Prayers.

REsolved, &c. That a Warrant shall issue forth, under Mr. Speaker's Hand, directed to the Clerk of the Crown in Chancery, to issue forth a Writ, for the new Election of a Burgess for the Borough of Colchester in the County of Essex, in the place of Sir Thomas Barrington, deceased.

Mr. Whittacre reports the State of the Information of Words spoken by Sir John Boteler, and witnessed by Mr. Wood Minister.

Resolved, &c. That Sir John Boteler be admitted to his former Fine and Composition: And that, upon his Paying and Satisfying thereof, he be discharged of his Delinquency and Sequestration, and from his Imprisonment in the Tower: And that an Ordinance be brought in for the Discharge thereof accordingly.

A Letter from Lieutenant-General Cromwell, from the Devizes, of 22 Septembris 1645, relating the Taking of the Devizes, and the Proceedings against Barcklay-Castle, was this Day read.

Ordered, That Curtys, the Messenger that brought the good News of taking the Devizes, shall have Ten Pounds bestowed upon him, by the Committee of the Army: And that they do likewise bestow Five Pounds upon the Messenger that brought Mr. Speaker, on Tuesday last, the News concerning the Proceedings of our Forces against Barclay-Castle.

Ordered, That the Committee of the Army do immediately withdraw, and do fit all this Day, both Forenoon and Afternoon, concerning the Business of the Army.

Ordered, That it be referred to the Committee of both Kingdoms, to take a speedy Care of the Preservation and Succouring of Colonel-General Pointz, upon the Informations given, That great Forces of the Enemy's are sent after him.

Ordered, That Ten thousand Pounds be charged upon the Receipts of the Excise, to be paid in its Course, with the Interest of Eight Pounds per Cent. for the Forbearance of the same, to be employed for the Service of the Cheshire Forces, and North-Wales.

Ordered, That it be referred to the Committee of both Kingdoms, to appoint a fit Person to command in Chief the Forces of North-Wales, in the mean time, until both Houses take further Order: And that it be especially referred to Mr. Recorder, to take care of this Business.

Ordered, That Sir John Price do bring in an Ordinance for regulating the Forces and Counties of North-Wales.

The House being informed, That divers of the Gentlemen of the County of Chester were at the Door;

They were called in: And Colonel Liegh presented a Petition, from divers Well-affected of that County, to the House, desiring, That it might be speedily taken into Consideration.

The Petition was read; and was, to desire, That Sir William Brereton might command their Forces again, as he did formerly.

Resolved, &c. That Sir William Brereton shall command in Chief the Forces of the County of Chester, as formerly he did, for Four Months.

The Lords Concurrence to be desired herein.

The Gentlemen were again called in: And Mr. Speaker, by Command of the House, acquainted them, That the House had read their Petition; and considered of their Desires, and the Importance of the Reducing of Chester: They have provided a Foundation of Credit for Monies for them; and have appointed Sir William Brereton to command your Forces in Chief, according to the Desires of the Petition; and doubt not, but you will take care, that the Work may be speedily carried on; it being of so great Consequence to themselves, and the whole Kingdom.

Ordered, &c. That Colonel Michael Jones be, from this House, recommended unto Sir Wm. Brereton, to take notice of the great Services done by the said Colonel Jones; and to appoint him some Employment of Honour worthy of him, if Occasion shall be.

Sir Henry Cholmeley is appointed to carry to the Lords, for their Concurrence, the Votes concerning the Scotts Army.

He likewise carried to the Lords the Vote concerning Raby-Castle, and the Names to be added to the Committees of the County of Durham.

Mr. Millington carried after him, the Vote for Sir Wm. Brereton to command in Chief the Forces of Cheshire, for Four Months: And was to put the Lords in mind of the Order, long since sent up, concerning Martial Law.

Resolved, &c. That this House doth declare, That for the future no Man who hath been in Arms against the Parliament, or hath adhered to the Enemy's Party, be admitted to be of any Committee, until his particular Case be first represented to this House, and the House give Allowance of him to be of the Committee.

Ordered, &c. That Mr. Ashhurst do prepare and bring in Letters, to be signed by Mr. Speaker, and sent to the several Counties neighbouring upon the County of Chester, to induce them, and to encourage them, to send their Forces into Cheshire; and to acquaint them, That the House has granted Ten thousand Pounds upon the Excise, to be paid in its Course; and that they do endeavour to advance this Ten thousand Pounds, upon the Credit of the Excise.

Sir Henry Cholmeley brings Answer, That the Lords will take the Votes, concerning the Scotts Army coming against Newarke, into speedy Consideration; and send Answer by Messengers of their own: And, to the rest, they do agree.

An Ordinance for securing and reimbursing the Commissioners of Excise the Sum of One thousand Pounds, being Part of Five thousand Pounds charged by former Ordinance upon the Receipts of the Excise, for the Service of the Forces of Hantshire, was this Day read; and, upon the Question, passed; and ordered to be sent unto the Lords for their Concurrence; and carried up by Mr. Erle.

Resolved, &c. That Jo. Bruen, Wm. Hussey, Robert Coker, Esquires, John Squibb, Walter Foy, John Fry of Ewerminster, and John Whiteway, Gentlemen, shall be, and are hereby, added to the Committee for the County of Dorsett.

The Lords Concurrence to be desired herein.

Resolved, &c. That such Gentlemen of the several Counties as are in Commission, and take Pay, shall not meddle as Committees in the Matter of Money.

Resolved, &c. That this House doth nominate and approve of John Fitzjames Esquire, to be High-Sheriff of the County of Dorsett: And that the Commissioners of the Great Seal do grant him a Patent accordingly.

Resolved, &c. That this House doth nominate and approve of Sir Francis Drake Baronet to be High-Sheriff of the County of Devon: And that the Commissioners of the Great Seal grant him a Patent accordingly.

Resolved, &c. That this House doth nominate and approve of John Osborne Esquire to be High-Sheriff of the County of Rutland: And that the Commissioners of the Great Seal do grant him a Patent accordingly.

The Lords Concurrence to be desired herein.

Ordered, &c. That Sir Thomas Widdrington do bring in an Ordinance for appointing a Sheriff of the County-Palatine of Durham.

Mr. Erle carried up to the Lords, for their Concurrence, the Names of several Gentlemen to be added to the Committee for the County of Dorsett: The Vote for John Fitzjames Esquire to be High-Sheriff of Dorsetshire: The Vote for Sir Francis Drake Baronet to be High-Sheriff of the County of Devon: The Vote for John Osborne Esquire to be High-Sheriff of the County of Rutland; and the Ordinance for securing One thousand Pounds, Part of Five thousand Pounds lent by the Commissioners of Excise, with Interest for the same, for the Service of the County of Hants.

Resolved, &c. That Sir Philip Parker shall have Leave to go into the Country, and to be absent from the Service of the House, for a Month.

A Message from the Lords, by Sir Edward Leech and Mr. Page;

The Lords have commanded us to deliver you these Votes concerning the Scotts Army; they moved first from this House; and they do agree to them, with this Addition; to which they desire your Concurrence: And likewise to deliver a Vote for Continuance of the Earl of Warwick to be Governor of the Islands of Guarnesey and Jersey, for one Year: A Petition of the Company of London, for Plantation of the Sommer-Islands: A Report from the Committee of both Kingdoms, concerning the Exchange of Prisoners in Ireland: An Order for passing the Commission and Instructions to the Governor of Ulster: An Ordinance for the Commissioners of the Great Seal to grant the Presentation of the Rectory of Uffington in the County of Lincolne to Mr. Henry Field. They desire to put you in mind of Captain Batten, that the Business concerning him may be expedited.

The Addition to the Votes concerning the Scotts Army were read; and, upon the Question, assented unto.

Ordered, &c. That the Members of both Houses, that are of the Committee of both Kingdoms, do, this Afternoon, communicate to the Commissioners of Scotland the Resolutions of both Houses, concerning the Scotts Army; and desire their speedy Answer, and to report the same to the House: And that they do further acquaint the Scotts Commissioners, That the Papers, by them lately given in, are under the Consideration of the House; and that they shall receive their Answer, with all Conveniency.

The Order for the Earl of Warwick to be Governor of the Islands of Guarnesey and Jersey was read, in hæc verba; "Resolved, &c. That the Earl of Warwicke is hereby made Governor of the Islands of Guarnesey and Jersey, for one whole Year next after the Date hereof, as formerly he hath been;" and, upon the Question, assented unto.

The Petition of the Company of London, for Plantation of the Summer-Islands, was read: And

Ordered, That the Passengers and Goods, mentioned in the Schedule annexed to the said Petition, shall pass Outward free, by Bill of Store, without paying any Custom for the same.

The Report from the Committee of both Kingdoms, concerning the Exchange of Prisoners in Ireland, was read: And, upon the Question,

Ordered, That it be referred to the Committee of Lords and Commons for Irish Affairs.

The Order concerning the Commission and Instructions for the Governor of Ulster, was read, in hæc verba; "Ordered, by the Lords and Commons, in Parliament assembled, That the Commissioners of the Great Seal are hereby authorized to pass the Commission, with Instructions thereunto belonging, for the Province of Ulster in the Kingdom of Ireland, bearing Date the Twenty-fifth of September 1645;" and, upon the Question, assented unto.

The Ordinance concerning Henry Field was read: And, upon the Question,

Ordered, That it be referred to the Members of this House that are of the County of Lincolne, to consider of the Fitness and Abilities of Mr. Henry Field; and thereupon to bring in an Ordinance for placing him and appointing him Rector of Uffington in the County of Lincolne.

Answer returned by the same Messengers; That this House hath considered their Lordships Message; and as to the Business of Exchange of Prisoners; the Business concerning Field, and concerning Captain Batten; they will send Answer by Messenges of their own: To the rest, they do agree.

Resolved, &c. That Serjeant John Glanvile be forthwith disabled for continuing or sitting as a Member of this House, during this Parliament.

Resolved, &c. That this House doth nominate and approve of Alexander Thistlethwayte to be Sheriff of the County of Wiltes: And that the Commissioners of the Great Seal do grant him a Patent accordingly.

Resolved, &c. That this House doth nominate and approve of Sir John Norwich Baronet to be High-Sheriff of the County of Northampton: And that the Commissioners of the Great Seal do grant him a Patent accordingly.

Resolved, &c. That this House doth nominate and approve of Colonel Thomas Mitton to be High-Sheriff of the County of Salop: And that the Commissioners of the Great Seal do grant him a Patent accordingly.

The Lords Concurrence to be desired herein.

Ordered, &c. That, on Saturday Morning, the Committee do bring in the Report of the Reasons to be offered to the Lords, against the Bailing of the Lord Savile; he being and continuing in Contempt of both Houses.

Ordered, &c. That, on Saturday next, the Report be made of the whole Business concerning Mr. Arthur Stavely, the first Business.

Ordered, &c. That Sir Thomas Widdrington and Mr. Prideauxe do, from this House, go to the Earl of Pembroke, and desire him to appoint an Under-Sheriff for the County of Westmerland.

A Message from the Lords, by Sir Edward Leech and Mr. Page;

That the Lords having frequently sent unto that House, upon the Report of the Committees of both Houses, concerning a Member of this House, the Earl of Denbigh; and having not heard from that House; the Lords do insist upon their former Votes, so far as concerneth his Lordship's Fidelity, and Affection to the Publick; and desire their Concurrence therein: And what appertains unto his Places of Command, the Lords have not intermeddled with any such Matter concerning their own Members since the Self-denying Ordinance; and desire those other Papers, which are Matters of mere Right, may, by that House, be so dispatched, as the Merit of the Person requires.

Resolved, &c. That this House doth concurr with the Lords in clearing the Earl of Denbigh, so far as concerneth his Fidelity and Affection to the Publick.

Resolved, &c. That the Earl of Denbigh shall have the Pay and Entertainment of Ten Pounds per Diem, as Serjeant-Major-General: And that it be referred back to the Committee of Accompts, to allow him the said Allowance; and thereupon to certify his Accompt.

This Committee is to meet To-morrow at Two of the Clock, in the Exchequer-Chamber; to consider, How the Engagements of the Earl of Denbigh for the Publick may be disengaged; and how the Free-Quarter taken by his Forces in Acton, and elsewhere in the County of Middlesex, may be satisfied: And have Power to send for Parties, Witnesses, Papers, Records, &c.

Ordered, &c. That a Warrant shall issue forth, under Mr. Speaker's Hand, directed to the Clerk of the Crown in Chancery, to issue out a Writ, for the new Election of Two Burgesses for the Town of Stafford in Staffordshire, in the rooms and places of Ralph Suede Esquire, and Richard Weston Esquire; being both disabled, by Judgment of this House, to sit as Members thereof, during this Parliament.

Ordered, &c. That a Warrant shall issue forth, under Mr. Speaker's Hand, directed to the Clerk of the Crown in Chancery, to issue forth a Writ, for the new Election for a Burgess for the Town of Poole, in the room and place of Wm. Constantine Esquire; who is disabled, by Judgment of this House, to fit as a Member thereof, during this Parliament.

Ordered, &c. That a Warrant shall issue forth, under Mr. Speaker's Hand, directed to the Clerk of the Crown in Chancery, to issue forth a Writ, for the new Election of one Burgess for the Borough of Weymouth in the County of Dorsett, in the place of Sir John Strangewaies; who is disabled, by Judgment of this House, to fit as a Member thereof, during this Parliament.

Ordered, &c. That a Warrant shall issue forth, under Mr. Speaker's Hand, directed to the Clerk of the Crown in Chancery, to issue forth a Writ, for the new Election of Two Burgesses for the Borough of Melcombe Regis in the County of Dorsett, in the places of Sir Richard Nappier, and Richard Kinge; being both disabled, by Judgment of the House, to fit as Members thereof, during this Parliament; and since the said Richard King is deceased.

Ordered, &c. That a Warrant shall issue forth, under Mr. Speaker's Hand, directed to the Clerk of the Crown in Chancery, to issue forth a Writ, for the new Election of a Burgess for the Borough-Town of Bridport in the County of Dorsett, in the room and place of Giles Strangwaies Esquire; who is disabled, by Judgment of this House, to fit as a Member thereof, during this Parliament.

Ordered, That the Committee of Northampton, according unto Two former Orders from the Committee of Examinations, delivered to the said Committee at Northampton by Anthony Izard, William Astley, and others, Citizens of London, do forthwith deliver all the Goods staid at Weedon, and brought to Northampton, unto the said Anthony Izard and William Astley, for themselves, and the rest of the Owners, who have petitioned this House in that Behalf; it appearing to this House, that the Petitioners are Persons well-affected to the Parliament.

Ordered, That a Warrant shall issue forth, under Mr. Speaker's Hand, directed to the Clerk of the Crown in Chancery, to issue forth a Writ, for the new Election of a Burgess for the Borough of Shaftbury in the County of Dorset, in the place of Samuel Turner Doctor in Physick; who is disabled, by Judgment of this House, to fit as a Member thereof, during this Parliament.

Ordered, That a Warrant shall issue forth, under Mr. Speaker's Hand, directed to the Clerk of the Crown in Chancery, to issue forth a Writ, for the new Election of a Burgess for the Borough of Corfe-Castle in the County of Dorset, in the place of John Burlas; who is disabled, by Judgment of this House, to fit as a Member thereof, during this Parliament.

Ordered, That a Warrant shall issue forth, under Mr. Speaker' Hand, directed to the Clerk of the Crown in Chancery, to issue forth a Writ, for the new Election of Two Citizens for the City of Bristoll, in the places of John Glanvill Esquire, disabled, and Wm. Tayler Esquire, disabled, and after deceased.

Ordered, That a Warrant shall issue forth, under Mr. Speaker's Hand, directed to the Clerk of the Crown in Chancery, to issue forth a Writ, for the new Election of a Citizen for the City of Bathon, in the place of Wm. Bassett Esquire, disabled to fit as a Member of this House.

Ordered, That a Warrant shall issue forth, under Mr. Speaker's Hand, directed to the Clerk of the Crown in Chancery, to issue forth a Writ, for the new Election of Two Citizens for the City of Wellen, in the places of Sir Ralph Hopton and Sir Edward Rodney, being both disabled to sit as Members of this House.

Ordered, That a Warrant shall issue forth, under Mr. Speaker's Hand, directed to the Clerk of the Crown in Chancery, to issue forth a Writ, for the new Election of a Burgess for the Borough of Taunton in the County of Somerset, in the place of Sir Wm. Portman Baronet; who was disabled to fit as a Member of this House, and since deceased.

Ordered, That a Warrant shall issue forth, under Mr. Speaker's Hand, directed to the Clerk of the Crown in Chancery, to issue forth a Writ, for the new Election of Two Burgesses for the Borough of Bridgwater in the County of Somerset, in the places of Sir Peter Wroth, deceased, and Thomas Smyth Ar', disabled to sit in the House, and deceased.

Ordered, That a Warrant shall issue forth, under Mr. Speaker's Hand, directed to the Clerk of the Crown in Chancery, to issue forth a Writ, for the new Election of Two Burgesses for the Borough of Ilchester in the County of Somerset, in the places of Sir Edward Phillips and Robert Hunt; being both disabled, by Judgment of the House, to sit as Members thereof.

Ordered, That a Warrant shall issue forth, under Mr. Speaker's Hand, directed to the Clerk of the Crown in Chancery, to issue forth a Writ, for the new Election of Two Burgesses for the Borough of Milborne-Port in the County of Somerset, in the places of Edward Kirton and John Digby, Esquires; who are disabled to sit as Members, during this Parliament.

Ordered, That a Warrant shall issue forth, under Mr. Speaker's Hand, directed to the Clerk of the Crown in Chancery, to issue forth a Writ, for a new Election of a Burgess for the Borough of Wendover in the County of Buck', in the place of Sir Robert Crook, disabled to be a Member, during this Parliament.

Ordered, That a Warrant shall issue forth, under Mr. Speaker's Hand, directed to the Clerk of the Crown in Chancery, to issue forth a Writ, for a new Election of Two Burgesses for the Borough of Apulby in the County of Westmerland, in the places of Richard Viscount Dungarvon, and Sir John Brook; being both disabled to sit as Members, during this Parliament.

Ordered, That a Warrant shall issue forth, under Mr. Speaker's Hand, directed to the Clerk of the Crown in Chancery, to issue forth a Writ, for the new Election of a Burgess for the Borough of Wiccomb in the County of Buck', in the place of Sir Edmund Verney, deceased.

Ordered, That a Warrant shall issue forth, under Mr. Speaker's Hand, directed to the Clerk of the Crown in Chancery, to issue forth a Writ, for the new Election of Two Burgesses for the Borough of Richmond in the County of York, in the places of Sir Wm. Pennyman, deceased; and of Sir Thomas Danby, disabled for being a Member this Parliament.

Ordered, That a Warrant shall issue forth, under Mr. Speaker's Hand, directed to the Clerk of the Crown in Chancery, to issue forth a Writ, for the new Election of a Citizen for the City of Carlioll in the County of Cumberland, in the place of Sir Wm. Dalston Baronet, disabled to be a Member of the Commons, during this Parliament.

Ordered, That a Warrant shall issue forth, under Mr. Speaker's Hand, directed to the Clerk of the Crown in Chancery, to issue forth a Writ, for the new Election of Two Knights for the County of Cumberland, in the places of Sir George Dalston Knight, and Sir Patricius Curwyn Baronet; being both disabled for being Members of this Parliament.

Ordered, That a Warrant shall issue forth, under Mr. Speaker's Hand, directed to the Clerk of the Crown in Chancery, to issue forth a Writ, for the new Election of a Knight to serve for the County of Northumberland, in the place of Sir Wm. Widdrington Knight, disabled to be a Member this Parliament.

Ordered, That a Warrant shall issue forth, under Mr. Speaker's Hand, directed to the Clerk of the Crown in Chancery, to issue forth a Writ, for the new Election of a Burgess for the Borough-Town of Tamworth in Warwickshire, in the place of Ferdinando Stanhope, disabled, and after deceased.

Ordered, That a Warrant shall issue forth, under Mr. Speaker's Hand, directed to the Clerk of the Crown in Chancery, to issue forth a Writ, for the new Election of a Burgess for the Town and County of Haverford-West, in the place of Sir John Stepney Baronet, disabled to sit as a Member, during this Parliament.

Ordered, That a Warrant shall issue forth, under Mr. Speaker's Hand, directed to the Clerk of the Crown in Chancery, to issue forth a Writ, for the new Election of a Burgess for the Borough of Newcastle under Lyne in the County of Stafford, in the place of Sir Richard Leveson Knight of the Bath; who is disabled, by Judgment of this House, to sit as a Member thereof, during this Parliament.

Ordered, That a Warrant shall issue forth, under Mr. Speaker's Hand, directed to the Clerk of the Crown in Chancery, to issue forth a Writ, for the new Election of a Burgess for the Borough-Town of Colehester in the County of Essex, in the place of Sir Thomas Barington, deceased.

Post Meridiem.

ORdered, &c. That the Committee of Lords and Commons for Advance of Monies, at Haberdashers-Hall, do pay unto Sir Philip Stapleton Knight, a Member of this House, the Sum of Five hundred Pounds, upon Account, in Part of the Arrears due unto him upon his Entertainment.

Ordered, &c. That the Entertainment of Twenty Shillings per diem be allowed and paid to Sir Philip Stapleton, as Captain of the Lifeguard to the Earl of Essex, over and above the Pay of a Captain of Horse, during the Time of his Employment in that Service.

Ordered, &c. That the Committee of Accompts do take the Accompts of Sir Philip Stapleton: And that they do allow unto him the Sum of Twenty Shillings per diem as Captain of the Lifeguard to the late Earl of Essex, for his Entertainment, during his Employment in that Service, over and above the Pay of a Captain of Horse.

Ordered, &c. That the Lady Farmour, now Prisoner at Northampton, be discharged from any further Restraint, in Exchange of Mrs. Knightley, Prisoner to the King's Forces in Banbury-Castle.

An Ordinance for passing the Pastures of Creslowe, in the County of Bucks, upon Mr. Holland, by Lease, for One-and-twenty Years, was this Day read the Second time; and, upon the Question, passed; and ordered to be sent unto the Lords for their Concurrence.

Mr. Nicholl reports the Amendments to the Ordinance for settling Ten thousand Pounds per Annum upon Robert Earl of Essex: The which Amendments altering the whole Frame of the Ordinance, the Ordinance was totally read.

Two Provisoes were added at the Table: The which were read; and, upon the Question, assented unto.

And then the Ordinance, with the Proviso, passed, upon the Question; and ordered to be sent unto the Lords for their Concurrence.

Ordered, &c. That the Ordinance concerning the University of Cambridge be read To-morrow, the first Business after Mr. Speaker come to the Chair.

Ordered, &c. That the Committee of Lords and Commons for Advance of Monies, at Haberdashers-Hall, do pay unto Sir John Meirick Knight, a Member of this House, the Sum of Five hundred Pounds, upon Account, in Part of his Arrears, or out of such Delinquents Compositions as he shall name to the said Committee.

Ordered, &c. That Sir John Meirick shall have the Allowance of Four Pounds per Week, as other the Members have, paid to him by the Committee of the Revenue; to commence from the same time the like Allowance is paid to the rest of the Members.

Ordered, &c. That the Report from the Committee of Lords and Commons for the Affairs of Ireland be made on Monday Morning next.

Ordered, &c. That the Ordinance in Mr. Rose's Hand, concerning divers Merchants, be read on Saturday Morning next.

An Ordinance for the Discharge of the Delinquency and Sequestration of the Estate of Wm. Sandham, of Chichester, was this Day read; and, upon the Question, passed; and ordered to be sent unto the Lords for their Concurrence.

Ordered, &c. That the House do sit To-morrow in the Afternoon to read Ordinances.
