July 21. Warrant by Treasurer Rochester to the King's Remembrancer etc. for stay of process against sundry Recusants mentioned in the enclosed schedules [missing] and against their goods etc. and the lessees of the two-thirds part of their lands; and for all moneys levied there to be restored which have not been answered to the King; and for the discharge of the respective sheriffs who have charged themselves therewith. Same to Mr. Blathwayte. Send the Lord Treasurer an account what instructions are followed by the Commissaries of Musters in mustering the Forces. Ibid.
Same to Rawleigh Radford. On your submitting yourself to Sir Nicholas Butler you will be restored as a tidesurveyor, London port. Ibid.
Same to Lord Dartmouth [Master of the Ordnance]. On June 22 last Sir Rob. Holmes received 300l. from the collector of Cowes port for his Majesty's service in the Isle of Wight. Said money was so delivered without any regular order for the payment of it. It is necessary that Holmes be charged therewith and render an account thereof. You are to order a bill of imprest to be made forth by the officers of the Ordnance for said 300l. to Holmes on account for fortifications and other services in said island. On his endorsing the said bill, as a receipt, the receipt which he gave to the collector, and which is in the hands of the Secretary to the Treasury, shall be delivered up to him. Care will be taken that the Treasurer of the Ordnance shall be charged with the like sum in the Exchequer. Ibid.
[?] Unfinished entry crossed through [doubtless because transferred to the now missing Irish Letter Book] of a letter from? Treasurer Rochester to the Primate of Ireland. "Your Grace's of the 14th inst. came to my hands by the last packet which acknowledged the receipt of three of his Majesty's letters, particularly that concerning the 22,000l. to be returned hither out of Ireland." July 21. Henry Guy to Mr. Pepys for an account what is due in the Navy for smart money and to seamen that are wounded, and such as have lost limbs, and to the widows and children of those that are killed. Ibid.
Same to the Attorney General to report on the paper presented to the Lord Treasurer by the Commissioners of Excise and Hearthmoney about the collecting the Hearthmoney. It is to be recommended to the Judges now going the circuit to give it in charge to the respective Justices of the Peace in the several counties for satisfying the objections made against levying the said duty. July 21. Constitution and appointment by Treasurer Rochester of Alderman Charles Duncomb, of London, goldsmith, to receive from Capt. George St. Lo, commander of his Majesty's ship Dartmouth, 14 chests containing 166,308 crusadoes, 295 ries Portugal money, which were received by Charles Fanshaw, Envoy Extraordinary in Portugal, on account of the Queen Dowager's portion. Duncombe is to bring same to London and deliver it by weight and tale to the Mint Commissioners to be coined into English money for his Majesty's use. Money BookVI, p. 103b.

Royal warrant to the Attorney General for a great seal for a grant as follows for the Queen Consort for the increase of her jointure and for the present support of her state and dignity: said grant to be to trustees, viz. Laurence, Earl of Rochester, Henry, Earl of Peterborough, Sidney, Lord Godolphin, Robert Werden and Sir Edward Herbert, kt., the said Queen's Attorney General: is to be for the said Queen's life and is to comprise "the immediate possession of all the manors, lands, tenements and hereditaments [? belonging to the Crown and as per schedule] lying and being in the several and respective counties of Wilts, Gloucester, Oxford, Northampton, York, Lincoln, Huntingdon, Cambridge, Surrey and Isle of Ely and every or any of them; and of the yearly sum of 9,328l. 13s. 7d. payable out of the profits of the Post Office; and also of the yearly sum of 8,000l. issuing out of part of our revenue of Excise which were formerly by us (when Duke of York) settled upon our said dearest Consort for her jointure; and also of the further yearly sum of 10,000l. to be paid out of the Hereditary Excise arising in the counties of Beds, Berks, Bucks, Herts, Essex, Kent, Norfolk, Suffolk, Cambridge, Yorks and Somerset, excepting the city of Bristol; and 10,000l. [per an.] more out of the profits of the Post Office": all the said payments to be made quarterly from Lady day last with preference to [before] all others and by the immediate hands of the respective Commissioners, Receivers, Farmers or Collectors of the said revenues before the same be paid into the Exchequer: and if the said revenues of Excise or Post Office be paid into the Exchequer before payment of the above sums charged thereon then what is due thereon as above is hereby to be paid out of any treasure in the Exchequer and without [office] fees or allowances in respect thereof: with power to said trustees to make leases etc. for 21 years or three lives at the present rents (or more) if in lease or a fourth part (or more) of the rent or value if not now in lease: also for a grant to said trustees for the life of said Queen of the manor of East Greenwich, co. Kent, and all that mansion house called Greenwich House and the parks called Greenwich Parks and other lands, tenements and hereditaments thereto belonging; and also all the manor of Eye, co. Suffolk, and all other the manors, lands, tenements and hereditaments in cos. Norfolk, Suffolk, Lincoln, Lancs, Cumberland, Chester, Sussex, Northampton and Essex which by patent of 1678–9, Mar. 18, were granted to Peregrine Bertie, Charles Bertie and Charles Osborne in trust [for the Earl of Plymouth] which grant they have lately surrendered: with power of making leases etc. in the above: and with "directions to the trustees of our dearest sister Katherine, the Queen Dowager after her death to stand possessed thereof or transfer their trust and interest therein (subject to such leases as shall be made pursuant to their powers in that behalf) for the benefit of our dearest Consort during her life" and thereafter for the King and his successors etc. King's Warrant Book X, pp. 164–5. July 25. Royal warrant to the Clerk of the Signet for a privy seal for payment to be made to Thomas Corbyn of the 375l. arrear due to him up to 1684, Christmas, on the salary of 50l. per an. as Surveyor of Woods Trent North (which office was granted to him in 1660 for life with said salary as payable out of the Crown revenues in co. Yorks, and when same became no longer so payable by reason of the sale of fee farms it was by a privy seal of 27 Car. II made payable out of the Exchequer, whereupon it has so been paid up to 1677, Lady day, with 12l. 10s. 0d. in part of the succeeding half year): the payment of said arrears on the above privy seal being obstructed by the late King's death. His growing salary is hereby also to be paid from Christmas last. King's Warrant Book X, p. 166.
Royal sign manual for 500l. to Henry Guy, for secret service, without account: to be issued on the 10,000l. dormant privy seal of June 30 last. (Money warrant dated July 27 hereon. Money order dated July 28 hereon.) Ibid, p. 167. Money Book VI, p. 105. Order Book I, p. 41.
July 25. Royal warrant to the Clerk of the Signet for a privy seal for the payment to Robert Swan, gent., from 1684, Christmas, of the pension of 80l. per an. granted to him by privy seal dated 1668, Oct. 22, for being instrumental in the escape of Charles II from Worcester fight; the said annuity being granted only during pleasure and having thereby become void by the late King's death. The payment due at June 24 last is hereby to be presently made. King's Warrant Book X, p. 167.
Same to the Attorney or Solicitor General for a great seal for a grant to Thomas Aram of the office of Solicitor of Excise (Solicitor for the prosecution and defence of all causes before the Excise Commissioners and Commissioners of Appeals) with the salary of 200l per an. payable as from Christmas last: his patent dated 1679, July 31, of said office, being during pleasure, having become void by the late King's death. Henry Guy to the Auditor of the Receipt. The 500l. formerly advanced to the Mint Commissioners for Healing Medals is to be regularly discharged at the Exchequer by making issues thereof to Mr. Graham, Keeper of the Privy Purse, on his order of the 9th inst. Disposition Book IV, p. 53.
Same to same to issue to the Navy Treasurer 2,260l. out of the loans on the duty on French linens etc.: same to be for the charge of transporting back to Holland from the Thames the six Regiments of (Scotch) soldiers lately come from hence, with the women and baggage belonging to them. Same to Mr. Frowd [Governor of the Post Office] to pay to Richard Allibone and Richard Graham the 500l. per an. granted out of the Post Office to Sir Sam Morland, same being vested in them by mesne assignment and having been usually paid them by the Receiver General of the Post Office. Ibid.

Same to the Navy Commissioners. In reply to yours of the 22nd inst. to Visct. Falkland desiring a further supply of 29,745l. for carrying on the ordinary and extraordinary repairs of the Navy the Lord Treasurer has (since the 3,000l. mentioned in my former letter to you) directed 2,000l. to the Navy Treasurer in further part of said 29,745l. When you send for any more money on that head you are to mention the [particular] sum that you desire to have. Out Letters (General) IX, p. 109.

Appending: letter dated July 21 from the Earl of Arlington, Lord Chamberlain, to the Lord Treasurer. There is wanting for the Queen's service at Windsor Castle a down bed with a fine blanket lined with white satin, a quilt covered with white satin, and the bolster there covered with satin; four Portugal mats, two large ones (one for the Eating Room, one for the Queen's Withdrawing Room) and two lesser ones for her Majesty's little bedchamber and dressing room. They are to be delivered to Thomas Hall, Keeper of his Majesty's Standing Wardrobe at Windsor.
July 25. Henry Guy to Sir Boucher Wray. Who is to have the 100l. for taking Richd. Goodenough? Out Letters (General) IX, p. 110.
Same to the Auditors of Imprests, enclosing copy [missing] of the minutes of the late Treasury Lords concerning the arrears of the Law duty. Ibid.
Same to the Customs Commissioners, enclosing the draft [missing] of instructions prepared by you some time since for the Governor of Jamaica. You are to review, enlarge and return same as some other laws have been made and revived in Parliament since same were prepared. Ibid.
Same to Mr. Darcy et al. In yours of Mar. 14 last you informed Treasurer Rochester that not being accomptants of the money nor acquainted with the appointments or deceases of the late King's servants you could not present a particular account of them. If you [now] can make such an account do it out of hand. Ibid.
Same to Visct. Lumley. I am ordered to pay 5,000l. for the persons that took the late Duke of Monmouth. The money is ready. Ibid.
Treasurer Rochester to Lord Chief Justice Jones and Justice Charlton on the Norfolk Circuit. The Commissioners of Excise and Hearthmoney have presented me a paper containing several objections made by Justices of the Peace in several counties touching the receiving and levying of the Hearthmoney with the answers of said Commissioners thereto. They desire same to be communicated to the Justices of Assize to be by them mentioned in the respective charges at the assizes so that the Justices of Peace may take note thereof and the revenue be with less trouble collected for the future. The Attorney General conceives that the said answers are according to law and that it would be to his Majesty's service that the Judges in their several circuits either on the Bench or in their Chambers should call the Justices of Peace before them and acquaint them therewith. I enclose said paper and desire you to do as above within your circuit. (The like letter to Baron Gregory and Justice Levings for the Oxford Circuit and to Baron Atkins and Justice Sir Thomas Walcott for the Northern Circuit. The like dated July 27 to the Lord Chief Baron and Justice Holloway for the Midland Circuit and to Lord Jeffryes and Justice Streete for the Home Circuit. The like dated Aug. 7 to Sir Edwd. Herbert and Jno. Warren for Denbigh, Flint, Chester and Montgomery; to Sergt. Wynn and Jno. Powell for Brecknock, Radnor and Glamorgan; to Sergt. Bugby and Sergt. Farrington for Pembroke, Carmarthen and Cardigan and to Richard Hopton for Carnarvon, Anglesea and Merioneth.) Ibid, pp. 110, 111.
July 27. Henry Guy to Mr. Darcy et al. to pay 6l. to Mr. Gregory King for three books furnished by him containing the Ceremonial of their Majesties' Coronation. Out Letters (General) IX, p. 111.
Same to Sir Richd. Middleton, bart., at Chirk Castle in Denbigh. Sir William Neale solicits the Lord Treasurer, and stays in town for a grant of the lands he has discovered in or near the Lordship of Denbigh. Treasurer Rochester desires you to bring or send the grant which you say you have of those lands. Ibid, p. 112.
Same to Mr. Hall to examine the sufficiency of the securities proposed by William Thomas of St. Margarets, Westminster, for his office of Paymaster of the Band of Gentlemen Pensioners: said securities being himself, Edward Gresham and Jeremiah Thomas of London, goldsmith: total bond, 3,000l. Ibid.
Same to the Customs Commissioners to deliver to the Envoy Extraordinary from Portugal his goods which came in the Cleveland yacht: on payment of Custom. Ibid.

Same to Sir Robert Holmes. In reply to yours of the 25th inst. concerning the 300l. which you received from the collector of Cowes port, Treasurer Rochester orders ut supra, p. 272. On your owning the receipt of the money by endorsement on the imprest bill I will deliver you the note you gave to the Collector: the Paymaster of the Ordnance will charge himself with the like sum in the Exchequer and the Exchequer officers will give the Customs Cashier a tally for the 300l. and thereupon the Customs Cashier will discharge the said Collector thereof upon his account, "which is the nearest way to despatch this matter regularly." Ibid, p. 114.
Same to the Navy Commissioners to order 200l. [per week] part of the 400l., appointed to be paid weekly to the Navy, to be applied first of all to satisfy the 1,167l. 7s. 0d. due to Lord Colepeper and company for freight "in regard you have reported that you do not find any other ship but his (for which freight is due) to have been cast away." Thomas, Benjamin Beer, Edward Keech and Thomas Pitts during the late rebellion there; considering the circumstances the merchants were under by the said rebellion; and on payment of the duties payable on the first arrival of the ships bringing same, being several days before the Acts for the new duties on wines and linens took place. The said office to be kept in the Custom House, London, and to be open daily till 4. He to pay his receipts weekly into the Exchequer every Tuesday, keeping the moneys of all the above five heads distinct and separate. He to present to the Lord Treasurer every week on Tuesday an account of his receipts and payments and remains which is to be attested by the Comptroller of the Customs: all with the salary of 1,000l. per an. as from Christmas last: he to detain 500l. in his hands for the half year thereon to June 24 last. He to present a yearly account of the Customs at Michaelmas or within three months thereof: with exemption from juries etc. to him and his clerks. And whereas the said Richard Kent and Charles Duncombe have lent several considerable sums to the late King and may hereafter lend to the present King it is hereby declared that all such moneys shall be well and truly repaid upon their tallies for the same upon the Customs other than the abovesaid new duties on linens and coinage duty which are appropriated by Parliament: together with 6 per cent. interest for same. "And to the end it may be in our power from time to time during the continuance of the said Richard Kent in the said employment to have in our hands by way of credit or loan to us upon our said revenue of Customs the sum of 40,000l. of the moneys of the said Richard Kent and Charles Duncombe or of the proper moneys of him, the said Richard Kent alone, or so much of the said sum as we shall from time to time think fit for the supply of our occasions and to be a further and better security for the said Richard Kent's due performance" of his trust herein the said Kent is hereby to covenant that as soon as he and Duncombe are satisfied the debt now due to them by tallies on the Customs, or when less than 40,000l. shall remain due to them thereon then Kent will advance on the Customs any further sums for the supply of his Majesty's occasions to the amount of 40,000l. Instructions by same to same in reply to their memorial of the 30th inst. (1) There is a doubt as to the duty on French linen, viz. whether the new Act meant only to double the duty on French linen or whether they ought to pay double the duty over what they paid before "the former being supposed to be according to the sense of the House of Commons." Upon a prudential consideration you are to collect only double what they paid before. (2) By a clause in the Act for the duty on tobacco and sugar the duty is to be levied on consumptions thereof in this kingdom, that is to say, it is to be paid by the importer if he be a shopkeeper, retailer or consumptioner upon the importing the goods. Hereon you state a case: a shopkeeper dealing in tobacco and sending a ship to Virginia and bringing thence 50 tons of tobacco which cost there about 500l. is liable to the whole new duty in ready money which, with the former Custom included, amounts to 2,500l. which sum he is not able to pay. If you take the goods into the King's store the King's warehouses will be filled with tobacco and only such little proportions of money will be received as the retailer shall have occasion to dispose of his goods, and besides the great loss of duty by damage and decay of the goods this practice will be subject to great charge, corruption and deceit and this is likely to prove a common case in Bristol and other ports. You offer as an expedient that whoever shall import 10 hogsheads or upwards shall be deemed an importer and give security as a merchant importer. I approve thereof and you are hereby to take security for the duty accordingly in all such cases. (3) By the same Act it is provided that every merchant or importer that is not a retailer shall give security in double the value of the duty not to dispose thereof before the duty be paid or if he shall not sell or export same in 18 months from the importation, that he will pay the duties. You inform me that many seamen import tobacco in bulk and cannot pay the old Custom of 2d per lb. or find security to pay the new duty of 3d. per lb. when it falls due: that a merchant is willing to buy this tobacco of the several seamen, to pay down the old Custom and give security for the new duty as if be had been the importer. In such case, which frequently happens, you are to admit the merchant so to do. (4) Several merchants, importers of tobacco, desire to pay this new imposition in ready money provided they may have an allowance or rebate for the time given by the Act. You are hereby to give them a rebate of 2 [sic for 10] per cent. per an. which is the usual rebate in other parts of the revenue. Out Letters (Customs) X, pp. 41–2.
