Bankrupts.

ORDERED, That Leave be given to bring in a Bill touching a Disposition of Bankrupts Estates.

Bills depending last Session.

Ordered, That the Committee appointed to inspect the Bills depending the last Session of Parliament be revived; and do sit this Afternoon.

Westminster Paving.

Ordered, That Leave be given to bring in a Bill for the paving and cleansing the Streets of Westminster, and Liberties thereof, and other Parishes within the Weekly Bills of Mortality, exclusive of the City of London.

Prisoners in the Tower brought up in custody.

The House being informed, that the Earl of Castlemaine, Sir Edward Hales, Charles Hales, Esquire, and Obadiah Walker, Prisoners in the Tower, were brought to the King's Bench, by the Governor of the Tower, by virtue of Habeas Corporas, in order to their Bailing;

Ordered, That a Warrant be sent to the Governor of the Tower, to bring immediately before this House the Earl of Castlemaine, Sir Edward Hales, Charles Hales, Esquire, and Obadiah Walker; to answer to such Matters as shall be charged against them.

Accordingly, Mr. Speaker issued his Warrant: And the same was sent by the Serjeant.

Earls of Salisbury and Peterborow's Impeachment.

Resolved, That an Impeachment of High Treason be sent to the Lords, against the Earl of Salisbury and Earl of Peterborow, for departing from their Allegiance, and being reconciled to the Church of Rome.

Ordered, That Mr. Foley do go up to the Lords; and at their Bar, in the Name of the House of Commons, and all the Commons of England, impeach the Earl of Salisbury, and the Earl of Peterborow, of High Treason, in departing from their Allegiance, and being reconciled to the Church of Rome; and acquaint them, That this House will send them further Articles against them in convenient Time; and to desire that they may be committed.

Orderstouching other Prisoners.

The Serjeant at Arms acquaints the House, That the Deputy Governor of the Tower informed him, That the Earl of Castlemaine was not brought from the Tower, having not moved for his Habeas Corpus; but that, the Deputy Governor had brought Sir Edward Hales, Mr. Charles Hales, and Obadiah Walker; and that they attended at the Door.

Mr. Foley reports, That he had been, according to the Order of the House, at the Bar of the House of Lords; and impeached the Earl of Salisbury, and the Earl of Peterborow; and desired, that they might be committed: The Lords gave Answer, That they would consider thereof; and send an Answer by Messengers of their own.

Then Sir Edward Hales and Mr. Charles Hales, and Obadiah Walker, were severally brought in to the Bar; and heard what they could say to the Matters they were severally charged withal.

And being withdrawn;

Ordered, That Sir Edw. Hales and Obadiah Walker be charged in the Tower, by Warrant from this House, for High Treason, in being reconciled to the Church of Rome, and other High Crimes and Misdemeanors, wherewith they are charged by this House.

Ordered, That Mr. Cha. Hales be discharged from any further Attendance upon this House.

Ordered, That a Warrant be sent to the Governor of the Tower, to bring the Earl of Castlemaine before this House upon Monday Morning next; to answer to such Matters as shall be charged against him.

Ordered, That Sir Thomas Jenner, in Custody of the Serjeant at Arms attending this House, be brought to the Bar of this House on Monday Morning next.

Bill of Pains and Penalties.

Ordered, That a Bill be brought in, for inflicting Pains and Penalties upon such Persons as have been the Occasion of the violating the Laws and Liberties in the Two late Reigns.

Ordered, That Mr. Attorney General and Mr. Solicitor General do prepare and bring in the said Bill.

A Debate arising touching the Number of Persons to be mentioned in the Bill for Pains and Penalties;

Ordered, That the Debate be adjourned till Monday Morning, Ten of the Clock.

Message touching Commitment of impeached Lords.

A Message from the Lords, by Sir Miles Cooke, and Sir Adam Otley;

Mr. Speaker, We are commanded by the Lords to acquaint this House, That the Lords have committed the Earl of Peterborough to the Tower of London; and that the Earl of Salisbury being already a Prisoner in the said Tower, their Lordships have ordered him to be brought to the Bar of their House on Monday next.

And then the House adjourned till Monday Morning, Nine of the Clock.
