Report dated Whitehall from John Povey to the Treasury Lords on Col. Benjamin Fletcher's petition referred ut supra p. 313. The petitioner was appointed Governor in Chief of New York in 1690 with power to dispose of the public revenues there for the public services by his warrant with the advice of the Council of that Province. He continued in that Government till 2 April 1698 when he was recalled by letter from the Duke of Shrewsbury, then Principal Secretary of State, acquainting him that the same was not done out of any dissatisfaction his Majesty had in him but in favour of the Earl of Bellomont whom his Majesty appointed Governor in Chief of New England and New York. He was succeeded by said Earl in that Government and thereupon did obtain from the Council of New York a certificate of his behaviour in the Government and particularly that all payments during his Government had been made by warrants passed in Council and that all accompts of incident charges had been examined in Council before the issuing the warrants.
Nevertheless the Earl of Bellomont receiving informations upon his arrival of mismanagements in the revenue there thought fit to oblige the petitioner at his coming from thence to procure security in 10,000l. sterling to be given by divers of the principal traders in New York that he should answer to the King for what public money may have been converted to his own use or otherwise disposed of by him contrary to his Majesty's commission and Instructions.
Mr. Chidleigh Brook, Collector and Receiver of all his Majesty's revenues in New York, did according to directions from England transmit his accounts of the public Revenue quarterly to 8 June 1698 when he was suspended from his office by the Earl of Bellomont, the said accounts having been first credited in New York by Mr. Courtland, Deputy Auditior of the publid Accounts, and afterwards examined and passed by the Council there [but were referred back to Lord Bellmont 1 July, 1699. Treasury Calendar XIV, 407–8], In pursuance of your [the Treasury] Lordships' order in 1699 [19 Sept. 1699. Treasury Calendar XV, 164] I re-examined all the said accounts with the vouchers produced by Fletcher and I laid befor you my objections thereto [26 Sept. 1699. Ibid., 240–2]. A copy of the said objections and of the said accoumpts was by yousr order sent back to New York [21 Oct. 1699. Ibid., 185] to be further examined there at the instance of the Earl of Bellomont and are now depending there.
The petitioner is likewise accoumptable for the advantage accuring to his Majesty of 30 per cent. [by exchange] amounting to 3905l. 9s. 7d. made by the remittance to New York of money received from the Paymaster General of the Forces London, upon account of the Company of Foot at New York during the peititoner's government; an account whereof the petitioner alleges is now lying before the said Paymaster General of the Forces.
I humbly offer that Visct. Cornbury, the present Governor of New York, may be ordered to examine the said accompts of the public revenue of the Province in order to a final determination thereof and to return his objections thereto and opinion thereon: whereupon your Lordships may give directions as to you may seem fit. Dec. 3. Establishment for the Treasurer of the Chamber's Office: to be payable as from 1700 Xmas. (total 22338l. 4s. 8d.) Report dated Whitehall from John Povey to the Treasury Lords on the petition of Oliver Hill as referred the King to the Treasury and by the Treasury to said Povey July 29 last supra p. 328. By indenture dated 1682 Aug. 24 the late King James, then Duke of York, did bargain, sell and confirm to William Penn and his heirs for ever all the lands lying upon Delaware River from 12 miles south of the town of Newcastle to the Whorekills otherwise called Cape Hinlopen under covenants ut supra p. 235. As it did not appear that Penn had made any accompt to his Majesty in accordance with said covenants a Treasury letter was sent to him in March last ut ibid requiring such an accompt: which letter was sent by Mr. Blathwayte to Mr. Depeyster, his Deputy Auditor in New York, to be by him delivered to Mr. Penn and for Depeyster thereupon to demand such accompt. The petitioner alleges that the profits in question consist of a bushel of wheat for every hundred acres of the premises set to lease by Mr. Penn (which amount to 450,000 acres). But in regard very little of the said lands were set for the first years and that all the said acres have not been set till of late he computes the whole profits made by Mr. Penn to be about 24,000 bushels of wheat, which at the rate of 5s. per bushel (being as the petitioner alleges the current price there) amount to 6000l.; whereof the moiety accruing to his Majesty by virtue of the abovesaid covenants amounts to 3000l. Out of this the petitioner prays one third for his discovery and that out of the remaining two thirds he may have such compensation for his services, disbursements and damages as to his Majesty shall seem meet.
I conceive the petitioner cannot claim any part of the said moiety as a discovery but I have no objections to your Lordships compensating him for services, disbursements and damages out of what may accrue upon the return of Mr. Penn's account of the said moiety.
