Monday, January 9th, 1659.

Prayers.

Letter read.

A LETTER from General Monck, from Woller, of the Third Day of January 1659, was read.

Ordered, That the said Letter be referred to the Council of State: And that the Council of State do also take into Consideration some Recompence to the Messenger for his Pains, and for what is due to him.

Door shut.

Resolved, That the Door be shut.

Sir H. Vane.

Resolved, That Sir Henry Vane be sent for to attend the Parliament forthwith.

Admiralty Papers.

Ordered, That the Clerk of the Admiralty, and every other Person or Persons whom it doth or may concern, be and are hereby required and enjoined forthwith to send to the Parliament the Book of Orders, and the Book of Letters, of the Admiralty.

Delinquents Estates.

Ordered, That it be referred to a Committee, to bring in an Act for Sale of the Estates of the Delinquents and Traitors, in the late Rebellion of Sir George Booth: Viz. to Colonel Martin, Sir Arthur Hesilrig, Mr. Say, Mr. Dormer, Lord Commissioner Lisle, Baron Nicholas, Mr. Cawley, Mr. West, Mr. Corbet, Mr. Garland, Sir Anthony Ashley Cooper, Mr. Boone, Mr. Dove, Mr. Challoner; or any Three of them: And are to meet this Afternoon, at Three of the Clock, in the Speaker's Chamber: And that Mr. Say do take care hereof: And that this Committee have Power to send for the Commissioners for Sequestrations; and to take an Account of them, What Monies have been received upon the Sequestrations of the said Delinquents and Traitors Estates; and to examine, How the same hath been disposed of; by whom; to whom; and by what Authority: And to send for a List of the Names of all such Persons sequestered.

Ordered, That it be referred to the Council of State, to examine, What Persons, in the late Rebellion of Sir George Booth, have been released since the late Interruption of the Parliament; and by whom; and to remand them to Prison to such publick Prisons as they shall think fit.

Admiralty.

A Bill for constituting Commissioners for ordering and managing the Affairs of the Admiralty and Navy was this Day read the First time.

Ordered, That this Bill be read the Second time To-morrow Morning.

Navy Appointments.

Resolved, &c. That the Parliament doth approve of the Placing of Captain Henry Fenne Commander of the Bristoll Frigate; and of Captain Henry Tearne to be Commander of the Hampshire Frigate; and of Captain James Ableson to be Commander of the Grantham Frigate; and of Captain George Dakins to be Commander of the Worcester Frigate.

The House being informed, That Vice-Admiral Lawson was at the Door;

He was called in: And, being come as far as the Bar of the House, and standing there, Mr. Speaker did acquaint him, That the Parliament took Notice of the great and eminent Services done by him since the late Interruption of the Parliament; and of his constant Fidelity to the Parliament: And did acquaint him, That the House had commanded him to take Notice of it; and to give him the hearty Thanks of this House: And, in their Names, Mr. Speaker did accordingly give him the hearty Thanks of the Parliament; and acquainted him, That the Parliament had approved of the Officers by him placed in the several Frigates aforesaid.

Great Seal.

Ordered, That it be referred to a Committee, to present the Names of Commissioners for the Great Seal; and also of Judges to fill the several Branches in the Courts at Westminster-Hall, to this House, on Wednesday next: With Power also, to present unto this House the Name of a Person fit to be Attorney-General: Viz. unto Sir Arthur Hesilrig, Mr. Corbet, Colonel White, Sir Henry Mildmay, Lord Commissioner Lisle, Colonel Hutchinson, Mr. Dormer, Mr. Ralegh, Sir John Trevor, Mr. West, Colonel Martin, Mr. Serjeant Hill, Colonel Fagg, Mr. Nevill, Sir Tho. Wroth, Mr. Fleetwood, Mr. Jo. Lenthall, Captain Skynner, Colonel Dove, Mr. Robinson, Alderman Pennington, Sir Peter Wentworth, Sir Anthony Ashley Cooper, Mr. Scott, Mr. Weaver, Mr. Robert Goodwin, Colonel Walton, Sir Wm. Brereton, Mr. Millington, Mr. Boone, Mr. Solicitor. Reynolds; or any Five of them: And are to meet in the Speaker's Chamber, To-morrow in the Afternoon, at Two of the Clock.

Sheriffs.

Ordered, That the several Members of this House do present the Names of Three Persons for every County to be Sheriffs of the respective Counties, on Thursday Morning next.

Sir H. Vane.

Sir Henry Vane, having been sent for according to the Resolution aforesaid, came to the House: And, being set in his Place, several Members of the House objected several Matters against him, acted since the late Interruption of the Parliament.

And several Letters sent from the Commissioners of the Admiralty; the one of the 15th of October 1659, written to Vice-Admiral Lawson, in the Downes; and several Orders of the Commissioners of the Admiralty; one, of the 29th of October 1659; and another of the 31th of October 1659; and another of the 2d of November 1659; were read.

Sir Henry Vane, standing up in his Place, made Answer to the said several Charges; and, after, sat down again in his Place: And, upon the Debate of the House, It is

Resolved, That Sir Henry Vane be discharged of being a Member of this Parliament; and he is hereby enjoined forthwith to repair to his House at Raby in the County of Durham; and there to remain, during the Pleasure of the Parliament.

Colonel Lambert, &c.

Resolved, That Colonel John Lambert, Colonel Disbrowe, Colonel Ashfeild, Colonel Berry, Colonel Kelsey, Colonel Cobbet, Colonel Barrow, Colonel Packer, and Major Creed, and every of them be, and are hereby required and enjoined forthwith to repair to their respective Houses in the Country farthest distant from the City of London; and that they there continue, during the Pleasure of the Parliament.

Ordered, That the Council of State do see this Vote put in Execution accordingly.

Officers opposing Parliament.

Ordered, That it be referred to the Council of State, touching the sending such other Officers of the Army as have been against the Parliament, since the late Interruption, out of the City of London, to their respective Houses in the Country.
