Feb. 3. Henry Guy to the Auditor of the Receipt to keep apart and not to issue without special instructions the moneys which Major Brett et al., Commissioners for receiving the rights and dues of Admiralty in the last Dutch war, are directed to pay into the Exchequer. Out Letters (General), p. 372.

The Treasury Lords to Sir William Scroggs, Lord Chief Justice. The Farmers of the Law duty inform us that the duties due thereon from the attorneys and others belonging to the King's Bench Court are wilfully and negligently omitted to be paid, notwithstanding the penalty; and that they, the Farmers, have in the King's name prosecuted them in the respective courts for the arrears and forfeitures. Said Farmers have prayed us to inform you that in the covenants with them the King reserves to himself the disposition of such arrears and forfeitures which are to be paid into the Exchequer and not to go on account of the Farmers' rent. We recommend this matter to your consideration. Ibid, p. 374.
Henry Guy to the parties concerned. The Treasury Lords have at the request of Samuel Rolls, Esq., put off to the first Tuesday in March the hearing of the matter of the lease to Mris. Howen of certain mills in Cornwall built under high water mark. Ibid, p. 380.

Prefixing: said order dated Whitehall Jan. 28 last referring to the Treasury the petition of Adam Gronen representing the great want and scarcity at present of gum seneca in the nation for the trade of dyers, hatters and the like and that same is the growth of the rivers Senegal of which the Dutch are sole masters and therefore praying leave to import 70 or 80 tons from Holland under conditions as usually granted heretofore.

Feb. 5. Same to Sir Thomas Exton and Sir P. Pett. The Treasury Lords find by what they observe of Mr. Phillip Browne that they cannot depend upon the evidence he has pretended to produce so as to proceed thereon to adjudication in the cause touching the ship claimed by the Genoese. They advise the deferring the hearing of said cause till it may be done with more certainty for the King. Ibid.
Same to Mr. Fillingham to certify the Treasury Lords what arrears are due from the receivers and head collectors of the several hundreds and divisions of co. Cornwall upon the Royal Aid and Additional Aid. Ibid.
Same to the Customs Commissioners to attend the Committee for Trade and Plantations in the Council Chamber on Saturday next with Mr. Miller at the hearing of the business against Culpeper for misdemeanours committed at Carolina. Ibid, p. 376.

Same to the Bishop of Lincoln. The Treasury Lords are informed that there are great arrears of Tenths standing out in your diocese by the neglect of former bishops and sub-collectors and the exactions of 19s. by the sub-collector for the arrears of every year of all Tenths which is said generally to amount to almost double the sum due to the King for those arrears. My Lords have perused several matters presented to them for the better collecting of those arrears, and I hereby acquaint you therewith: (1) that sequestration be by you granted of all such benefices where there shall be arrears of Tenths after refusal of payment upon notice left, especially upon all livings and benefices not held by institution: (2) that you order your sub-collector not to receive above the usual fee of one year for all arrears of every benefice except where he be constrained to sequester a benefice for non-payment: (3) in regard many clergymen are in benefices by sequestration and not by institution, whereby much damage is [done] to the King in his Tenths and also great dilapidations, that where the benefice is not above 20l. a year you admit a moiety by way of composition rather than lose all or undo many clergymen; by this it is supposed the payment of that moiety would be expedited and all those Tenths for the future constantly paid whereas they swell every year now more towards an impossibility of payment: (4) that the sequestrations in the case be granted by you and not referred to the archdeacons who by themselves or their officials or registers are said to recommend their relations upon voidance of benefices to hold them by sequestration to serve the cures only and so are likely to be partial. The Treasury Lords desire your opinion whether putting the above in execution will conduce to his Majesty's service. "If your lordship will give me leave I would offer to you that Mr. Gilbert, your lordship's secretary, may be as fit a man as any to undertake the collection, whose integrity and ability is very well known to your lordship and hath been so a long time to me."
Feb. 5. Henry Guy to Mr. Slingsby for any objections against the enclosed draft of an order if you find it not agreeable to what was resolved at the last hearing [of this matter of your accounts] before the Treasury Lords and Barons of the Exchequer. You are to forthwith carry your accounts for 1678 and 1679 to the Auditor. Out Letters (General), p. 379.
Same to the Bishop of Hereford to send up to the Treasury Lords by some trusty hand several writings and papers belonging to the estates of Jesuits and other Romish priests, said papers having been seized by Capt. Skidmor, of Kentchurch, one of the Justices of Peace for co. Hereford, and delivered to you. Ibid.
A like letter to the bishop of Peterborough to send up papers similarly seized by Mr. Arnold, a Justice of Peace for co. Monmouth.
Same to Mr. Lawrence. Mr. Trant has promised to pay 1,457l. 10s. 7d. to the officers and widows of the Barbados Regiment on the 20th March next on the account of the old Barbados [Four and a Half per cent. duty] farm, upon the delivery of tallies to him for the same. You are to keep those tallies in your hands till the 20th March, so that they can be delivered up accordingly on payment of the money. Ibid, p. 380.

"But in regard some part of the said sum and reward is or may be already authorized to be paid in the orders of repayment which were drawn for several of the principal sums comprehended in the said account," the risk of double payment is to be obviated by making memoranda on the margent of the said orders drawn for said principal sums or by omitting in the orders hereby directed to be drawn the interest which is borne upon orders already drawn: the present sums to be satisfied by tallies on the Customs. [? Feb. 5.] Letter of direction on 305l. 6s. 0d. in part of an order of 1678, Sept. 4, for 4,000l. to Phillip Packer for one year's extraordinary of the Works: the present sum to be to pay for paving in the streets and to be satisfied by tallies on the wood Farmers. Order Book XXXVIII, p. 70.
Appending: (1) a previous letter of direction for 1,396l. 15s. 7¼d. to be by tallies on Anthony Rowe et al., Hearthmoney contractors: (2) a later letter of direction dated 1680, April 14, for a further 50l. to be paid upon this order.
Feb. 6. The Treasury Lords to the Duke of Ormonde. In ours of Nov. 15 last to you we intimated that 6,076l. for stores sent into Ireland in 1669 was still unpaid, see supra, p. 260. The Commissioners for the Office of Master of the Ordnance are very pressing in their occasions herein, and are under great necessities in their office, which we are very sensible of. We have received nothing from you since we acquainted you with the King's pleasure herein. We desire you to take immediate course for payment of the money. Out Letters (General), p. 381.

Report to the King from the Treasury Lords on the petition of Capt. Martin Sandys as by the order of reference of May 9 last, petitioner praying to have his debt of 1,756l. 14s. 5d. to the King remitted. By certificate of the Deputy Auditor for co. Worcester there is remaining in the petitioner's hands upon the determination of his account as Receiver of Hearthmoney for said county for 3½ years to 1674, Lady day, 871l. 3s. 1d., and on his account as Receiver of the 1673 Eighteen Months' Tax 885l. 11s. 4d. In 1670 when he first came to be Receiver of said Hearthmoney he improved that revenue 294l. 12s. 0d. [per an.] and continued it much about the same rate while he continued Receiver. He alleges that 83l., part of the said Hearthmoney debt, is in the hands of Samuel Caldwell, a sub-collector, and 736l. 9s. 5d. in the hands of Francis Hanbury, a deputy collector, which debts he offers to assign to the King. The Attorney General advises us that the condition of Hanbury's bond is not clear. Your Majesty may gratify petitioner in consideration of his services and loyalty and of his sickness which compelled him in his receivership to employ deputies. Feb. 7. Treasury warrant to the Customs Commissioners to employ Peter Taylor as a watchman, London port, loco George Thwyn, deceased. Out Letters (Customs), p. 172.
Royal warrant to the Clerk of the Signet for a privy seal to give full power to the Justices of the King's Bench (Sir William Scroggs, Chief Justice, Sir Thomas Jones, Sir William Dolben and Sir Francis Pemberton, Justices, and the Attorney General and the Coroner and Attorney of said court and to the said Justices now and for the time being) power and authority for assisting the prosecution of Papists' and Recusants' estates, that whenever any money shall become due and payable unto the King by any person by prosecution upon the penal laws, and it shall appear by certificate of the Attorney General or Attorney of the King's Bench Court that any person has bestowed any charges or travail on the King's behalf in the prosecution thereof, you may give warrant and allowance to such person of such money in recompence thereof as you shall think fit, same to be paid out of such money as shall be paid into your court for the King's use upon such prosecution: such allowances to be entered upon the rolls of said Court: all by reason that the King has been informed that the laws against Papists have not been so effectually put in execution as they ought to have been; and the King having by his proclamation of Dec. 21 last (reciting the statutes of 23 Eliz., c. 2, 3 Jac., c. 4, 3 Car. I, c. 2) commanded his subjects that if they knew any person guilty of the offences against the laws to depress propery they should immediately reveal the same to some magistrate; the King likewise therein promising a privy seal to the Judges of the several courts at Westminster to reward all prosecutors upon the said laws. Feb. 9. Henry Guy to Sir Peter Pett to take the evidence of Phillip Browne and Thomas Fisher concerning the Genova ship seized in Ireland. (The like letter to Sir Tho. Exton.) Out Letters (General), p. 382.
Same to the Customs Commissioners to present Symon Young, of London, merchant, upon the first vacancy. Ibid.
Same to the Auditor of the Receipt. In your certificate of the 6th inst. of receipts and payments in the Exchequer there is 1,558l. 6s. 11d. of First Fruits and Tenths remaining in the Exchequer. You are not to issue any of that money without particular directions. Ibid.
Same to the Barons of the Exchequer to advise with the Judges of the other courts and prepare a method for the better convicting of Popish Recusants and the bringing in of two-thirds of their estates into the Exchequer. Send the same to the Treasury Lords the 19th inst. Ibid.
Same to the Lord Chief Baron. The Treasury Lords notice that there are no returns of Recusants' estates from the city of London and counties of Middlesex, Leicester, Norfolk, Northampton, Oxford and Sussex. Send to the respective sheriffs to know the reason thereof. Ibid, p. 383.
Same to the Auditor of the Receipt. My Lords have appointed Thursday week for hearing the matter concerning the fines in the hands of Mr. Astree as Coroner of the King's Bench. (The like letter to Mr. Astree.) Ibid.
Treasury warrant to the Auditor of the Receipt to issue 411l. to Ralph Montague, Esq., upon any unsatisfied orders in his name as Master of the Great Wardrobe: to be issued as imprest; 315l. thereof being intended to pay for the furniture of the Henrietta yacht and the remainder for other uses in the office of the Wardrobe and in part of 3,000l. which the Treasury Lords promised to supply to said Office: to be issued out of Hearth tax moneys in the Exchequer. Money warrant for 26l. 13s. 4d. to John Pottinger for half a year to Christmas last on his allowance as Comptroller of the Pipe; for writing the farms and debts of Recusants in Pipe hand twice every, year; to be paid out of any issues of Recusants' estates in the Exchequer. Treasury warrant to Auditor Shales to make allowance of 374l. in Lewis Harding's account as late Receiver of the One and the Eleven Months' Assessments in co. Beds: his surety Paul Cobb having petitioned the Treasury representing that on a former petition from said Harding for an allowance on the 34,776l. 3s. 9d. collected by him a Treasury warrant was made for allowing him 175l. for charges and 150l. for salary as solicitor [for said assessments in said county] from July, 1666, to Christmas, 1668, and 50l. for passing his accounts: but by reason there was an arrear of 1,822l. 12s. 0¼d. on said Receiver, the former Treasury Lords respited the passing the said warrant till said arrear was cleared: that the said Cobb and the executrix of Lewis Paradine (another of said Harding's sureties) have since paid 1,370l. of said arrear and Cobb is ready to pay 78l. 11s. 10½d. to complete same if said 374l. be allowed as above. Report to the King from the Treasury Lords on the petition of Joseph Crispe as by the order of reference of Nov. 25 last. Petitioner, prays a grant of the place of Escheator of the Leeward Isles. On enquiry as to the nature and use of said office we are informed that the escheator there takes recognizances of and collects the escheats due to the King [such] as all fines and forfeitures arising by penal laws (except in some cases) and has always been esteemed altogether necessary for your Majesty's service in those parts. We are also certified that petitioner has been instructed by the Governor and inhabitants of these islands in negotiating in America a treaty of neutrality between them and the French and by their orders has for a long time solicited the ratification thereof here in Europe and has very well deserved of your Majesty and of said inhabitants by his diligence besides his great expence therein. Advise that he be granted said post for which he is qualified, the grant to be with such powers and instructions as the Attorney General shall advise. Ibid.
