Prayers.
THE humble Petition of Thomas Lenthall, John Maston, and others, Merchants, was this Day read; and was, for a final Hearing and Determination, according to the Rules of the Admiralty, before the Judges Delegates, upon an Appeal, concerning a Ship and Goods stopped at Sea, under colour of a Patent adjudged by this House to be a Monopoly.
Ordered, That the Judges Delegates do proceed to Sentence, with Effect, upon the whole Matter itself, without admitting any further Delay, or any Plea, or insisting upon the Jurisdiction of the Court, in these Causes: And the Parties, and their Counsel, are injoined to attend the Judges Delegates accordingly; who are hereby required to give a speedy Dispatch therein, according to the Rules of the Civil Law, and Merit of the Cause.
Mr. Rous reports, from the Committee for the King's Childrens Family, the Opinion of the Committee concerning the Placing of them with the Earl of Northumberland.
Resolved, &c. That Five thousand Pounds per Annum be allowed to the Earl of Northumberland, for the Keeping of the King's younger Children, in an honourable Way.
Resolved, &c. That the Earl of Northumberland shall have the Use of Whitehall, St. James'-House, or Somersett-House, or any other of the King's Houses near the City, as he shall find Occasion: And that, upon his Warrant, the several and respective Officers, whom it doth or may concern, shall deliver such Hangings, Plate, Silver Vessel, or such other necessary and sitting Accommodations, as he shall require, for the Use of the King's Children, and for furnishing and accommodating such of the King's Houses, as he shall, upon Occasion, think fit to make use of.
Resolved, &c. That the Allowance to the Physician appointed to attend the King's Children shall not be understood to be comprehended within the Five thousand Pounds per Annum allowed to the Earl of Northumberland, for keeping the King's Children.
Resolved, &c. That Three hundred Pounds per Annum shall be allowed to the Physicians appointed to attend the King's Children; viz. to Sir Theodore Mayherne Two hundred Pounds per Annum, and One hundred Pounds per Annum to Dr. Collydon.
Upon the Report of the State of the Case of Cornelius Holland Esquire, a Member of this House, in relation to his Place of Paymaster, and Clerk of the Green-Cloth, to the Prince;
It is Resolved, &c. That Mr. Holland, by the Ordinance for disabling the Members of either House to hold any Office, Military or Civil, is not disabled from the Enjoying of the said Paymaster's and Clerk of the Green-Cloth's Places, and the Profits thereunto belonging.
Resolved, &c. That a Lease shall be made, to Cornelius Holland Esquire, of the Lands of his Majesty's Pastures of Cresland in the County of Buck', formerly used for the Feeding of Composition-Cattle, for One-and-twenty Years, at the Rent of Two hundred Pounds per Annum: And that an Ordinance be brought in to this Purpose, to enable the Commissioners of the Great Seal to pass a Lease unto him, under the Great Seal, accordingly, in lieu of the Profits of his Places of Paymaster, and Clerk of the Green-Cloth, amounting, as by the Report, and according to his Majesty's Book signed, and Warrant under his Majesty's Sign Manual, unto the yearly Sum of Eight hundred and Twenty-seven Pounds and Seven Shillings.
Sir Tho. Widdrington is appointed to prepare this Ordinance.
Resolved, &c. That Four hundred Pounds per Annum shall be allowed unto Colonel Humfreis.
Resolved, &c. That Two hundred Pounds per Annum shall be allowed and paid to Mr. Nicolas Bond.
Resolved, &c. That Eighty Pounds per Annum shall be allowed and paid to Mr. Jackson.
Resolved, &c. That the Five thousand Pounds per Annum, and the Three thousand Pounds per Annum appointed to the Earl of Northumberland, for keeping the King's younger Children, and for his own Support, be paid by the Committee of the King's, Queen's, and Prince's Revenue: And that they give Directions for the Payment thereof proportionably, out of the Profits of the Mint, every Week: And that, in case such Assignation out of the Mint shall not supply the same, that then the same shall be paid out of the Receipt of the Revenue.
The humble Petition of his Majesty's Servants attending the Royal Children was this Day read: And
It is Resolved, &c. That Three thousand One hundred and Twenty-seven Pounds Five Shillings and Nine-pence be allowed to the Petitioners, and other his Majesty's Servants appointed to attend the King's Children here, by way of Pension, yearly, for Subsistence of them and their Families, and be distributed according to the Order and Directions of the Committee for the Prince's Family.
Resolved, &c. That this House doth declare, That they hold it fit, that the King's Children be forthwith removed to St. James's.
An Ordinance to enable both Houses, or the Committee of Lords and Commons for Irish Affairs, or the Committee of both Kingdoms, to prepare and give Instructions to Mr. Annesley, and Sir Robert King, appointed to go Commissioners into Ulster in Ireland, was this Day read; and, upon the Question, passed; and ordered to be sent to the Lords for their Concurrence.
Resolved, &c. That a Committee shall be appointed, by this House, to hear and receive such Matters as shall be offered and propounded unto them, by the Scotts Commissioners.
Resolved, &c. That Sir John Brownloe Baronet, Sir Richard Erle Baronet, Sir Hamond Whitchcost Knight, Francis Pierepoint, John Wray, Edward Aiscough, William Ofield, John Broxholme, Wm. Ellis, Edmund Anderson, William Disney, Henry Pelham, William Savile, Edmund Ellis, Henry Massingbird, Esquires, shall be Deputy-Lieutenants for the County of Lincoln.
Resolved, &c. That this House doth nominate and approve of Alderman Langeham, and James Langeham Esquire, his Son, to be added to the Committee of the County of Northampton.
The Lords Concurrence to be desired herein.
Sir John Clotworthy carried to the Lords, for their Concurrence, the Order for reimbursing the Commissioners of Excise Three thousand Pounds, advanced by them to the Committee of Hants: The Ordinance concerning the first Buyer: The Ordinance for maintaining the Blockhouses out of the Excise.
He was to put the Lords in mind of passing the additional Names of the Committees to the Eastern Association: The Order concerning the Comptrol upon the Excise. The Vote concerning Martial Law: The Ordinance for the Sale of Delinquents Estates.
He was likewise to desire, that the Lords would appoint a Committee to meet with a Committee of a proportionable Number of this House, to receive and hear such Matters as shall be propounded by the Scotts Commissioners.
He likewise carried up the Names of Alderman Langham, and his Son, to be added to the Committee of Northampton; and the Names of divers Gentlemen to be added Deputy-Lieutenants to the County of Lincoln.
Mr. Pierepoint carried to the Lords, for their Concurrence, the Votes made concerning the King's Children, and the Earl of Northumberland.
Resolved, &c. That the House do meet in a Grand Committee every Saturday and Tuesday, at Eight of Clock, peremptorily, to take into Consideration the Providing of Monies and Forces for the publick Service of the Kingdom.
A Message from the Lords, by Doctor Aylett and Doctor Heath;
The Lords have commanded us to bring you the Desires of the Earl of Stamford, expressed in this Paper; which they desire may be taken into speedy Consideration: The Lords Desires concerning the Duke of Guildres, expressed in this Paper; which they desire you to take into your Consideration: And an Ordinance concerning Trinity-College in Cambridge; which they likewise desire you to take into your Consideration.
The Paper, concerning the Desires of the Earl of Stamford, was read.
Sir Henry Mildmay, Sir Phil. Stapilton, Sir Edmund Fowell, Sir John Curson, Sir Christopher Wray, Mr. F. Buller, Sir Sam. Luke, Sir Symonds D'Ewes, Mr. Erle, Sir John Northcott, Mr. Knightley, Mr. Broxholme, Sir Edw. Aiscough, Mr. Dunch;
This Committee, or any Four of them, are appointed to consider of some Way for the Subsistence of the Earl of Stamford, either by the Way propounded by himself, or any other convenient Way: And are to meet To-morrow at Two post meridiem, in the Court of Wards.
The Paper concerning the Duke of Gueldres was read.
Resolved, &c. That the Duke of Gueldres shall have Leave to transport Ten Geldings, himself, his Retinue, and his and their necessary Accomodations.
The Ordinance concerning Trinity College in Cambridge was read the First time; and, upon the Question, ordered to be read the Second time, To-morrow Morning.
Ordered, That the Ordinance concerning the Government of the University of Cambridge be read To-morrow Morning.
Ordered, That the Report from the Committee for Examinations, concerning the scandalous Words spoken of Mr. Speaker, be made peremptorily, the first Business, on Monday Morning; and that no other Business do then intervene. And
It is further Ordered, That the Cheshire Business be then next taken into Consideration: And after That the Business of Ireland.
The humble Petition of divers Ministers of the County of Suffolk was this Day read: And
Ordered, That it be referred to the Grand Committee for Religion, to be taken into Consideration To-morrow.
Ordered, That, in the Absence or Sickness of Mr. Serjeant Hunt, Edward Birkhead Esquire, Serjeant at Arms attending the Great Seal of England, do attend this House.
Answer returned by the same Messengers;
The House has considered their Lordships Message, and the several Parts of it; and will send Answer by Messengers of their own.
The humble Petition of divers Gentlemen, and others, well affected, of the Isle of Jersey, was this Day read.
Resolved, &c. That a Declaration be prepared, and brought in, and sent to the Isle of Jersey, to declare how sensible this House is of the barbarous and cruel Proceedings of the Governor of the Isle of Jersey; and how much they do detest and abhorr it: And, that if he shall put to Death any of the Friends to the Parliament, that then Three for every One shall be hanged, of the Prisoners to the Parliament.
Sir Wm. Waller, Sir Philip Stapilton, Mr. Selden, and Mr. Lisle, are appointed to prepare and bring in this Declaration.
Ordered, That it be referred, and especially recommended, unto the Committee for the Admiralty, to consider of some speedy and effectual Course for the Reducing of the Isle of Jersey: And that they do make Report of this Business on Tuesday Morning next.
An Ordinance for making void all Acts and Proceedings by Captain George Carterett, and his Adherents, in the Island of Jersey, against the well-affected in that Island; and for disabling the said Carterett, and his Adherents, from holding any Place or Office there; and for giving the Wellaffected Reparation for their Losses, out of the Estates of those Malignants; was this Day twice read; and, with One Amendment at the Table, upon the Question, passed; and ordered to be carried to the Lords for their Concurrence, by Sir Wm. Waller.
Sir John Clotworthy brings Answer, That as to the Ordinance for the first Buyer; for the Sale of Delinquents Estates; the Vote for Martial Law; the additional Names to the Committees of the Eastern Association; they will send Answer by Messengers of their own: As to the rest of the Messages, they do agree: And the Lords have appointed a Committee of their whole House, to meet To-morrow Morning at Ten of Clock, in the Painted Chamber, to receive what shall be communicated from the Scotts Commissioners; and do desire, that a Committee of this House may be appointed to meet with them.
Mr. Pierepoint brings Answer, That the Lords do agree to the Votes carried up by him.
Sir Thomas Widdrington, Sir Peter Wentworth, Mr. Lisle, Sir Henry Heyman, Mr.Lane, Mr. Gourden, Mr. Morley, and Mr. Pury, are appointed to prepare Heads of a Conference to be desired with the Lords To-morrow Morning, upon the additional Names desired to be added to the Committees of the Eastern Association; the Ordinance for Sale of Delinquents Estates; the Order concerning Martial Law, sent up to the Lords, and remaining with them, and yet unanswered, though many Messages have been for the Passing of them.
They are likewise to manage this Conference.
A Letter from the Mayor and Jurates of Dover, of 8 Julii 1645; and another Letter from the Governor of Dover-Castle, of 2 Septembris 1645; were both read; and were, to desire the House to take care for the speedy Payment of the Arrears to the Soldiers of that Garison.
Ordered, &c. That it be referred to the Members of this House, that are of Kent, to conser with the Commissioners of Excise, and to consider of some Expedient, How the Excise of Dover, and the Cinque-Ports, and Members in the County of Kent, may be so ordered and managed, that from thence an Entertainment may be raised for the Pay of the Garison of Dover.
Ordered, That Five hundred Pounds be forthwith provided and charged upon the Receipts of the Excise, to be paid in Course, with Interest after the Rate of Eight Pounds per Cent. during the Time of the Forbearance of the same: And that this Five hundred Pounds be employed towards the Pay of the Arrears of the Garison of Dover.
Ordered, That it be referred to the Members of this House, that are of the Committee of Kent, to find out some Delinquent who may pay One thousand Pounds for his Composition, to be employed for the Pay of the Arrears of the Garison at Dover-Castle.
Ordered, That a Warrant shall issue forth, under Mr. Speaker's Hand, directed to the Clerk of the Crown in Chancery, to issue forth a Writ, for the new Election of a Burgess for the Borough-Town of Middhurst in the County of Sussex, in the room and place of Thomas May Esquire; who is disabled, by Judgment of this House, to sit as a Member of this House, during this Parliament.
Ordered, That it be referred to the Committee of the Army, to consider of an Establishment for the Garison at Dover-Castle, and the Forts there.
Ordered, That Mr. Marlett shall have the Allowance of Four Pounds per Week, for his present Maintenance, as the other the Members have; to begin from the Time that other Members receive it.
Ordered, That Sir Wm. Constable shall have the Allowance of Four Pounds per Week, for his present Maintenance, as other the Members have; to begin from the Time that the other Members are to have it.
Ordered, That all Papers concerning any Persons in Lancashire, either brought in to the House from the Committee of both Kingdoms, or now in Mr. Speaker's Custody; and also the Matters contained in the Petitions of Colonel Thomas Birch and Mr. Peter Harrison; be referred to the Committee of Examinations.
