supra pp. 288–9 concerning paying back the King's share of a seizure

Customs Commissioners have reported that after the goods were
seized and prosecuted as French the entry was withdrawn and the
King's books not charged with the Customs thereon so that if the
King repays the Crown's share of the forfeiture he loses the Customs
which otherwise he would have had at the importation and if the
proprietor should be obliged to pay the Customs which amount to
185l. he [the proprietor] will obtain nothing by the intended grant of the
King's part of the forfeiture which after the charge of prosecution deducted is but 186l. 2s. 0d. Hereon the Treasury Lords decided that Ward
may have his choice either to pay the duty or submit to the forfeiture
upon which he chose to pay the Customs. Accordingly the order
as above is to be executed on his so paying the Customs. Ibid. |
