Oct. 1 Warrant from Treasurer Southampton to the Customs Farmers to discharge a seizure of some calf-skins shipped by William Kenedy on board the "Francis," David Robyn master, for Dieppe. Early Entry Book X. p. 132.
Prefixing:—Note of said Kenedy's petition and report thereon from the Customs Farmers.
Oct. 2 Lord Treasurer Southampton to the Farmers of the Customs. "You are so well acquainted with the nature of that bounty which His Majesty conferred on those gent that made some agreement about the addiconall duty and some propositions about the whole Customes that I need give you no further information but that His Majesty assured them it should bee paid speedily unto them and out of the first monies that came in by the advance of you that are now his farmers of his Customs. The Privy Seal is passed for authorising the payment of the same and I intend forthwith to give an order for same to the Exchequer. In the mean time it seemes a great accomodacon to those gent (untill the tally may bee struck, which regularly cannot be untill you have past your grant) that you make them such payment as you can furnish them at present with. And upon their discharge when you are in a capacity to have tallies struck on you I shall give order accordingly." Ibid, III. p. 454.
Same to same to furnish Sir Theophilus Gilby, Governor of Chester Castle, with letters to some of the Customs officers near Chester, where he may be sure to receive the 240l. 2s. 0d. ordered by warrant as below struck upon the Customs for three months' pay to said garrison: he being now hastening upon his return to his command there. Warrant from Treasurer Southampton to the Receipt for tallies to be struck on the second six months of the eighteen months' assessment in divers (Welsh) Counties, detailed, for 2,000l. for the Royal Watermen, and 4,441l. 2s 6d. for the Guards, to whom a greater assignment shall be made as soon as a new Privy Seal is passed. Oct. 3 Money warrant, dormant, for 30l. per an. to Sir George Barker, being fee as underkeeper of His Majesty's house and palace of Richmond, he being thereto appointed, loco Nicholas Bird, by letters patent of 1642, July 3. Ibid, p. 498.
Oct. 6 Warrant from Treasurer Southampton to Thomas Veele, William Clayton, Nich. Davenant and William Doelittle to repair to the several houses below and seize certain prohibited French commodities lately imported, and now lodged there, being stolen in without custom being paid, viz., a house in Frogmorton Street, in St. Bennet Fink parish; a house in Cheapside, in St. Leonard, Foster Lane; a house in Bishopsgate Street, in St. Martin's Outchurch; a house in Holyday Yard; several houses in St. Martin's le Grand; a house in Swithin Lane; a house in Sherborne Lane; and in Duke Humphries, near Puddle Dock: the possessors of all which houses are merchants and foreigners except one, who is a Scotohman. Oct.6 Treasurer Southampton's order that Godfry Richards, of London, stationer, and none other do print the table of fees intituled an "order of the Commons in Parliament establishing and confirming fees and allowances to the officers of the Customs and subsidies; for the better directions and satisfaction of merchants, officers, masters of ships and others." Early Entry Book X, p. 137.
Warrant from same to the Customs Farmers for a true certificate of all debentures whereby the merchants demand repayment of half duty for any time within a twelvemonth before the Customs and subsidies were granted to His Majesty, keeping distinct from these any others before that time that seem to be excluded by the Act of Tunnage and Poundage. Also for a certificate likewise of the pretences to the Algier duty. All in view of the representation made to the King by divers merchants concerning the non-repayment to them of the above [for the period] before the King received the Customs, the Customs Commissioners or Farmers having demurred thereto in respect the subsidy was not the same as was received by others. concluding thereby that the Customs which were given to His Majesty were not liable to be repaid. Treasurer Southampton to Sir George Carteret, Treasurer of the Navy, concerning employing the imprest for stores in paying off incoming ships, according to the account thereof given in to the Treasury by said Carteret. viz., 73,395l. for ships newly come home, paid off in part and sent to sea again, and of ships wholly paid off; and 92.051l. for ships to be paid off in harbour and others now called in from sea; making in all (with 6,000l. of bills of exchange drawn on the Navy Treasurer) 172,446l., which the said Navy Treasurer has declared cannot be met out of any previous assignments for wages, and can only be met out of the assignments for stores. Therefore hereby authorises him to use those assignments for this service. "And whereas His Royal Highness [the Duke of York] was pleased in a time of necessity, of his owne private money to furnish towards the payment of some shipps then come in ... 9,000l. or thereabouts for which you received assignments but such as will not be paid [in] time enough to reimburse His Highness suitable to his occasions," therefore likewise orders repayment of this item out of the like assignment for stores as above. Oct.8 Sir Philip Warwick to the Commissioners of Excise forwarding a warrant as below, same having been only signed by Lord Ashley, as Treasurer Southampton is indisposed at this present. "I am to recomend it to you as if it were signed by both. If you returne it to me after you have put it in some course I'll get it signed." Ibid, XI. p. 159.
Prefixing:—Said warrant to said Commissioners to permit Sir Jo. Robinson, Francis Sone, Jo. Ryves, Richard Wescomb and Jo. Woder, merchants (who have agreed for the farm of the whole Excise of London, Westminster, Middlesex and Surrey at a considerable advance of rent over what it hath hitherto yielded to His Majesty), or such as they shall appoint, to have the free perusal and view of all such books, entries and returns as are necessary to evidence the true and certain product of the said Excise from 1660, Dec. 25, to 1661, Dec. 25, with power to take such extracts therefrom as they think fit: and to that end that there may be a convenient room assigned them where they may at any time prosecute the stating of the said accounts. The Excise Commissioners to nominate certain expert accomptants to join in the said accompts with said farmers, and return same to the Treasury jointly subscribed.
[?] Warrant from Treasurer Southampton and Lord Ashley for a commission to Robert Butts, William Stockton and Valentine Pearse, Sub-Commissioners of Excise for co. Suffolk, for the management of the Excise of that county on terms as below. Ibid, p. 158.
Prefixing:—Memorial to the Treasury from the Excise Commissioners. The abovesaid Butts and Stockton, present Sub-Commissioners for Suffolk, being recommended by the Justices of Peace as fit persons for the farm of the Excise of said county. refused to come up to the rate fixed. "And it having been since thought fit to continue the same in comission the said persons have appeared before us together with Valentine Pearse and propound to raise within the said county (the hundred of Lothingland, the town of Newmarket and suburbs of Thetford excepted) the summe of 6,500l. per an. for three years from Michaelmas last past, cleere of all charges; to be paid by equal quarterly payments; paying the adjacent farmers all defalcacons and allowances for beere and ale sent spent out of the county as well from Beccles as elsewhere. And moreover the said persons oblige [themselves] to give a true and just accompt of what they shall raise within the place aforesaid, and in case they arise above the summe of 7,222l. they propound to have 5s. per £ for salary and all charges of what they shall raise over and above the said sume of 7,222l. which wee humbly conceave is a good bargaine for His Majesty."

Oct. 14 Warrant from Treasurer Southampton and Lord Ashley to Thomas Warner, a Sergeant-at-Arms, to arrest Charles Black-more, John Stacey, Francis Furrold, Luke Butler, and James Hagger, of Epping, co. Essex, for refusing to permit Henry Osby, of Epping, a gauger under the Sub-Commissioners of Excise for that county, to enter their dwelling-houses to take an account of their brewing. Ibid, p. 160.

Prefixing:—Memorial from the Excise Commissioners. dated the 14th inst. "Sir Thomas Mompesson on the behalf of John Mompesson Esq. having agreed for the farme of Wiltes at 2,800l. per an. hath since, upon the sickness of the said John Mompesson, totally declined the same: and forasmuch as the said county in commission falls much short of the said farme rent," therefore advise the acceptance of the above offer of Estcourt and Davis, considering the great lapse of time since Michaelmas and the loss thereby to the ensuing farmers.
Treasurer Southampton and Lord Ashley to the Mayor and Aldermen of Norwich. The late Sub-Commissioners of Excise of Norfolk, on what ground and pretence we know not, have taken on them to make compositions with brewers, victuallers and others for the Excise that shall grow due after Michaelmas last. The law does not empower this and same is inconsistent with the grants made to the present farmers. All such compositions after Michaelmas last are void. Notice hereof to be given to all concerned, and the present farmers properly assisted in the enjoyment of their farm. Ibid, p. 162.

Warrant from Treasurer Southampton to the Receipt for tallies to be levied in favour of Viscount Brouncker for 1,524l. 5s. 6d. to be allowed by way of defalcation and discharge of so much of his rent of the issues of jurors for default of appearance or contempt, &c., in any of the courts mentioned in the late King's indenture of 1640, April 30, and the letters patent of 1660–1, Jan. 21, in regard it was conceived that the covenants of the first recited indenture did in equity extend to discharge the said Viscount Brouncker of so much of the yearly rent of 1,000l. upon the allowances made by sheriffs upon their accompts for issues of jurors as if the same had been actually paid into the Exchequer; and that the overplus of the said moneys allowed by sheriffs upon their accompts over and above the said yearly rent of 1,000l. for one year ought to have been paid to the said Viscount: the said sum being made up as follows, viz., 1,296l. 16s. 4d. answered to the King on this head by the sheriffs of several counties since 1660, June 24, and 227l. 9s. 2d. answered upon the accompts of several sheriffs for His Majesty's use for the 13th year of his reign over and above the 334l. 18s. 0½d. for issues of jurors paid by several sheriffs into the Receipt for that [the 13th] year ended at Michaelmas: which two said sums of 1,296l. 16s. 4d. and 227l. 9s 2d. not being actually paid into the Exchequer and tallies there stricken for the same were not applied to the payment or discharge of the said yearly rent of 1,000l. incurred since 1660, June 24. "I intend for noe perticuler buisines hereafter to strike tallies. Let therefore my Lord Duke bee paid 461l. 19s. 11d. out of the monies payable by Mr. Napper as Receiver of the Duchy of Cornwall and 500l. by Mr. Scawen, Receiver of Southampton, &c., for the present yeare or the half yeare to end at Lady Day next. And doe you write unto them to pay in this money into the Exchequer as soon as possibly they can." Ibid.

Other colleges in either university pretend not to this exemption. Hope this advertisement of His Majesty's concern herein may work upon their tenderness to give no disturbance to His Majesty's revenue in view of the evil example of practices and disputes being drawn from bodies so observant and dutiful to the King as the universities are. Oct.— Treasurer Southampton and Lord Ashley to Lord Townshend, Lord Lieutenant of Norfolk, and to the Justices of Peace of said county, concerning the undutiful petition from the brewers of Norwich "Had it not been for your lordship's kindness to them wee had taken notice of many very unfitt expressions which have fallen from the petitioners and such as might have tempted us to have laid it before the Lords of His Majesty's Council but that wee believe better of the intencons than the expressions." As to the occasion of the complaint, viz. that the farmers disown the compositions made by the former Sub-Commissioners, are advised by Counsel that the Act gives no authority to the Sub-Commissioners to compound for any certain time, only for a month or a quarter, and no more. None of petitioners have such compositions running beyond Michaelmas last, from which date the farmers begin their lease. Therefore no allowance of composition after Sept. 29 last is to be allowed.
