Solicitor General "by his Majesty's command
in the presence of several of the Lords of his Majesty's
Privy Council" to forthwith bring an action in his
Majesty's name, to the value of 20,000l. by writ
of Quo minus out of the Exchequer against John
Baker, of Thistleworth, to answer the damages and
loss received by his Majesty by the breach of his
agreement lately made in the presence of several
Lords of the Council for the management of the
revenue of Excise under a certain salary to be received
and several heads for covenants to be performed by
him, and in case of failure to forfeit 10,000l. to the
King : Baker having failed in the performance
of his said undertaking, although the time to which
he was first confined has been prolonged to him
considerably ; by which failure the King's service has
suffered great prejudice and loss.

Sherwood Forest to fell 100l. worth of timber (not
fit to be used in the building of shipping) to be
employed towards the rebuilding of Kirklington
Church, co. Notts : it being represented in a
petition from Andrew Meires, minister, and from
the churchwardens thereof that said church lies
wholly demolished by a violent storm of wind,
and that they are of themselves unable to rebuild
it : the said Surveyor General having reported
that he has viewed said church and finds that the
parishioners have made some progress in the
rebuilding thereof, but stand indebted for the
materials used and for workmen's wages. (Treasurer

Report [to the King] from Treasurer Danby on the
petition to the King from the Governor, etc., of
the Plantation of Londonderry, (which said petition
sets forth that the King did in Jan., 1675-6, by
letter direct the Lord Lieutenant of Ireland to pay
them the remaining 4,000l. in compensation for
their right to the Custom of Londonderry, and by
reason that no fund is appointed for the payment
of the same prays that it may be paid either out
of the surplusage of the revenue of the kingdom
[of Ireland] after the civil and military lists are
satisfied or otherwise, as the King shall think fit).
Before I make a full report hereon I find it necessary
to be informed from the Earl of Anglesey, late
Vice Treasurer of Ireland (and accordingly have
sent to his lordship) whether a conveyance has not
been already made from the city of London of all
their right and interest to the Customs of Londonderry
upon the sum of 6,000l. paid by said Earl
upon account of this matter.

wastes, spoils and abuses since 1660, June 24, in

for interest upon the several accounts as follow
made up by Auditor Richard Aldworth, viz., one
account declared Jan. 28 last for six per cent.
interest on 158,770l. 7s. 0d., advanced and lent to
the King by said Kent from the several dates of such
loans to 1675, July 1 (interest 3,825l. 11s. 3d.) ;
another account declared June 9 last for the like
on 178,571l. 13s. 2d. from 1675, July 1, to 1675-6,
Jan. 1 (3,972l. 5s. 3d. interest) ; and another account
declared April 27 for the like on 67,666l. 13s. 4d.
from the several days of lending until the said
1st Jan., 1675-6 (interest 1,686l. 13s. 5d.). "And
whereas the said Richard Kent hath advanced
the sum of 8,565l. upon the credit of a tally struck
on the Excise to be satisfied in or about Dec., 1677,
which said 8,565l. was paid to Sir William Godolphin,
our Ambassador Extraordinary to Spain, for our
service, and hath also advanced and lent and undertaken
to advance and lend several sums of money
on the credit of tallies struck and to be struck
for the quarterly payment of 1,500l. to Sir Allen
Apsley for the Duke of York" until the 20,000l.
to said Duke as by the order of 1670, June 22, be
paid ; "and whereas we may have occasion to
borrow several other sums of money of the said
Richard Kent from time to time for the accommodation
of our affairs "he is to be hereby granted the
additional allowance of 2 per cent. per an. as gratuity
for the loan and procuring the said several sums of
158,870l. 7s. 0d. and 178,571l. 13s. 2d. He is therefore
hereby to further receive 1,275l. 3s. 9d. and
1,324l. 1s. 9d. as such gratuity on said sums and
such 6 per cent. interest and 2 per cent. gratuity on
8,565l. paid as above to Sir William Godolphin and on
the moneys paid to said Apsley as above as may
appear due to him upon [statement of] account
thereof. All the above sums so due for interest are
to be paid by tallies on the Excise. "And whereas we
have cause[d] several tallies to be levied on our said
revenue of Excise for the sum of 250,580l. of the
moneys advanced and lent to us by the said Richard
Kent and by our letters patent under our great seal
of England we have directed the payment of the
said tallies as they are mentioned in a schedule
annexed to the said letters patent according to the
precedency of the date of such tallies" in gracious
consideration of Kent's services in having very
seasonably advanced and lent same for our immediate
service he is hereby allowed 2 per cent. per an. [as
gratuity] for the moneys unpaid upon Jan. 1 last
of the tallies in said schedule, such gratuity to be
paid quarterly as it grow due till the respective
times of the repayment of the said unpaid moneys.
