of Persons to be a Committee for the Army: Which Amendments were twice read.

Resolved, That Thomas Pury the elder be one of the Committee for the Army.

Resolved, That Colonel John Downes be one of the Committee for the Army.

Resolved, That Colonel Thomas Lister be one of the Committee for the Army.

Resolved, That Edmond West Esquire be one of the Committee for the Army.

Resolved, That Richard Lucy Esquire be one of the Committee for the Army.

Resolved, That Anthony Samuell Esquire be one of the Committee for the Army.

The Question being put, That a further Addition be made of Persons to be of the Committee for the Army;

It passed with the Negative.

Resolved, That James Nelthorpe Esquire be one of the Treasurers at War;

The Question being propounded, That the House doth agree with the Committee, That John Allen be one of the Treasurers at War;

And the Question being put, That this Question be now put;

It passed with the Negative.

Resolved, That Mr. John Lawson be one of the Treasurers at War.

Resolved, That the Quorum of the Committee for the Army be Three.

And the said Amendments, being put to the Question, were agreed unto.

Resolved, That the said Treasurers at War do continue Treasurers at War, until the Tenth Day of October 1660.

Resolved, That the Committee for the Army do continue until the Tenth Day of October 1660.

Resolved, That the Blank, in the * Folio of this Bill, be filled up with these Words; viz. "by Warrant from the Parliament, Council of State, or Commissioners for the Army."

Another Amendment was offered to this Bill, in these Words; viz. "And be it Enacted, and it is hereby further Enacted, That John Blackwell, and Richard Deane Esquire, late Treasurers at War, shall forthwith pay unto the present Treasurers at War by this Act constituted, all and every Sum and Sums . . Money remaining in their Hands, as Treasurers at War; and do henceforth forbear, and are hereby discharged, to receive or dispose of any Monies any way assigned for the Armies and Forces of this Commonwealth:" Which was twice read; and, upon the Question, agreed unto.

Resolved, That this Bill, so amended, be ingrossed.

The House adjourned till Two a Clock.

Admiralty.

ORDERED, That the Amendments to the Act for settling the Admiralty and Navy be reported To-morrow Morning, the first Business.

Admiralty Judges.

Ordered, That the Salary of the Judges for the Admiralty, and Probate of Wills, be taken into Consideration To-morrow Morning, next after the Amendments to the Act for the Admiralty and Navy reported.

Fortifying Invernes.

Ordered, That it be referred to the Committee for Inspections, to examine, How the Threescore and ten thousand Pounds, ordered for the Fortifying of Invernes, was disbursed; and to call Colonel Fitch, and Captain Spooner, and such other Person or Persons as are concerned therein, to an Account for the same: With Power to send for Persons, Papers and Witnesses; and to state Matter of Fact; and report it to the Parliament.

Army Appointments.

A List of the Names of Officers in Colonel Smithson his Regiment were read.

Ordered, That this List be re-committed to further Consideration.

Resolved, That the Parliament doth approve of Arnold Cella Nova to be Surgeon to the Regiment of Colonel Sir Anthony Ashley Cooper.

Resolved, That this House doth approve of John Bunnell to be Quarter-master to Captain Yarleye's Troop, in Sir Anthony Ashley Cooper his Regiment.

A List of the Officers in Colonel George Fleetwood's Regiment was read the First time.

A List of Colonel Mosse's Regiment was read the First time.

A List of Officers of a Regiment, late under the Command of Colonel Fitch, was read the First time.

Ordered, That this List be recommitted to the Commissioners for the Army; with the Petition of several Officers of the Regiment, late belonging to the Tower London; to take the same into their Consideration.

Army Appointments.

A List of Officers for the Isle of Man was read; and is as followeth; viz.

The Commissioners for Management of the Army report Mr. Gilbert Mabbot to be constituted Advocate of the Army in Ireland.

Army Commissions.

The House being informed, That divers Officers of the Army were at the Door;

They were called in: And, being come up to the Clerk's Table, in usual manner, Mr. Speaker acquainted them with the great Trust reposed in them by the Parliament and the Commonwealth; and that the Parliament and Commonwealth expected Faithfulness from them, accordingly: And thereupon Mr. Speaker delivered,

To Colonel Francis Hacker, his Commission to be Colonel of a Regiment of Horse, and Captain of a Troop in the same:

To Captain-Lieutenant John Finnis, his Commission to be Captain-Lieutenant of this Regiment:

To Cornet Benjamin Ludlam, his Commission to be Cornet of the said Troop:

To Major Wm. Hobart, his Commission to be Major of the said Regiment, and Captain of a Troop in the same:
