Paine, Christopher Metcalfe and Francis Stephens who in Oct. 1704 became bail at the Old Bailey for Joseph Gifford, William Martin and Thomas Mathews, prosecuted by James Baker by indictment for saying mass, being Popish priests, who did not appear at the next Session but agreed with the prosecutor Baker (who prosecuted only to get the 300l. reward under the Act of 11 Wm. III c. 4. which was a great misdemeanour in him).

Treasury reference to the Customs Commissioners of the petition of John Angell gent shewing that Charles II granted to his late father Justinian Angell liberty to erect a lighthouse at Spurn Head at a rent of 10l. per an. with full power to demand of every English ship passing thereby a halfpenny per ton and of all foreigners a penny per ton, commanding all Custom House officers not to clear any ship liable to said payment without a note under the hand of said Justinian or his deputy : that the premises are descended to petitioner ; but the masters of ships both English and foreign refuse to pay the said Duty and the Customs officers suffer the same to pass notwithstanding non payment thereof, not having the Lord Treasurer's order to the contrary : therefore praying an order to the Customs Commissioners to examine into same.
