service of the Navy, nor to produce more than three
loads of timber valued at 5l., and to deliver same
with the offal thereof to the churchwardens of the
parish of Low Leyton, Essex ; the minister and
inhabitants having represented to Treasurer Danby
that in the late times of rebellion an honest and loyal
minister was thrown out of the benefice there,
and the vicarage wanting a settled incumbent for a
long time, the vicarage house became so ruinous
that it is no way fit to inhabit, and therefore praying
a grant of wood as above towards repair thereof :
the Attorney General [sic for Surveyor General
of Woods, Trent South] having thereon reported
that said ten pollards may well be spared in said
[Wall] wood.

Report from same to the King on the Earl of Essex's
draft of a letter as follows forwarded from Dublin
Castle, Aug. 14 last for approval, said letter being
in behalf of Mortagh Dowling, assignee of Sir James
Shaen for lands as follows ; which letter the said Earl
of Essex finds "very fair and reasonable for his
Majesty to sign, and shall certify this much to it
that had Sir James Shaen taken out his certificate
I had then been required by the Acts of Settlement
to have passed letters patent thereupon, but he having
having taken out none, there must be a letter of
his Majesty's before any such grant can be passed."
Said draft being referred to Treasurer Danby, he
hereby reports to the King that he has nothing
to object against it.
Appending : Said draft. Mortagh Dowling, gent.,
petitioned the King setting forth that Sir James
Shaen, Kt., purchased among other lands the
lands as below containing together 1,805 acres
3 roods in Meath and Westmeath from several
adventurers and soldiers, and claimed the same
among other lands, from the late Commissioners
for executing the Acts of Settlement and Explanation
as assignee of the said adventurers and soldiers
who were proved in possession thereof May 7,
1659. The same were adjudged by the said
Commissioners to be confirmed to him, said
Shaen, as the two third parts of the lands claimed
by him in right of the said adventurers and
soldiers, retrenchment being made of the other
third part according to the said Acts. But the
said Shaen expecting to have confirmed to him
the whole lands which he claimed, did neglect
passing any certificate for the said lands from the
said late Commissioners or any letters patent from
the King. Said Shaen has conveyed his interest
in said lands to petitioner, who being to be confirmed
therein by the said Acts, prays a patent
of grant of said land under the yearly quit rents
payable thereout, which quit rents have been constantly
paid by said Shaen and petitioner and those
claiming under them. Said petition is recommended
by the Earl of Essex [late] Lord Lieutenant of
Ireland who has therewith sent a report made by
Thomas Taylor, one of the sub-commissioners
to the said late Commissioners for executing said
Acts whereby the truth of said allegations appears.
This is therefore to require the passing of letters
patent under the great seal of Ireland for a grant
to said Dowling and his heirs, etc., of 206 acres
of profitable land, plantation measure, in Donore and
Coolefane [Coolfin], 233 acres ditto in Ballinlaban,
both in the barony of Moycashel and co. Westmeath
and the town and lands of Newcastle containing
680 acres of like land, Kilcorney containing 256 acres
2 roods ditto, 49 acres ditto in Great Posseckstown,
48 acres ditto in Cornelstown, said four items
being in the barony of Moyfenrath and co. Meath ;
and the town and lands of Marshall's Town containing
216 acres ditto, and 117 acres 1 rood ditto
in Curtistown, both in the barony of Deece and
co. Meath, being 1,805 acres 3 roods in all, to hold
of the King as of the Castle of Dublin in free and
common socage under the several yearly quit rents
payable under the Acts of Settlement and
Explanation.

"I have considered the within written accounts of
extraordinaries and as for the first article mentioning
3,200l. I can by no means think fit to allow
it, nor any part of it, because his Grace was all
that time under his Majesty's large and honourable
entertainment. The second and fifth articles seem
very equitable, though the occasion be unusual.
The third and fourth articles are for the most part
allowed in all accounts of extraordinaries. The last
article seems just and reasonable to be allowed, and
the rather because a ship of his Majesty's could
hardly have gone and come back but at double
the expense, besides the hazard, and therefore
excepting the first article, as aforesaid, I humbly
conceive all the rest fit to be allowed."

Warrant from Treasurer Danby to the Customs Commissioners
to discharge William Christian, Collector
of Whitehaven port, of the surcharge of 35l. 17s. 0d.
wherewith he stands charged for having suffered
Geo. Strafford, a man of Scotch parents, but an
inhabitant of Ireland, to enter at two several times
107 barrels of herrings, for which he paid only
[the Book of Rates duty of] 5d. a barrel as an Irishman,
but by reason he [Strafford] was not so named
in the [Customs] entries, said Christian is charged
with 3s. for every barrel whereof he alleges he never
received one penny. From your report of July 2 it
appears that the Act for Encouragement of Trade
provided a Custom of 1l. 16s. 0d. per last for white
herrings imported to England, Wales or Berwick in
any foreign vessel and that in 1671 some of the
King's subjects of Ireland imported herrings to
Whitehaven and paid only 5d. per barrel duty. In
excuse of his act said Christian pleads that the surveyor
of said port having formerly desired to be informed
in general whether Scots were to be reputed
denizens or aliens the then Commissioners of the
Customs did by letter inform him that the Scots not
being in construction of law understood aliens, are to
enter as natives, and to pay only English Customs ;
which general direction being according to the
Act of Tunnage and Poundage the petitioner
misapplied it to this particular case, not taking
notice of the said imposition setled by said Act of
Trade : from all which it appears that his omission
herein was by mistake and without any intention
of fraud to his Majesty. Further an additional
allowance of 10l. per an. is to be inserted on the
Customs establishment for said Christian from
Lady day last, he having been in January last
directed to collect the Customs of Whitehaven for
his patent salary as Customer of Carlisle (the salary
of 40l. per an. of the Collector of Whitehaven being
retrenched) with an allowance of 10l. per an. for a
clerk there from Lady day last, to which the Customs
Commissioners recommend the said further 10l. per
an. towards the charges of said clerk, and in regard
of the difficulty of returns of money.

any orders in his name for the service of the Office
of Ordnance.

appointed to inspect the business of the Mint
having represented to Treasurer Danby that said
St. Leger, the present Warden of the Mint, has
made no account of moneys relating thereto from
1660, April 16, to 1666, Dec. 20, nor from 1670,
Dec. 20, to 1677, Dec. 20, and likewise said Slingsby,
present Master and Worker of the Mint, has made
no account from 1662, Dec. 30 (being the date of
his patent) to 1666, Dec. 20, nor from 1670, Dec. 20,
and 1677, Dec. 20, although they have both passed
their accounts for 1666, Dec. 20, to 1670, Dec. 20,
"which seems to be very disorderly and irregular."
