Jan. 11. Warrant by Treasurer Godolphin to permit Peter Renue of London, merchant, to export, without payment of Duty, the prize fish which he bought from Philip Pentire of Plymouth, merchant, out of the prize Peace of Granvil, Peter Hugon late master, lately taken from the French by her Majesty's ship August whereof Lord Duffus is Commander. Security is to be given that same shall be exported to a foreign market and no part of it landed in Great Britain.

William Lowndes to the Customs Commissioners to report on the enclosed letter [missing] of the 5th inst. from the Customs Commissioners in Scotland touching some overtures made to them for compounding for a parcel of French wines under seizure. Ibid., p. 129.
Report to the Lord Treasurer from William Blathwayt as Auditor General of the Plantations on the memorial of Col. Ro. Hunter dated London 1709 Dec. 30, as referred Jan. 10 inst. to said Blathwayt, supra, p. 120, showing that he is entitled by her Majesty's letter to 500l. per an. out of quit rents of Virginia until his arrival there, and praying a continuance thereof for a year from June 1 next in regard of the great expenses he has been at and that by the planting the poor Palatines in New York he is stripped of the chief perquisite in that Government viz. the granting of lands.
Hereon Blathwayt reports that the last account of "that" [Virginia Quit Rents] revenue to April 1708 showed a balance of 191l. owing to the Queen. I compute that at the end of June next there may be a balance of 941l. or thereabouts and at the end of one year more viz. June 1711 (the time to which Col. Hunter prays that his allowance may be continued) there may be 1,000l. more. I have nothing to object to Col. Hunter being satisfied thereout in consideration of his sufferings and great zeal he continues to express in her Majesty's service.

Jan. 11. Same to same from same on the petition of Robert Armstrong, ut supra, Calendar of Treasury Books, Vol. XXIII, p. 477, said petition setting forth that being appointed Collector of Customs in New Hampshire and desiring forthwith to go thither he prays a deputation to be Surveyor of the Woods in those parts for preventing the great waste and destruction of her Majesty's timber continually made there.
Hereon Blathwayt reports: "I do well know and have often conversed with the said Robert Armstrong as having for a considerable time been concerned for the Proprietor of that Province in the contest with those inhabitants, and am satisfied that he is well acquainted with that Province and with the nature of those woods, which abound in masts for the Royal Navy and other materials for shipping and I believe him very capable of doing her Majesty good service there." But some time since her Majesty constituted Mr. Bridger as Surveyor of all her Woods upon the continent of America, with power of appointing deputies as he shall find requisite. It will not be for her Majesty's service to appoint Armstrong as Deputy Surveyor of the Woods in any other manner. But as the attendance of Bridger will be wanting in New York on the arrival of Col. Hunter there for instructing the people in these parts in making pitch and tar, your Lordships may write to Bridger that it seems requisite that (the said Armstrong being now appointed Collector of her Majesty's Customs in New Hampshire) the said Bridger should empower him as his deputy to take care of the woods there in his absence and to advise a salary: unless he have sufficient reason to the contrary. Treasury reference to the Victualling Commissioners of the petition of Richard Metcalfe, mariner, shewing that one Collins contracted with the said Commissioners to deliver a quantity of provisions for the inhabitants of Nevis and St. Christopher; that Collins had two ships in Ireland under petitioner's directions and ordered him [petitioner] to provide the said provisions and to draw a bill on Collins which he promised to pay when due: but Collins refuses to pay said bill and his [petitioner's] credit is so low that none of the parties to whom the [proceeds of] said "bills are" due will accept of his bond for the same: therefore praying that no money or bills be issued from the Victualling Office to said Collins till petitioner have security [from Collins], the certificates of the said provisions being in the name of petitioner. Jan. 19. Same dated same to the Attorney or Solicitor General for a great seal for a grant to John, Duke of Newcastle, viz., to accept the surrender from him of the patent of August 15 last which granted him the licence to make a park in Sherwood Forest, ut supra, Calendar of Treasury Books, Vol. XXIII, pp. 272–4, and to cancel the said grant and in place thereof to grant him licence to make a park of his own lands and hereditaments as follows whether the same be or be not in the forest of Sherwood or the purlieus thereof "for our use and service during our natural life": which park is to contain at least 3,000 acres of his own lands of inheritance in the County of Nottingham and to have the circuit herein set out viz. the fence of the park to begin near the north west corner of Clumber Wood in Butterworth Haggs and from thence to go towards the south leaving part of the said Butterworth Haggs and the town and part of the grounds belonging to the town of Carburton west cross the Clumber river to the Great Road leading from Derby to Retford; and to go thence towards the east leaving Budby Grounds and Thoresby Grounds on the south to the Great Road leading from Nottingham to York by the way of Blythe; and from thence to go towards the north cross the said river leaving part of the grounds belonging to Bothamsall, Normanton and Elsley east till it comes beyond Hardwick Wood, including the said wood within the said intended park; and from thence to go westward leaving Osberton and Worksop Grounds north to the place where the said fence is to begin: and with power to make a riding not exceeding 80 yards wide through the Queen's Wood called Birkland Wood from the west eastward across the riding already made in the said wood and to enlarge the said riding already made so as to make the same 80 yards wide also: and to grant to the said Duke all the timber (and the offal thereof) that shall be felled for the making of the said new riding and for enlarging the said riding already made; in consideration that the said Duke is to enclose the said park with a fence at his own cost: and further to grant to the said Duke 1,000l. per an. as from 1708 Sept. 29 for the Queen's life in consideration of his enclosing such of his own lands as shall be in the said park and of his bearing all the charges of repairing the lodges, deer barns, and of hay for the deer in the said park in the forest of Sherwood and the wages of keepers &c.: all provided that the ancient fee of 9l. per an. which hath been anciently collected for and paid to the keepers of said forest by the Sheriff of the County of Nottingham shall be collected and paid as the same hath usually been for and to the said keepers: and the said Duke doth hereby covenant that he will at the direction of the Lord Treasurer grant and demise to trustees for the Queen's use the said intended park with the lodges, houses and appurtenances thereof for 99 years terminable on the Queen's natural life. And the Queen hereby agrees that from her decease he shall have the lands again whereof such park shall be made as in his present estate, with the stock of deer therein and the fences and buildings belonging thereto, with all his rights therein under the grant made by Charles II. to William, late Duke of Newcastle, dated 1655 Dec. 18 touching the manor of Mansfield: further that on failure of payment of the said 1,000l. per an. as above by the Crown the said present Duke shall be at liberty to resume the said park and lodges &c.: and further hereby the said Duke is to have and enjoy the office of Ranger of the said park after the making thereof and the herbage and pannage of the same, leaving sufficient for the pasturage and sustenance of the deer: and also to have free chase and free warren within the premises and to take so many of the deer of Sherwood Forest as he shall think fit for stocking the said park. Jan. 19. Royal warrant to the Attorney General to acknowledge satisfaction upon record of the judgment against Jerome Oliver on a seizure of plate shipped by him at Falmouth on the Alliance packet boat for Lisbon in Portugal and seized "in March 1704" by Francis Jones, then agent for the Pacquets at Falmouth, as forfeited by the Act 7 and 8 Wm. III, c. 19, same comprising six chests of wrought plate appraised at 717l. but shipped as six chests of arms: the Barons of the Exchequer having given judgment for the said Jones, the seizer, after two years' proceedings during which it was argued in every term and the said judgment was affirmed on a writ of error in the Exchequer Chamber but the said Oliver and his bail have now brought a writ of error before the House of Peers and the cause stands appointed to be heard the first day after the recess: the said Jones having expended over 1,200l. in the costs of said proceedings and the sureties of said Oliver (who are tradesmen) having proposed terms of compromise to wit 1,100l. in instalments "and the said Oliver being himself already in prison and the petitioner [Jones] doubting it may be worse for him if he proceed to extremity against the bail and doth not accept the terms offered which he cannot do without leave": the said Jones is first to certify that Oliver's security have come to the said agreement or compromise with him. Report by same to the Queen on the report from Sir Charles Hedges, Judge of the High Court of Admiralty, upon the petition of Sir William Windham bart., Vice Admiral of the County of Somerset, and upon the petition of Capt. Clerk; the said Windham's petition praying that a French merchant ship which was driven into Bristol Channel and is since seized at Minehead and condemned as a perquisite of Admiralty may be granted to him to enable him to reward the Captain and officers concerned [in the taking of said ship]; and the petition of said Clarke being on behalf of himself and his officers and mariners alleging that they were the only means of the said ship being taken and therefore praying to be allowed same at the appraised value of 1,466l.
Hereon the Lord Treasurer reports that it has been usual in like cases (in regard of the difference between appraisements and actually realized sale price) to direct a sale and afterwards to give warrant to apply the proceeds. I therefore propose that Windham be directed to sell said ship to your Majesty's best advantage and to pay the costs of seizing and condemning and that out of the remainder such reward as your Majesty think fit be given to said Windham and to Captain Clarke's mate Beving and the eight men with him who appear to have been the chief cause of the capture. I have yours of the 3rd inst. relating to the composition offered by the merchants for the wines lately brought from Scotland. In regard of the uncertain event of trials I have no objection "but then it must be for the most they can possibly be brought to and by no means less than two thirds the appraised value. As to the clamours your Lordship is apprehensive of from those who have one eye upon an excrescent Equivalent, I believe there will be time enough afterwards to turn it so as to give them the like satisfaction as if the money to be received [by the Crown] on such composition was paid for Duty and not by way of fine."
