day to Vincent Chaban who is appointed by Henry Lord Walden
(Commissary General of the Forces) as his deputy for mustering the
Forces going upon the present Expedition under Richard, Earl

Treasury reference to the Customs Commissioners of the petition
of Thomas Newton of Boston in New England shewing that he has
been a resident there near 20 years and has served the Crown in
several ports as Deputy Judge of the Admiralty and solicitor and is
well acquainted with the method of the Customs there and well
affected to the Government : therefore praying for the place of
Jahleel Brenton collector, surveyor and searcher at Boston, who
for some years has resided in the Colony of Rhode Island about 60
miles distant from Boston and employs one to execute his employment
that acts as a merchant, which is improper. Reference Book

Report to Treasurer Godolphin by William Blathwayt, Auditor
of the Plantations, on the petition of Leonard Compere, Receiver
General of her Majesty's Revenue in Jamaica, ut supra p. 636, desiring
to be exempt from the rule lately established by the Lord Treasurer
for officers of the revenue in America to give security in England as
well as in those parts where their offices are executed.
Hereon Blathwayt reports that the said Compere and his uncle
Thomas Martyn Esq. have for above 30 years held the said office
and discharged the duty thereof without complaint. The said
Compere is under a security of 5000l. which he has given in Jamaica
pursuant to the direction of an Act of Assembly there "for the well
and true accompting as often as he shall be thereto required by the
Governor and Council or the Assembly of that island." In 1692 the
said Compere sustained a loss of 11,000l. by the earthquake which
then happened and by the French invasion there the year following
which loss and the weight of the above security render him (as he
alleges) altogether incapable of procuring securities here in England.
For your Lordship's satisfaction he offers to make oath as to the
sufficiency of his security given as aforesaid in Jamaica and has
undertaken to procure a certificate from the Governor there of the
ability of the said securities. He further alleges that the whole
revenue is appropriated to the support of the Government of Jamaica
as appears by the several Acts [of Assembly there] and that the
demands thereof are so constant upon him as never at any time to
leave any sum in the hands of his deputy equal to the security given :
for which reason he hopes your Lordship will not require from him
any further security.
Upon the strictest enquiry into the condition of the said patentee
I do not find that he is able to procure any further security in
England, but depends upon the credit and value of his place in
Jamaica, whereby his deputy has been encouraged to give the
security there as directed by the Act of Assembly in that island.
"However, I am humbly of opinion that the same security in Jamaica
may be ordered to be extended not only to his accompting before
the Governor and Council or the Assembly of that island but also
to her Majesty according to the course of the Exchequer in England."

Plantations as follows : Col. Quarry, Surveyor General of Customs
on the Continent in America having by a late memorial acquainted
the Customs Commissioners that he had removed William Dyre
who by appointment of Mr. Randolph (the former Surveyor General
there) acted from May 1702 to May 1704 as riding surveyor at Bahama
and Sassafras, the head of Chesapeake Bay in the Province of
Maryland : and had appointed him to be riding surveyor of Delaware
Bay loco Mr. Rowe deceased "where tis absolutely necessary that
an officer should be continued" : and Thomas Wood to be riding
surveyor at Bahama and Sassafras in place of the said Dyre.
Likewise Capt. Thomas Seymour (who by appointment of said
Quarry has served at Bahama and Sassafras from 10 May 1704 under
a good character) to be collector at North Potomac in the province
of Maryland loco John Dansey who has relinquished the service.
Edward Price (who has long served as surveyor at Wiccomoco and
Munni in the Province of Maryland with a good character) as collector
at Pocomoke in the said province loco Jeff. Roby deceased.
Robert Snead as surveyor at Cape Charles in Virginia loco John
Washburne who has quitted the service (the said Snead having been
thereto appointed in Oct. 1703 by the Governor of Virginia and
said Quarry) with instructions to survey all the eastern shore of
Virginia and Maryland to the sea board, having many inlets where
vessels carried away tobacco without entry or clearing.

Province of Maryland) to be settled there at 35l. per an. Ibid.,

Same by same to the Attorney General for a noli prosequi to the
information against elephants teeth and citron consigned to William
Brooke, merchant in London, by commission from a subject of
Portugal and seized in the Thames by Mr. Robertson a Customs officer
as being the product of that part of the West Indies belonging to the
King of Portugal ; the said Brooke having petitioned showing that
the said King being in the Grand Alliance for the good of Europe
his subjects deserve encouragement the rather because during the
war, trade is precarious and Portugal is the chiefest place for the
reception of our woollen manufacture.

The goods were reported by the ship's master as the goods of an
alien before the seizure and therefore as they were so brought from
a proper port and in a ship duly qualified and as the importation of
them by an alien seems to have been through ignorance and surprise,
without purpose of breaking the law, the proprietor may deserve
