Please report what you think fit to be further done for recovering his Majesty's Duties and effectually preventing such practices for the future. |

Salisbury. They acquainted us that he had been tried for dealing in merchants’ goods contrary to his instructions and fined six months'
wages. |

The complaint of John Lee, late midshipman on board the Salisbury, against Capt. Fra. Hosier, late Commander of the same, for taking merchants’ goods on board the said ship and trading with the same in several ports in the West Indies, having been laid before the Court
and several witnesses having been examined thereupon it doth appear to the Court both by the deposition of the witnesses and by Capt. Hosier's own confession that he did take some parcels of goods on board at different times and trade with the same to some ports in the West Indies: and it is the unanimous opinion of the Court that
Capt. Hosier by so doing has acted contrary to the 140th article of the General Instructions given to all the Commanders of his Majesty's ships of war. But in regard that Capt. Hosier has laid before the
Court the orders which he had from the Commanding Flag in the
West Indies to proceed to the several ports at which he touched and that he has satisfied the Court he was obliged to take some small goods on board with him to make presents or to sell to the Spaniards to procure him a free access to the inhabitants of the country and thereby to get better intelligence of the enemy, which had so good effect that he took two of the enemy's ships out of the port of Santa
Martha, and whereas it further appears by the examination of the officers that she never was so pestered with any goods but that she was always ready to be put immediately into a condition of fighting in case of meeting with an enemy, the Court therefore in consideration of the abovesaid reasons do only think fit to fine the said Capt. Hosier for this his misdemeanour six months’ pay for the benefit of the Chest of Chatham. |

as security for the purchase money for the slaves) was released after having been six weeks on board the Salisbury: the said 7,000 pound weight of indigo being entered as prize goods to defraud her Majesty's
Duties at Chatham Custom House was seized on and brought to London, information being exhibited against the said goods. But we are informed that Capt. Hosier hath got the said goods from out the
Custom House at London without any legal or lawful delivery. Out
