Saturday, the 14th of February, 1656.

Brimslade, &c. Parishes.

A BILL for the Erecting of a Church, settling a Ministry, and establishing a Parish, in the Parks of Brimslade and Savernack, and Forest or Chace of Savernack, and Parts adjacent, belonging to and Part of the said Forest, was this Day read the First time; and, upon the Question, ordered to be read the Second time on this Day Sevennight.

Proceedings against Stranger, &c.

The humble Petition of John Stranger, and Hanna his Wife, Martha Symonds, and Dorcas Erbury, was this Day read.

Ordered, That it be referred to the Lord Chief-Justice of the Upper-Bench, to examine the Business touching the Petitioners; and receive such Informations as shall be given against them, or any of them; and to cause Proceedings to be against them, according to Law.

Ordered, That it be recommended to the Council, to take some Order for the Satisfying the Charge of the Serjeant at Arms attending this House, in keeping the said John Stranger and Hanna his Wife, Martha Symonds, and Dorcas Erbury.

Ordered, That the Petitioners be discharged out of the Custody of the Serjeant at Arms; and committed to such Prison as the Lord Chief-Justice of the Upper-Bench shall order: And that there be a Warrant to the Serjeant, to deliver them to the Keeper of such Prison, accordingly.

Proceedings concerning Cole.

The Lords Commissioners of the Great Seal this Day attending the House, according to former Order, to give an Account to the House, touching the Execution of the Orders of this House, in the Case of Rodney and Cole;

The Lord Commissioner Fynes did acquaint the House with the Particulars wherein they had proceeded, so far as the Orders direct: And that there are some Particulars, whereunto the said Votes and Orders do not extend; as the Vacating of the Certificate, and the Indorsing it on the Back of the Statute.

Resolved, That the Certificate of the Statute, which was filed in the Chancery, whereupon the Extent issued in this Case of Rodney and Cole, be taken off the File: And that the Lords Commissioners of the Great Seal be authorized and required to cause the same to be done, accordingly.

Resolved, That this Statute is a void Statute; and that there shall be no further Proceedings upon it.

Resolved, That it be indorsed on the said Statute, That, by Judgment of Parliament, the same is vacate; and that there shall be no further Proceedings thereupon: And that the Lords Commissioners of the Great Seal be authorized and required to see the same done, accordingly.

Resolved, That John Bulkley, John St. Barbe, William A-Barrow, Edward Hooper, John Machell, Thomas Butler, and Henry Lamnan, Esquires, or any Three of them, be the Commissioners to execute the Commission ordered by the Parliament to issue out of Chancery in this Business.

Resolved, That these Commissioners shall have Power to enquire, either by Jury, or Examination of Witnesses on Oath, touching the Damages in this Business between Rodney and Cole; and also to send a Precept to the Sheriff, to impanel a Jury for that Purpose, if they see Cause; and that they ascertain these Damages, and return the Commission into the Chancery; and that the Commission be returnable without Delay.
