November 1686, 26-30

Nov. 26. Henry Guy to the Auditor of the Receipt to issue (out of Customs money this week paid into the Exchequer) 2,000l. to Charles Toll in [part] repayment of his loan of 16,000l. Disposition Book V, p. 63.
Same to Mr. Stephens. Your servant has brought me this evening a letter from Sir John Tippetts et al. to Visct. Falkland desiring him to solicit Treasurer Rochester for 368l. 15s. 6d. to discharge 66 shipwrights and 20 caulkers at Chatham Yard; which I must wonder at, because the payment of that money was ordered on Tuesday last in the weekly disposition. If you had applied yourself to the Exchequer, you might have received the money there: and I always thought that you had applied yourself every Wednesday morning to the Exchequer to see what was ordered to the Navy on Tuesday night, since every week more or less money is ordered to the Navy. If you do not so apply, pray let me know, [so] that there may be no more of these mistakes. Out Letters (General) X, p. 35.
Same to Tho. Richards, undersheriff of Wilts. You have in your hands 40 marks levied on one White for a fine set on him for seditious words. You are to pay same forthwith into the Exchequer. Ibid, p. 36.
Same to Mr. Blathwayt enclosing the Customs Commissioners' report as below, with additional instructions proposed by them to be given to Sir Robt. Robinson, Governor of the Bermuda Island. Take care that such instructions be given accordingly. Ibid.
Appending: said report to the Lord Treasurer dated Custom House, London, Nov. 25 inst. In reply to Mr. Guy's letter of Oct. 26 last on the draft of instructions proposed to be given to said Robinson touching the Acts of Trade and Navigation, we find same to agree, mutatis mutandis, with those we formerly prepared for the Governors of the other Plantations. We offer the enclosed paper [missing], which we think necessary to be added to the said instructions if approved of by your Lordship.
Warrant by Treasurer Rochester to the Customs Commissioners to deliver, Customs free, some goods imported for the proper use of the Comte d'Adda. Out Letters (Customs) X, p. 178.

Nov. 26. Reference by Treasurer Rochester to Richard Graham and Philip Burton of the petition of Peter Batiscomb to the King: shewing that his late brother. Christopher Batiscomb, was some time since attainted and executed for high treason whereby all his lands and tenements became justly forfeit, but being mortgaged for 1,200l. and charged with other incumbrances long before the King's title accrued, the surplus would not amount to above 700l. Petitioner having been always faithful and having been much impaired in his credit by the wicked and traiterous practices of his said brother, therefore prays a grant of said forfeited estate. Nov. 27. Warrant by same to Philip Ryley. sergeant at arms attending the Lord Treasurer, to make diligent search for all or any deeds, conveyances, settlements, muniments and writings whatsoever concerning the real or personal estate of Sir Robt. Peyton, who is outlawed for high treason, and to seize and bring said papers to the Lord Treasurer for manifesting the King's title to all or any part of said estate. Appending: note of papers as follows relating to said estate. (1) An indenture dated 22 Jan., 1677–8, between said Peyton and Dame Jane his wife of the one part and Richard Spicer and John Fanshaw of the other for levying a fine of divers lands to uses: with said Sir Robert's release endorsed dated 17 Oct., 1685. (2) A lease dated 13 Mar., 1685–6, between said Sir Robert Peyton and Peyton Craven: and release thereon dated 1685–6. Mar. 15.

Nov. 29. Henry Guy to the Auditor of the Receipt to issue. out of the money of the Letter Office, 300l. to me [Guy] by way of advance, for secret service. Disposition Book V, p. 63.
Same to Mr. Burton to pay 20l. to George Macy to enable him to prosecute several clippers. Ibid.
Same to the Auditor of the Receipt to issue by way of advance to the Treasurer of the Navy 10,750l. out of the East India Company's present and 8,167l. 5s. 3d. out of Hearthmoney. The total. 18,917l. 5s. 3d. is to be applied to pay off the James galley. (Same dated same to Mr. Stephens [Navy Cashier] to receive said money and to give notice thereof to the Navy Commissioners.) Same to the Attorney General to report on the enclosed papers [missing], being the Customs Commissioners' presentment of the 25th inst. concerning a parcel of brandy seized at Whitby and condemned by the Justices of the Peace: and a letter from Mr. Hussey. correspondent to the Excise Commissioners, dated Sept. 18 last, to the officers of Excise there: a letter from George Fox, an officer of the Customs, to the Customs Commissioners, dated Oct. 28 last: the Excise Commissioners' presentment of the 23rd inst. concerning two parcels of brandy condemned by them. Nov. 29. Henry Guy to Mr. Villiers. The Agents for Arrears of Taxes have paid into the Exchequer 800l. as part of the 5,140l. due from Samuel Williams, who by privy seal supra, p. 714, was to be allowed 4,340l. on the payment of said 5,140l. on account of the last Twelve Months' [part of the last Eighteen Months'] Assessment. You are to charge your Office with the remaining 4,340l., taking Lord Dartmouth's security to discharge the same in one week's time. Out Letters (General) X, p. 37.

Same to the Attorney General to report on the enclosed report [missing] of the 25th inst. from the Customs Commissioners on William Browning's petition concerning the ship Elizabeth of Bordeaux, with other papers relating thereto: viz. as to the matter of law touching said ship. Ibid.
Same to Mr. Graham and Mr. Burton, enclosing the letters [missing] of Mr. Sterne and Mr. Sugar. You are to have extents issued forthwith against Walker's estate for the 43l. 4s. 4d. and for such other moneys as he shall be found indebted to the King. Ibid.
Same to Sir Christopher Wren. It is represented to the Lord Treasurer that there are several decays in the roof, flooring and windows of the rooms belonging to the [State] Paper Office. Estimate the charge of these repairs. Ibid, p. 39.
Nov. 29. Treasurer Rochester to Mr. Harris, Regt. [Register], for an exact account of all moneys collected in the Archdeaconry of Surrey for the redemption of captives in 1680 and paid to you; the sum collected in each parish and the names of the parishes that have made no returns, so that speedy care may be taken to get in what is behind. Henry Guy to the officers of the Mint to report on the enclosed draft sign manual [missing] for the executors of Dame Barbarah Villiers, with the papers [missing] relating thereto. Ibid.
Same to Mr. Graham and Mr. Burton to report on the enclosed certificate [missing] on behalf of Elias Allen et al. made to the King by the Commissioners for enquiring into concealed lands. Ibid.
[Treasurer Rochester] to the Bishop of Norwich. I am informed that no account can be found of moneys collected in your diocese in 1680 for redemption of captives: and though several sums have been paid [from said diocese] into the Chamber of London, yet none can tell whether the moneys collected have been truly answered until such account be sent up and compared with the payments into the said Chamber, "which was the reason the letters patent did require the Archdeacons to send up an exact of the whole to the Privy Council. I know your lordship is a stranger to the proceedings of your predecessor and his officers, but as to the method how it ought to be done your lordship well knows, being I suppose observed by your lordship in the diocese of Peterborough. All that is expected of you is to inquire of the Archdeacons or their registers or any other concerned therein. Mr. Middleton, who is very well known to you, has all the books and duplicates already sent up." Ibid, p. 40.
[Same] to Dr. Hammond, Canon of Christ Church, Oxford, and Archdeacon of Huntingdon. I am informed that 121l. collected in co. Huntingdon in 1680 for the redemption of captives was paid to Mr. Dod, since deceased, who was servant to the Bishop of Lincoln and likewise your Register. By whose order did he receive the same, and why was the money not paid to the bishop's collector in that county, "as the residue was [which was] collected in part of Hertfordshire and within the archdeaconry?" The matter must be speedily adjusted between yourself and the Bishop of Lincoln, so that the moneys may be answered into the Exchequer. Ibid.
Same to Sir Timothy Baldwin, kt., Chancellor of the diocese of Hereford. By your letter to Mr. Middleton it plainly appears that the above method [of accompting for the redemption collection moneys] was not observed, "for had the archdeacons sent the money to the bishop, his lordship or his secretary could presently have informed me what the sum was, collected upon the whole diocese: and if the archdeacons had sent up an exact account to the Privy Council as they were required, this trouble might have been saved." You are to discover and find out the account of the whole collections. Ibid, p. 41.
Nov. 29. [Treasurer Rochester] to Mr. Garrett, at Winchester, Secretary to the late Bishop [of Winchester]. The archdeacons [of said diocese] have not observed the method etc., ut supra. I hope you have by this time made an inquiry and that you intend to reply to Mr. Middleton's letter. Out Letters (General) X, p. 41.
[Same] to Mr. Holland, minister of St. George's in Stranford [? Stamford]. It appears from an account presented to me by Mr. Middleton that 5l. 15s. 0d., concealed by one Henry Waters, an appraisiator [sic for apparitor], was paid into your hands to be returned to London; which you have not done. You are forthwith to answer same into the Exchequer. Ibid.
Warrant by Treasurer Rochester to Sir John Shaw, bart., to swear in William Scrafton as deputy to Tho. Raymond, a King's waiter, London port. Out Letters (Customs) X, p. 178.
Same by same to the Customs Commissioners to add 20l. per an. to the salary of Thomas Cole, collector of Cowes port, towards clerkship and other assistance; by reason that the Isle of Wight is of late years become a very considerable place of trade, which is much increased by the new imposition on the Plantation commodities, thereby adding to the pains and labour of said Cole. Henry Guy to Visct. Preston [Master of the Great Wardrobe] to pay 200l. to Monsieur Lobell for his expenses this last voyage, "upon account of the goods which he bought and sold for his Majesty's service." Disposition Book V, p. 66.

Nov. 30. Same to Mr. Ange to report on the enclosed affidavit [missing] of Mr. John Wilcocks, about 90 guineas given to Dr. Pinfold [being moneys collected for the redemption of captives in Barbary]. Ibid, p. 37.
Same to Mr. Duncombe [Cashier of Excise and Cashier of Hearthmoney]. Treasurer Rochester notices that you bring your weekly certificates [of the cash of those branches of the revenue] late on Tuesday nights. But as this day is holyday and your certificates must be made up only to last night, you are to bring this week's certificate early to-day. And for the future you are to make up your certificates only to Monday nights, so that you may always bring them to the Lord Treasurer early on Tuesday mornings. (The like letter exactly to Mr. Lilly.) Ibid, pp. 39, 40.

Royal warrant to Sir Edmond Andros, Captain General and Commander in Chief of New England, to deliver up and cancel the bond given for Robt. Breton and Thomas Fryer in the matter of the Canary wines imported in their ship Swallow from Teneriffe and consigned to John Usher at Boston in New England, etc., ut supra pp. 994–5: the said Usher having given bond, July 16 last, for them in 510l. to Joseph Dudley, esq., the King's President [of the Court of Admiralty] at Boston to secure the appraised value of said ship, being 285l. of New England money, on the said ship being by said Court decreed to be delivered to them on such bond to abide the King's judgment in the case. Royal warrant to the Clerk of the Signet for a privy seal for the Customs Commissioners to levy and collect the duties on barilia, smalts or saffers and potashes imported into England or Wales from Scotland or from beyond the seas or exported from England or Wales up to 1695, Lady day: all the receipts thereof from the death of Charles II to the said date to be paid to the Receiver General of Customs for the uses following, viz.: (1) to pay the salaries and incidents of the officers engaged in the collection of the said duties: (2) to pay to the executors etc. of William, Earl of Kinnoul, without account, the yearly rent or sum of 940l. and all arrears thereon: and likewise the sum of 235l. on the last day of the original term therein as follows; (3) the residue to be paid, as to a moiety thereof, to Thomas Broderick and the other moiety to William Jackson and Martha his wife, their executors etc., without account: the last three months of the 31 years term, as follows, is to be hereby paid to said Broderick: the present privy seal to be revokeable at the King's pleasure. The present privy seal is by reason that by indenture dated 1666, July 30, between Charles II and William, said Earl of Kinnoul, the said Customs were demised to said Earl for 31 years from 1664, Lady day, under the rent of 240l. per an.: and by an indenture tripartite dated 1668, Nov. 21, between said Earl of the one part, Tho. Broderick of London, merchant, of the second part, and Benjamin Martyn of London, merchant, of the third part, the said Earl demised to said Broderick and Martyn the said duties for 26 years from the then ensuing Christmas under the yearly rent of 940l. by them to be paid to said Earl yearly and 235l. on the last day of the said original term: which said Benjamin Martyn afterwards died and Martha Martyn, his relict, was administratrix, and it was afterwards decreed in Chancery that she and the said Broderick, pursuant to articles of agreement in that behalf, should enjoy the premises by moieties without benefit of survivorship: and further the moiety of the premises belonging to the said Benjamin Martyn was by good assurance settled in William Jackson of London, gent., and Martha his wife, daughter of the aforesaid Benjamin and Martha Martyn: and further by a great seal dated 1666, July 30, Charles II pardoned and released to the said Earl, his heirs etc., the said rent of 240l. reserved on the premises; but the present King is advised that the grant of said Customs of smalts etc. being made on the Act of Tunnage and Poundage of 12 Car. II, e. 4, did expire on the death of Charles II, but his Majesty of his royal grace and favour is pleased to regrant the said Customs on smalts etc. as herein for the remainder of the abovesaid term with the condition only that the said Customs be collected by Customs officers thereto appointed by the Lord Treasurer etc. ut supra. Nov. 30. Royal warrant to Treasurer Rochester to pay 300l. to Andrew Cockaine, late Yeoman Rider of the Hunting Horses to Charles II, without account, for his charges in building upon Charles II's ground at Newmarket by permission and sufferance of Charles II a house or tenement standing near the church there, containing 12 rooms besides the cellars, which house Charles II was pleased to take for his own service, declaring that Cockaine should have 300l. for same and 20l. per an. at the Board of Greencloth till said 300l. should be paid; which 20l. per an. has been paid up to June 30, 1685, and by deed dated 1686, Nov. 25, the said Cockaine has released his interest in said house to the King.
