July 18. Allowance by Treasurer Godolphin of the 1709 June 24 quarter's salary bill of the Customs for London port (total 6,963l. 16s. 6d.) and the outports (total 9,487l. 18s. 9d.) Out Letters (Customs) XV, p. 178.
Warrant by same to the Customs Commissioners to depute Col. Robert Quarry as Surveyor and Inspector of the Southern Survey on the Continent of America containing both Carolinas, Virginia, Maryland and Pennsylvania as also Jamaica and the Bahama Islands at the established salary which he enjoys, which is 20s. a day; the said Commissioners having had long experience of his diligence, good services and integrity.
Maurice Birchfeild to be a like Surveyor and Inspector of the Northern Survey of said Continent, containing East and West Jersey, New York, Connecticut, Rhode Island, New England, New Hampshire and Newfoundland (instead of Robert Armstrong presented by the said Commissioners) at the like salary of 20s. a day: the said Birchfeild being recommended to the Lord Treasurer as a fit person.
Nathaniel Shannon (at present Naval Officer at Boston) to be collector and surveyor at Piscataway: at 100l. per an.
Nathaniel Kay (one of the riding officers on the borders between England and Scotland) to be collector and surveyor at Rhode Island at 100l. per an. (whereby his present salary of 60l. per an. will be saved to the Queen).
Charles Blechynden (at present one of the quaymen in London port and has been otherwise employed in the Custom House London for about 20 years past) as collector and surveyor of Salem and Marblehead (whereby his quayman's place of 54l. 9s. 0d. per an. will be saved to the Queen).
Prefixing: undated report by said Commissioners to the Lord Treasurer. We have of late received several informations of divers frauds committed and of the illegal trade carried on in her Majesty's Colonies and Plantations on the Continent of America to the great prejudice and loss of the trade and revenue of this kingdom. We are of opinion it is impossible for one person to survey and inspect the several officers established there and to keep them to a due performance of their duties, the said Continent being upwards of 1,200 miles in length. We advise dividing the Continent into two Surveys, Southern and Northern as above and we recommend Col. Quarry for the Southern Survey and Robert Armestrong for the Northern Survey. We have received from said Armestrong a very full and particular account of the condition and situation of the Northern Governments which is hereto annexed [missing] he having been formerly Secretary to the late Lord Bellomont when Governor of New York and New England and also Naval Officer under his lordship for New Hampshire in New England and resided in those parts a considerable time and appears a person very fitly qualified, as being knowing in the Acts of Trade and Navigation as well as the laws and constitutions of those parts.
Since the dismission of Mr. Jahleel Brenton, the late collector of Boston who did by virtue of his patent appoint deputies under him at several other ports in New England &c. who were also of course dismissed, no collectors have been established there except Mr. John Jekyll the present collector at Boston. We have lately received several informations from Col. Quarry and from the said Mr. Armstrong and from merchants residing here that for want of officers in New England illegal trade is there carried on without obstruction. We find there is an absolute necessity of appointing more officers in those parts not only to prevent such illegal trade but for putting in execution the Act of 3 and 4 Anne, c. 9, for encouraging the importation of naval stores from the Plantations and other laws relating to trade and navigation there. We therefore propose Shannon, Kay and Blechyden for places as above. Out Letters (Customs) XV, pp. 179–82.
July 18. Warrant by Treasurer Godolphin to the Customs Commissioners to permit the export to Portugal or any other foreign market of prize Bank fish and train oil taken in the French prize called the Marquis de la Bretack lying in Plymouth port which goods were bought from the captors' agents by James Cock and Company merchants of Plymouth.
Prefixing: report by said Commissioners. The fish is in the same case as that in our report of Nov. 23 last on the petition of Capt. John Paul supra, Calendar of Treasury Books, Vol. XXII, p. 456. Ibid., pp. 182–3.
Treasury reference to same of the petition of Nathaniell Smith, Comptroller of Poole port, shewing that said Commissioners are willing to make him a collector to enable him to subsist his family as his present employment is small: therefore praying leave to resign his present post to his son, Nathaniel Smith, who has been bred to business. Reference Book VIII, p. 364.
Same to Mr. Baker and Mr. Gosling of the petition of John Flavell shewing that he lost 18l. 8s. 3d. by a parcel of verdigreece bought from the late Prizes Commissioners which was short weight 140 pound; and further lost 300l. by overpayment of Customs on tobacco bought out of the Spanish galleon Tauro by reason that her Majesty's Declaration about Prize goods came out after the sale and lowered the market; and further lost 47l. 1s. 6d. in prize oil bought for Tho. Tomkins; that during the war he bought above 70,000l. from the Prizes Commissioners, great part thereof for the said Tomkins and upon his failing an extent came out against the petitioner for 8,835l. 3s. 4d. which was his ruin; that upon the said extent 240l. was levied though on the balance of the account there was due but 150l. 15s. 0d.: therefore prays relief. Same to the Navy Commissioners of the petition of Capt. James Plunket in the Marquess of Carmarthen's Regiment of Marines, praying payment of 156l. 13s. 4d. due to him for pay. Ibid.
Warrant by Treasurer Godolphin to Robert Walpole, Secretary at War, to prepare a royal warrant for an allowance or pay of 7s. 6d. a day to Capt. Timothy Daly to commence from 1709 May 24 and to continue during his being a prisoner.
Prefixing: report by J. Brydges and R. Walpole on said Daly's petition ut supra, p. 201. By direction of Major Gen. Shrimpton he was paid 7s. 6d. a day as a prisoner (which is the subsistence of a Capt. of Foot and three servants upon the English Establishment) from the 24th April 1707 to the 24 May 1709 out of moneys remitted abroad for prisoners of war. July 18. Same by same to same to prepare a royal warrant for making the like allowance for the future for the cure and lodging of every disabled soldier brought from the Low Countries to Harwich as is made for disabled soldiers brought from Portugal to Falmouth; as likewise 5s. for conduct money for each man from Harwich to Bow being 60 miles at a penny a mile.
Prefixing: report by said Walpole on the petition of the Justices assembled at the General Quarter Sessions at Chelmsford Jan. 11 last who set forth that the Constables on the road between Harwich and Bow have been at extraordinary charges to the value of 1,000l. since the commencement of this war, on account of relieving and conveying with horses, carts and waggons from Harwich to Bow the many poor, sick, lame, maimed and disabled soldiers that have been weekly brought over in the packet boats from Holland, notwithstanding the said Justices have ordered double, afterwards treble, and for about five years last past quadruple quarterage to be raised and paid throughout the county of Essex, which hath caused complaints from Hundreds and other parts distant from the Harwich Road as being unreasonable and contrary to law and very likely to create several law suits.
Hereon the said Walpole reports that there is no provision made for conveying disabled soldiers from Harwich to London but there is a settled allowance for every disabled soldier brought from Portugal to Falmouth viz. 6s. 8d. for cure, 12d. per night for lodging till cured: and 20s. for conduct money computed at a penny a mile: the care of which sick and infirm soldiers is committed to a chirurgeon residing at Falmouth who is agent to the Commissioners for Sick and Wounded Seamen. (The details include 35l. for the rent of the Office in Villars Street, for payment of captors from Lady day 1708 to Lady day 1709 when that Office was discontinued and the payments made in York Buildings.) J. Taylour (in the absence of Mr. Lowndes) to the Navy Treasurer. The Lord Treasurer directs that the flag pay of the Marquess of Carmarthen for the three quarters ended June 25 last be paid to him notwithstanding the stop which was put thereto on account of money owing by him to George and Joseph Newells who have failed and are greatly indebted to the Crown. But you are to take care that the Marquess's pay which shall become due for the future shall be stopped towards securing to the Crown so much as he owed the said Newells. Disposition Book XX, p. 22. We have computed the salaries of the Lords of Session from 25 Sept. 1708 as her Majesty's letter which increases their salary intimates that their addition shall commence from 1708 March 25 and in pursuance thereof they have received two quarters' salaries. We have computed the salary of Robert Stewart of Tillicultry to the date of dismission and of Dougall Stewart of Blairhall from the date of commission which they esteem a hardship, supposing one of them to be entitled to the whole salary. We do not conceive our power to extend so far as to allow them the same.
In the Establishment transmitted to us Sir David Dalrymple's and Mr. Carmichael's allowance as Solicitors are omitted: and the salary of the doorkeepers and messenger of Exchequer are directed to be computed from 25 March 1709 although they have received nothing from 1 May 1708.
