Reservation to the pope, for collation to him, who is of noble birth and a counsellor of James, king of Scots, and his proctor in the Roman court, of the canonry and prebend called Botari, in Moray, value not exceeding 8l. sterling, about to become void by the promotion, made by the pope, of John, elect of Caithness, and by his consecration, which he is to receive; notwithstanding that he holds the said archdeaconry, which is a non-major non-elective dignity with cure, and a canonry and the prebend called Mortlai in Aberdeen, value altogether not exceeding 28l. sterling. (fn. 2) Mandate (the pope having been informed by Thomas Oculean, clerk, of the diocese of Armagh, that Solomon Ocorra, rector called prebendary of the parish church of St. Yrlatheus the Bishop, Cluoynfechana, in the diocese of Armagh, wont to be governed by canons of Armagh only, has, when excommunicate and publicly proclaimed excommunicate, celebrated and taken part in masses and other divine offices in contempt of the Keys, thereby incurring irregularity, and has committed simony) if Thomas, who, on account of the inordinate favours which Solomon has in the city and diocese of Armagh, has no hope of obtaining justice therein, will accuse Solomon before them, etc. as usual, to summon Solomon, and if they find the above to be true, to deprive him, and in that event to make provision to the said Thomas of a canonry of Armagh and collate and assign to him the said rectory called a prebend, value not exceeding 14 marks sterling. To Thady Macrayth, a canon of Killaloe. Collation etc., as below. His recent petition contained that (after he had been dispensed by papal authority, as the son of an abbot of the order of St. Augustine and an unmarried woman (i) to be promoted to all, even holy orders and hold a benefice even with cure, (ii) having obtained the perpetual vicarage of Cluondagad in the diocese of Killaloe, to receive and hold a canonry and prebend, also of Cluandagad [sic], in Killaloe, and the rectory of the united parish churches of Ocormayc in the said diocese, of which (de quibus) the pope had ordered provision to be made to him, and two other benefices with or without cure, compatible with one another, even if canonries and prebends etc., and to resign them, simply or for exchange, as often as he pleased, and hold instead five other compatible benefices), upon the voidance, by the death at the apostolic see of Odo Mecrayth, and consequent reservation to the pope, of a canonry of Killaloe and the prebend of Inyskayd, Donatus bishop of Killaloe made collation and provision thereof to him by his ordinary authority, under pretext of which he obtained possession and still detains them, taking no fruits therefrom. Seeing that the said collation and provision are without force, and that the said canonry and prebend are still void, as above, the pope hereby makes collation and provision to him thereof, value not exceeding 30 marks sterling, whether void as stated, or by the death of Robert Ykalligy, or in any other way; notwithstanding that he (whom the pope lately dispensed to hold the said vicarage and rectory together for life, and to resign them, simply or for exchange, as often as he pleased, and hold instead two other incompatible benefices, even if one of them were one of the dignities etc. of Killaloe, provided that such incompatible benefices were not without the church and diocese of Killaloe) holds the said vicarage and rectory, the value of each of which does not exceed 10 marks sterling. To the prior of the secular and collegiate church of St. Senan, Inyskaid, in the diocese of Killaloe. Mandate, as below. The recent petition of Donatus Macrayth, clerk, of the diocese of Killaloe, contained that on the voidance of a canonry of Killaloe and the prebend of Clondagad by the resignation of Thady Macrayth to Donatus, bishop of Killaloe, that bishop made collation and provision thereof to the said Donatus Macrayth, who had been dispensed by papal authority, as the son of unmarried parents, to be promoted to all, even holy orders and hold a benefice even with cure, and had obtained no other dispensation in the matter of the said defect; and who under pretext of the said collation and provision obtained possession and still detains them, taking no fruits therefrom. Seeing that the said collation and provision are without force, and that the said canonry and prebend are still void as stated, the pope orders the above prior to collate and assign to Donatus, who is in his twenty-third year, and is on his father's side of noble birth, the said canonry and prebend, value not exceeding 2 marks sterling, the pope hereby specially dispensing him to hold them.
