Treasury warrant to same to discharge the seizure of the ship Little William, Richard Daniell master, from Spain and to free her lading from aliens' duties: it appearing from the petition of Ambrose Upton, merchant, that two of the seamen that came in said ship were there for no other consideration than their provisions, wherefor she was seized as not qualified [insufficiently manned] according to law, yet in truth they “were [two of the King's subjects who] paid for their passage, but received gratis their meat and drink for their assistance to the ship, and ought to be accounted in the number of the ship's company,” having been taken by the French and set on shore in Spain and pressed into their Majesties' service since their coming hither “and if the bringing home their Majesties' subjects puts such an inconvenience on trade it will be an obstruction for the future, his ship not being able to come home without those hands”; the ship's complement consisting of the master, nine English and three Scots when he came into Harwich, but five were pressed away there before his arrival in the Thames: and of the said nine English two were the said passengers. Same to the Attorney General to enter a noli prosequi to the King's share of the composition made by Robert Bristow and Timothy Poston for goods (pepper) shipped by them on drawback debenture 1691, July 3, on the Jane, John Bean master, for Bilboa, and sold by them to John Lambert of London, merchant, reserving to themselves half the drawback debenture, but which was re-landed at Dover by the ship springing a leak at sea and being forced back into Dover, and thence brought to London by said Lambert without their knowledge or consent, whereupon same was seized by Henry Canby after Poston had endeavoured to obtain debentures in common form and might in probability so have done if the officer had not discovered that the goods had been returned: the Customs Commissioners having reported hereon that the officer deserved encouragement for his discovery, which had prevented the payment of the drawback, and that this case is a plain instance of a common practice which gave the occasion of a clause inserted in a Bill lately passed [? 1 James II, c. 4, § 4], and is no more than a clever explanation [? evasion] of the law as it stood before: but that in this case Bristow has the character of a very fair trader and deserves favourable consideration as far as concerns the King's share of the forfeiture. Treasury reference to the Excise Commissioners of the petition of Thomas Combs, collector of Excise, co. Kent, shewing that in Dec., 1691, he delivered over several bags of Excise money collected at Deptford etc. to Thomas Shrubb, Surveyor of Excise, and went with him by water to the Tower Stairs, whence it was carried to the Excise Office in a coach, but coming to tell out the money a bag containing 68l. 3s. 6d. was missing, which is supposed to be lost out of the coach, being in the dark: therefore praying to be remitted same. Treasury warrant to the Receipt to make forth a duplicate for Peter Parker of a lost order, number 968, dated 1691, April 30, for 500l. in the name of Edward Russell [Treasurer of the Navy] and registered on the two thirds of the Additional Excise, which order was assigned to Peter Parker by Anthony Stephens as Attorney [Cashier] to said Russell. April 24. Treasury warrant to the Attorney General to enter a noli prosequi to the informations against John Addis and Nath. Dowrish [Dowdridg] of Plymouth, merchants, and Edmund Buckeridge for retailing some French wines and against Dowrish for suffering French wines and prunes to be embezzled and not destroyed according to the Act; they absolutely denying the offences, and the prosecutor, John Ford, not being able to rely on his witnesses; and the Mayor etc. having testified to the good credit and loyalty of the accused: the matter being that in the end of 1690 two ships, the Nostra Seigniora de penna de Francia and the St. Symon of Bordeaux were brought in and condemned as prize at Plymouth and in May or June, 1691, their lading of wines and prunes were landed by said Buckeridge and Samuell Laver, both officers of the Prizes at Plymouth, and some thereof was put in the cellars of said Dowrish, who was Treasurer to the Sub-Commissioners of Prizes, and some other in the cellar of William Durston of Plymouth, and some thereof were sold by said Lave [Laver] and some by Nicholas Kendall (who was employed by Richard Carew, esq., since deceased, then one of the Sub-Commissioners of the Prizes) to John Cooke, distiller of Plymouth, at 55s. the ton, and others were sold by Mr. Carew to John Munnyon of Plymouth, distiller. Henry Guy to the Auditor of the Receipt. It is now agreed that the orders of loan for the 31, 616l. 11s.d. issued to the Earl of Ranelagh, ut supra, p. 124, shall be registered on the Additional Impositions as follows, viz. 540l. thereof next after 61,460l. thereon; 9,000l. next after 191,000l. thereon; with interest from the dates of the order of loan for these sums; and the remaining 9,000l., 11,038l. 5s. 6d. and 11,038l. 5s.d., ut supra, ibid. Same to Mr. Blathwaite, enclosing for the King's pleasure thereon a draft warrant [missing] for allowing several sums to Col. Erle upon account of (arrears of) his Regiment. My Lords think this draft conformable to the resolutions which the King took at Kensington before his departure for Holland, but desire to be satisfied in this. They find that there are pretensions of this nature to be made for most of the Regiments (at least for many) that served in Ireland, “which their Lordships will not presume to judge of by themselves, but will in a short time cause an abstract to be made of them and send the same over to you to receive his Majesty's pleasure thereupon.” Out Letters (General) XIV, p. 54.

Treasury warrant to the Customs Commissioners to discharge Walter Middleton, collector of Milford port, of the sum of 250l. in account, being part of a bill which he despatched 1688, Sept. 15, to Richard Kent, then Customs Cashier, of which only 200l. was paid by reason of the failure of the drover who received the money payable upon his bill payable in London, and the said bill remained in Kent's hands from Sept. till the following Feb., so that Middleton had not timely notice of the drover's non-compliance with this bill, and there being no other means of remitting the King's moneys from Milford but by paying the same into the hands of the drovers in the country and taking their bills on London: and Middleton being esteemed a good officer.
