Poor Churches.

L. 1a. B. FOR the Amortysing of Lands to poor Churches, and for better Serving of Cures.

L. 2a. B. For the true Measuring, Marking, and Assising of Timber, and other Stuff incident and belonging to Building: - Secondly read, and, upon a double Question, for committing and ingrossing, rejected.

Injuries from Spaniards.

Sir Edwyn Sandys maketh Report of the Proceeding of the Committee upon the Petition of the Merchants, touching the Cruelties and Wrongs of the Spaniards. -

Reciteth the Effect of the Petition, and the particular Wrongs therein mentioned ; with other Wrongs, remembered at the Committee; as,

1. Seizing of Goods by Violence. 2. Confiscating of Hollanders Goods, without Presumption. 3. Staying of our English Ships for the King of Spaine's Service, without the Consent of the King. 4. Purveyance of Cordage, Corn, &c. as in the Case of Spencer, &c. -

Tucker had Thirteen Sentences of Restitution, but never could get Execution. -

Traitors, as Owen, and others, have found Justice and Satisfaction; other good Subjects none. -

In Four Years Ten Ships, divers Mariners, and 200,000l. Loss in Goods. -

Redress necessary. - The Merchants pray Letters of Mart. - The Committee thought fit to prefer a Petition to the King, and to send to the Lords, that they would be pleased to join.

A Letter, in Nature of a Complaint of these Wrongs, from his Majesty's Legier Ambassador in Spaine, to the Court of Spaine, delivered in by the Reporter, and read in the House [b].

This Matter to be further debated, and concluded, on Saturday next.

Curriers.

B. For Relief of poor Curriers inhabiting near the City of London, and the Liberties thereof, and not free, &c. reported from the Committee by Mr. Fuller, and, upon Question, ordered to be ingrossed.

Privilege in a Suit at Law.

Informed, that Mr. Rich. Martin, a Member of the House, stood utlawed, at the Suit of one .... Palmer, dwelling in Wood-street, in an Action of Debt; and that one Nicholas Allen, Palmer's Attorney in the Suit, did threaten to proceed to Trial.

Direction given, that both Palmer, at whose Suit, and Allen, the Attorney, should be brought to the Bar by the Serjeant.

Ditto.

Informed also, that an Attachment ad sectam Roberti Lathorp, out of the Chancery, was served upon the Person of Mr. Francis Bullingham, One of the Members of the House, contrary to the Privilege of the House [c].

The Writ was read; and in this Case of Attachment, the Party Plaintiff being in the Country, and not readily to be found, the House thought fit that Mr. Speaker should direct his Letter to the Plaintiff's Attorney in the Chancery, Mr. Evelyn: Which was done, in this Form:

AFTER my hearty Commendations: Whereas there hath been some Proceeding in your Court, against Mr. Francis Bullingham, One of the Members of the Commons House ot Parliament, first by Subpoena, and afterwards by granting an Attachment, which hath been lately served upon his Person, contrary to the known Privilege of the House; lest there might be any further Proceeding, to the Contempt of the said Privilege, or the Party Plaintiff prosecute the Matter to his own apparent Danger, I thought good out of the Duty of my Place, to make known unto you the said Privilege; and, in the Name of the House, to require you to Foresee that no further Process issue against the said Mr. Bullingham, nor that he incur other Damage, by not attending the said Suit, being necessarily and daily attendant upon the Service of this House, And so I commit you to God.

Directed:

" To my loving Friend Mr. John Evelin Esquire, One of the Six Clerks of the high Court of Chancery."

The Court adjourned until Friday, at Eight a Clock in the Morning.

Privilege- Subpoenaing a Member.

A SUBPOENA ad comparendum, ad sectam Francisci Hildesley, militis, served upon the Person of Mr. Nicholas Fuller, a Member of the House, delivered in, and read; and ordered, that the Plaintiff, and he that served the Writ, should be proceeded withal as in such Cases is usual.

Members to attend Lords as Counsel.

Mr. Speaker propoundeth to the House, whether Sir John Boys and Mr. Brock, Two Counsellors at Law, but Judges in this House, might be retained of Counsel to attend a Committee of the Higher House in a private Cause there in Question.

Urgeth a Precedent of his own, that in 27 Eliz. in the Lord Norris and the Lord Dacres his Case, he himself had Leave of the House to attend, &c.

Mr. Solicitor, and Mr. Recorder of London, in Matter of Title of Honour between the Lord De Lespencer, and the Lord Abergavenny, had Leave of the House the last Session.

Leave granted, upon this Motion.
