Thursday, 29th September, 1659.

Chief Justice of North Wales.

ORDERED, That the Patent granted to Mr. Ratcliffe, to be Chief Justice of the Three Counties of North-Wales, viz. Merioneth, Carnarcon, and Anglesey, be and is hereby discharged: And that a Patent be granted unto Mr. Shepheard of the said Office of ChiefJustice there, according to the Statute: And that Mr. Speaker do sign a Docket for passing a Patent of the said Office to him: And that the Commissioners for Custody of the Great Seal do pass the said Patent under the Great Seal, accordingly.

Militia Pay.

Sir Arthur Hesilrig reports from the Council of State, Colonel Crompton's Letter, from Stoneby-Lodge, the 14th of September 1659; with the Order of the Council of State touching Paying of the Militia-Forces in several Counties; viz.

That whereas, by Letters from the Commissioners of the Militia of several Counties, it hath been intimated to the Council, That, by reason of several intervening Obstructions, Assessments have not been made in their Counties for the Raising of Horse and Foot, according to the late Act for settling the Militia in England and Wales; so that there can no Money be raised thence, according to the Orders of Parliament, for Payment of such Troops and Companies as were employed within the said Counties, for the Parliament's Service, and preserving the Peace of the Nation, in the Time of the late Rebellion; that the Parliament be humbly moved, to impower the Commissioners of the Militia in such Counties, where no such Assessment hath been made, to assess so much, according to the Rates appointed in the said Act; viz. Upon such Persons as ought to find Horse and Arms, Ten Pounds; and, upon such Persons as ought to find a Foot-Arms, not above Twenty-five Shillings; as will be sufficient to pay off the said Forces employed in such Counties during the Time they were in actual Service there; and reimburse such Monies, as were borrowed and paid for their Subsistence: Which were read.

He also reports, A Letter from the Commissioners for the Militia, from Stafford, of the Two-and-twentieth of September 1659.

And also, Another Letter from Mr. Edward Oxenburgh, from Bury, 23d September 1659:

Which Letters were both read.

Resolved, That all the Militia and Auxiliary Forces, that have been raised or employed, by Authority of Parliament, since the Seventh of May 1659, shall be paid off by the respective Counties in which the same were raised, for such Time as they have been since in actual Service.

The House adjourned until Three of the Clock.

Militia Pay.

THE House resumed the Debate upon the Report this Day made, touching the Payment off of the MilitiaForces.

Ordered, That Mr. Nevill, Mr. Scot, Colonel White, and Major Salwey, do withdraw, and pen an Order upon the Debate of the House.

Letter read.

A Letter from General Monck, from Dalkeith, dated September Second 1659, was read.

Army Appointments.

A List of Commission-Officers for a Regiment of Foot, formerly reported; viz. of Colonel Thomas Talbot his Regiment; was again read.

Resolved, That John Hubblethorne be Major of this Regiment.

Resolved, That Henry Pownall be re-committed.

And the said Colonel Talbot, and the rest of the Officers in the said List named, were, upon the Question approved.

Another List of the Names of Commission-Officers, formerly reported, wherein Colonel Mathew Allured is named Colonel, was again read.

Capt. Gough.

A Paper, intituled, "Articles against Captain Wm. Gough," subscribed John Barker, was read.-

Army Appointments.

Ordered, That it be referred back to the Commissioners for Commission-Officers to conser with Colonel Allured, about the Persons named in the said List; and report it forthwith to the House.

Candles.

Resolved, That Candles be brought in.

Plundered Ministers.

Ordered, That the Committee for plundered Ministers do sit To-morrow in the Afternoon.

Militia and Army.

Mr. Nevill reports from the Committee appointed to withdraw, That the Commissioners for the Militia in the respective Counties and Places of this Commonwealth, wherein any Militia or Auxiliary Forces, raised or employed by Authority of Parliament since the Seventh of May 1659, do yet remain unpaid, and for which no Assessment, by virtue of an Act of Parliament, intituled, An Act for settling the Militia in England and Wales hath been made, or where the Assessments made by the said Act do not suffice for the paying off the said Forces, do proceed to assess such Persons, not heretofore assessed or charged by virtue of the said Act, as were liable to find Horse and Arms, or Foot-Arms; and to cause them respectively, under the Penalties in the said Act contained, to pay, in lieu thereof, after the Rate of Ten Pounds for each Horse and Arms, and any Sum, not exceeding Twenty-five Shillings, for a Foot-Arms; and, with the said Monies forthwith to pay off the Forces of such Counties and Places respectively as have been raised or employed, as abovesaid, during the Time they have continued in Service; as also to reimburse such Monies as were borrowed and paid for their Subsistence in the Time of their Service as aforesaid: Which was read.

Ordered, That these Words, "or Auxiliary," be added next after the Word "Militia:" And the said Order, so amended, was, upon the Question, agreed unto.

Ordered, That the Council of State do see this Order put in Execution.

Ordered, That this Order be printed, and published.
