Royal warrant, dated Windsor Castle, to John, Earl of
Bath, Warden of the Stannaries, to call a Convocation
of Tinners ("at the old accustomed place in the
town of Lostwithiel, being within our said Stannaries,
at a certain day by you to be prefixed four and
twenty of the most substantial, discreet and wise
tinners of every Stannary Court of our Stannaries
aforesaid") to ordain and amend etc. all such
laws, customs, enormities and other things as are
amiss and needul to be repressed within the said
Stannaries and to ordain such good laws as shall
be necessay for the quietness and good government
of the tinners, the preservation of the said Stannaries
and also for the commonwealth of this realm. The
said Warden is hereby to straitly put in execution
from time to time those good laws and orders which
shall be taken by virtue hereof. All by reason that
there are sundry things at this present very requisite
to be redressed within the said Stannaries, and by
the privileges and liberties of said Stannaries granted
by the King's progenitors same have always heretofore been accustomed to be reformed by the tinners
under royal warrant [such as the present]: which
privileges and customs of the Stannaries the King
is not minded to break or take away, but to establish,
augment and confirm. |

After so importing said surrender the said great
seal is to contain a grant or demise of the premises
to said Powell for 31 years from Michaelmas last
at 13l. 6s. 8d. per an. rent, payable half-yearly:
all by reason that Richard Graham and Philip Burton
have certified that said fines are much sunk by reason
of decay of practice in the said Court; that formerly
same were worth between 300l. and 400l. per an.,
but at present are scarcely worth keeping a deputy
to look after same. The said great seal is to contain
clauses to direct the judges to make such rules and
orders as may be necessary for the due collecting or
levying of the said fines [as in the former grant]. |

forth process at the request of Bernard Grenvile
and Robert Phillipps in order to the recovery of
20,000l. (and all interest charges of 12 per cent.
thereon) against the heirs etc. of Arthur, late Earl
of Anglesea; and from time to time to issue to the
said Grenville and Phillipps to their own use and
behoof two thirds of all moneys raised thereby
and paid into the Exchequer in England or Ireland:
they satisfying the cost of said prosecution out of
their said two thirds share: all by reason that
James Nelthorpe and John Lawson, heretofore
Receivers General [under the Commonwealth] of
the Assessments for the Army and Treasurer at
War, constituted by a pretended Act dated 1659–60,
Feb. 2, for receiving and issuing all moneys then before,
or before 1660, Oct. 10, appointed for payment of the
armies in England, Scotland and Ireland, did pass
an account in the English Exchequer for the period
1659–60, Feb. 2, to 1662, April 21, in which account
they set 20,000l. in super on said Earl of Anglesea
for so much paid to him for pay of the Army in
Ireland: and by the Act of 13 Car. II, c. 3, all
receivers' etc. debts and moneys unpardoned by
the Act of Oblivion were vested in the King whereby
the said 20,000l. super vested in the King: whereupon diatringas [ad computandum] has issued
against said Earl and issues have been returned
against him, but it does not appear that he did
give any account of the said super: and the said
Grenvile and Phillipps are willing at their own
cost to prosecute the recovery of same and have
prayed two thirds parts thereof in consideration of
their charges therein and of their good and faithful
services: to which prayer the King is pleased to
condescend. |

appointed 1624, June 15, for Charles I when Prince
of Wales and likewise the survivors of respectively
the inheritance and reversion ut infra, and likewise
the survivors of the London Aldermen or trustees
appointed by Charles II ut infra to convey their
respective trusts, estates or interests in the lands
called Scoreby Fields to Tobias Jenkins upon the
terms as in a former contract made between them
and Robert Benson: all as follows, viz. By
indenture dated 1624, June 15, James I granted
to Sir Henry Hobart, Sir James Fullerton et al.
amongst other things the lordship of Sheriff Hutton,
co. Yorks (whereof the land called Scoreby Fields
are part) for 99 years from Michaelmas then last
past in trust for Charles, then Prince of Wales.
By sundry patents, conveyances and assurances the
remainder of the said term and the reversion and
inheritance thereof were afterwards vested, to wit,
the said remainder in William Williams, Robt.
Micholl, Walter Marks and Robert Marsh, citizens
of London, and the said reversion in Edward Ditchfeild, John High Lord, Hum. Clark and Francis Mosse,
citizens of London, in trust for the Mayor, commonalty and citizens of said city under a certain
yearly rent payable thereout to the Crown. Afterwards, in pursuance of the orders of Common
Council the said Robert Marsh as surviving trustee
of said remainder term assigned to John Bathurst,
Edward Clagett, William Vincent and John Benbow;
and similiter the said Humphry Clarke and Francis
Mosse as the surviving trustees of the said reversion
assigned to John Stone, Nathaniell Manton,
Methusalah Turner and Thomas Benson, who
were nevertheless to continue the trust for said
Mayor etc. Since the judgment in the Quo warranto
which was lately brought by Charles II against said
Mayor etc. Charles II did by patent dated 1684,
Dec. 24, grant to the then Mayor etc. of said city
(amongst other things) all the lands which belonged
to the Mayor, commonalty and citizens of said city
at the time of the rendering the said judgment, to hold
from Nov. 1 then last past for 99 years upon such
trusts as are therein mentioned; which grant has
been confirmed by the present King James II since
his accession. Tobias Jenkins, esq. has petitioned
his Majesty setting forth that in 1672 he employed
his son-in-law, Robert Benson, deceased, to treat
with the Committee of the Common Council in
London appointed to sell the manors and lands
belonging to the said city, for the purchase of the
said lands called Scoreby, alias Scoreby Feilds,
and an absolute grant thereof was agreed to be
made on a supposition that the yearly value thereof
was but 200l. per an. and warrants were signed
directing John Bathurst and Edward Clagett,
the surviving trustees, to convey said remainder
term to Robert Benson aforesaid, and similarly
warrant was signed to John Stone, Methusalah
Turner and Thomas Benson, the surviving trustees
of said reversion, to convey the inheritance of said
fields to said Benson. The conveyance was prepared and the purchase money paid into the Chamber
of London, but some differences arising as to the
yearly value of the premises the conveyance was
not executed and since then the Quo warranto has
been entered against the city. But last term
petitioner Jenkins has agreed the value with some
of the Aldermen and now the Attorney General
advises him that the way to obtain a good
title is to procure a privy seal to direct as above
herein. |

Prefixing: report dated July 28 last from said Deputy
Surveyor on said John Buller's petition for same.
The reversions of the said two tenements were
granted to Henry Seymour in 1664, who put in
the lives of his two nephews, Jonathan Trelawney,
now Bishop of Bristol, and Charles Trelawney, his
brother (both yet living and healthy young men),
in reversion of William Welshman in the one tenement and of William Knight in the other and under
rents of 4l. 7s. 4d. per an. for Welshman's tenement
and 48s. 5½d. for Knight's tenement; but in Seymour's grant there was an increase rent of 25l.
per an. on the first and 12l. per an. on the second.
Not long after John Hearle contracted with said
Seymour for his interest in said premises inter al.,
and in 1675 Hearle petitioned to buy off the increased
rents and change Seymonr's two lives. Said John
Buller agreed with said Hearle concerning the
ratal thereof, paid the fines and had a new lease
of the premises inter al. in 1676, and put in two of
his son's lives in Welshman's tenement and two
of his daughter's lives in Knight's tenement. One
of said sons (Francis) and one of said daughters are
since dead. In respect he paid dear for buying
in Seymour's interest, and that the tenements are
much fallen in value of late years, I advise a fine
of only 120l. on the first tenement, which now
hardly yields 40l. per an. and of 25l. on the second
tenement, being about a full year's value and at
the old rents of 4l. 7s. 4d. and 48s. 5½d. per an. |
