To the prior of the secular and collegiate church of Ynyskathayg in the diocese of Killaloe. Mandate (the pope having been informed by Donald Ocuynd, a canon of Killaloe, that Cornelius Ocuynd, rector of the parish church of St. Fyndelva in the diocese of Killaloe, has dilapidated the goods of the said church, is a public fornicator, incestuous and adulterer, and is accused of divers other crimes) if Donald, who is a priest and of noble race by both parents, will accuse Cornelius before the above prior as usual etc., to summon Cornelius, and if he find the above to be true, to deprive him, and in that event to collate and assign the said rectory, which is of the patronage of laymen, and is called the rectory of St. Fyndelva, Clandyfernan and Yflathrigy in the half Upper Cantred within the bounds of the parish of Ratthklathmic [sic], and whose value does not exceed 12 marks sterling, to Donald (fn. 2); notwithstanding that he holds a canonry of Killaloe with the prebend of Rathvllathmic, and a canonry of Kilfenora with a prebend called a rectory or portion without cure (simplici), value not exceeding 18 and 1 marks sterling respectively. To Thomas Bromhale, rector of the parish church of Staunton St. Quintin in the diocese of Salisbury, I.U.B. (fn. 3) Dispensation to him (who was formerly dispensed by papal authority, as the son of unmarried parents, to be promoted to all, even holy orders and receive and retain a benefice even with cure, and afterwards to hold two other benefices with or without cure compatible with one another and with the aforesaid, after which, having been so promoted, he obtained the parish church of Fanchirch in the diocese of London, and having resigned it, that of Staunton St. Quintin, the value of which does not exceed 10l.sterling; and who is a chaplain of Thomas, bishop of Bath and Wells) to hold any benefices of any number and kind, compatible with one another and with the said church, and to resign them, simply or for exchange, as often as he pleases; with grant that in future papal and other graces he need not mention the said defect. Indult to him—who holds by papal dispensation the said church and the perpetual vicarage of St. Mary's, Mynster, in the isle of Thanet, (fn. 4) in the diocese of Canterbury, and suffers from gout, colic, strangury, stone, and other grave diseases (fn. 5) —to reside for life in some honest place suitable to him and his health, and to rent, let etc. the fruits etc. of the said benefices to any persons, even laymen. Rehabilitation, at his recent petition containing that he, who is by both parents of a great noble race and was born of a lawful marriage, formerly obtained the rectory of Croma in the diocese of Limerick, which, after holding it for several years without being ordained priest and without dispensation, and taking the fruits, was judicially won from him by another, who is now in possession. Ibid. To the official of Limerick. Mandate (the pope having been informed by Cornelius Ohymayr, a canon of Killaloe, that Alan Olongchy, precentor of Limerick, and Cornelius, also Olongchy, rector of Croma in the diocese of Limerick, are notorious fornicators, have dilapidated the goods of their respective beneficies, and committed other excesses and crimes) if the said Cornelius Ohymayr, whom the pope has this day rehabilitated as in the preceding, will accuse them etc. before the above official as usual, to summon them, and if he find the above to be true, to deprive them, and in that event to collate and assign the said precentorship, which is not elective, and the said rectory, which is of the patronage of laymen, value not exceeding 40 and 20 marks sterling respectively, to Cornelius; notwithstanding that he holds a canonry and prebend of Killaloe, value not exceeding 5 marks sterling. Mandate, at the recent petition of Laurence Ductani, priest, of the diocese of Aberdeen (containing that he promised to pay, and paid, a yearly life pension to the late John Forestarii, priest, in order that he should resign his perpetual vicarage of Longley in the said diocese, a sum of money to Adam Ressolle, priest, in order that he should induce the said John to resign, and a sum of money to Andrew Keth, layman, of the same diocese, the patron, in order that he should consent to the said resignation; and that he further resigned in the said Adam's favour the perpetual vicarage called the pensionaria of the parish church of Machar (Sancti Machorii) in the same diocese; and that after the said John had resigned to Ingram, bishop of Aberdeen, that bishop, perhaps ignorant of the aforesaid, made collation and provision of the said vicarage to Laurence, who under pretext thereof obtained possession, and has unduly detained it for more than one year, but less than two, thereby incurring sentences of excommunication etc. for simony) to absolve him from the said sentences etc., enjoining penance, and dispense him on account of irregularity, and rehabilitate him. To Master Bartholomew de Bonitis, a papal chaplain and auditor-general of the court of causes of the apostolic camera. Mandate as below. The recent petition of Thomas, bishop of Ross, contained that formerly, after the present pope had made provision to him of the said church [above, p. 128], he, alike for the expedition of the letters of his provision as for his other needs, received certain quantities of money as a loan from Cosmas de Medicis and Peter de Pazis, and their fellow merchants, following the Roman court, pledged himself and his goods for repayment, and submitted himself, as is wont in such cases, to the jurisdiction of the above court; that when the said letters and his other affairs had been expedited, he left the said court and went to Scotland, whence he sent by certain ships a number of goods for the payment of the said moneys, but that, on account of obstacles which delayed his obtaining possession of the administration of the said church, and of the plundering and hindering of the said ships, he failed to pay the said moneys within the stipulated time, wherefore the above chaplain and auditor, at the instance of the said merchants, promulgated sentence of excommunication against him, and caused him to be publicly proclaimed excommunicate. At the said petition (adding that the said bishop, when under the said sentence, took part in divine offices, short of the celebration of mass, collated benefices, administered ordinary justice in his church, city and diocese, and exercised other acts and jurisdictions as bishop of Ross, and that with the consent of the said merchants he has been absolved from the said sentence) the pope orders the above auditor, if he find the said absolution and consent to be as alleged, to grant and decree the validity of his said acts, as if he had not been under the said sentences [sic].
