Grant and assignment to him for life (seeing that he has this day freely resigned, at the apostolic see, the rule and administration of the above monastery, by his proctor John de Dowglas, priest, of the diocese of St. Andrews, to William, cardinal priest of St. Martin's in Montibus, who has admitted it; and that the pope has made provision to Richard, [now] abbot thereof), for his maintenance etc., of the fruits etc. of the parish churches of Rosneth and Kilpatrik, in the said diocese of Glasgow, and all lands and possessions lying within the bounds of the said parish of Kilpatrik and belonging to the said monastery. 5 Kal July. St. Peter's, Rome. (f. 30d.)	To the abbot of St. Mary's, Boyle (de Buellio), in the diocese of Elphin, and Cormac Macdonnchaid and Dermit Mageagan, canons of Elphin. Mandate to cause Magonius Macdonnchaid, rector of the rectory of the rural lands inter duos pontes, alias de Mabrise [sic], in the diocese of Elphin (who was lately dispensed by papal authority, as the son of unmarried parents, nobles, related in the double second and the double third degrees of kindred, to be promoted to all, even holy orders and hold a benefice even with cure, after which he was so promoted and obtained the said rectory), to be received as a canon of the Premonstratensian monastery of Holy Trinity de Locque, immediately subject to the Roman church, at present without an abbot, in the said diocese, and to receive his profession. Mandate, recapitulating the preceding, (fn. 2) to make provision [cf. ƒ. 140] to the above Magonius, after he has been received etc. as above, of the above-named monastery, value not exceeding 30 marks sterling, void by the death of Rory Ocarraid, although Maurice Ma[c]donnchayd, a canon of the monastery of S. Angelo de Castellis, of the above order, in the diocese of Policastro, (fn. 3) the son of unmarried parents related in the double fourth degree of kindred and the fourth and fourth and third degrees of affinity, and a perjurer, has unduly detained Holy Trinity for more than a year, but less than two years, under pretext of papal letters which were surreptitious because he stated therein that its fruits etc. do not exceed 14 marks sterling; summoning the said Maurice, decreeing the said letters null, and removing him; whether Holy Trinity be void as stated, or by the resignation of Thady Macdiarmada, [now] a canon thereof, or in any other way. In the event of their making the said provision, they are to grant to Magonius that he may be blessed by any catholic bishop, and to receive thereafter his oath of fealty according to the form enclosed. Dispensation to him—who is the son of a priest religious, professed of the said order, and an unmarried woman, related in the third and fourth degrees of kindred, and is in minor orders—to be appointed to and receive and hold any administrations and offices of the said order, and to be abbot of the said or any other monastery of his order. Kal. April. St. Peter's, Rome. (f. 80.)	To Thomas Obeachnacan, prior of the Augustinian priory of St. Mary, Inchmacnerin (de Insula Macneri), in the diocese of Elphin. Collation and provision to him (who lately, after having made his profession, caused himself, notwithstanding that he was the son of unmarried parents, to be promoted to all, even holy orders (fn. 4) ) of the said priory, which is conventual and elective, has cure of souls, depends on no monastery or other regular place, and whose value does not exceed 25 marks sterling, on whose voidance, as his recent petition contained, by the death of Maurice Macdoncaidh, the convent, perhaps in ignorance of the pope's late reservation of all conventual priories, void and to be void, elected him, then a canon of the said priory, to be prior thereof, which election is null by reason of the said reservation, the priory being still void; whether it be void as stated or by the said Thomas's own free resignation, or be void in any other way. 3 Non. May. St. Peter's, Rome. (f. 89d.)	To the bishop, the dean and the precentor (cantori) of Moray. Mandate as below. The recent petition of John, abbot of the Cistercian monastery of St. Mary, Kynlos, in the diocese of Moray, to whom the pope lately made provision thereof, contained that it is alleged that the pope previously ordered provision to be made of St. Mary's to Henry Buttery, a monk of Cupar, of the same order, in the diocese of St. Andrews; that, although the fruits etc. of St. Mary's exceed 120l. sterling a year, it was stated in the pope's mandate of provision to Henry, which was thus surreptitiously obtained, that they did not exceed 80l. sterling; and that, after the date of the said mandate, Henry freely resigned all right in the said monastery, but that John fears molestation on account of the said mandate. The pope therefore orders the above to summon Henry and, if the said surreptitiousness be proved, to decree the said mandate and its consequences null, and not to allow John to be molested by Henry under pretext of the said mandate. 17 Kal. May. St. Peter's, Rome. (f. 94d.)	To the bishops of Whiteherne and Ossero and the abbot of Glenluce ([de] Valle lucis) in the diocese of Whiteherne. Mandate as below. The recent petition of Gilbert Makdonyl, a canon of the Premonstratensian monastery of Saulseat (monasterii Sedisanimarum alias Viridi[s]stagni) in the diocese of Whiteherne, contained that formerly, in ignorance that the institutes of the said order forbade anyone not of legitimate birth to be received as a canon thereof, he, without mention of his illegitimacy, as the son of a priest and an unmarried woman, entered the said monastery and was received therein, took the habit and made his profession and, without having obtained any dispensation on account of the said defect, had himself promoted to all, even holy orders; and that, on the voidance of the parish church of Kyrkmedin in the said diocese, wont to be governed by canons of the said monastery, by the death of Cornelius Macmaken, a canon of the same, John, abbot of Prémontré in the diocese of Laon, alleging that the said church had been void so long that its collation and provision lawfully belonged to him, ratified and approved by his ordinary authority the said reception and profession (fn. 5), and by papal privilege restored and rehabilitated Gilbert to all honours, dignities and lawful acts within and without the said monastery, of which by the statutes of the order he ought to have remained deprived, and made collation and provision to him for a certain time of the said church. Seeing that the said collation and provision do not hold good, the pope orders the above to collate and assign to him the said church, value not exceeding 20l. sterling, and hereby dispenses him to minister in the said orders and to receive and retain the said church. 8 Id. Aug. St. Peter's, Rome. (f. 106d.)	To Patrick Occurryn, prior of the Benedictine priory of St. Mary, Glascarrayg, in the diocese of Ferns. Grant, as below. Lately the pope, upon learning that the said priory was void by the death of Andrew Occurryn, although Thady Obreyen, a secular clerk of the said diocese, had without any canonical title detained possession for more than two years, and was still doing so, ordered the abbot of St. Mary's, Ferns, and the dean and William Ocyrdhudhayn, treasurer, of Ferns, to summon the said Thady, and if they found the said priory, which is not conventual, to be void as stated or in any other way, to collate it to the above Patrick who, as he stated, had made his profession of the said order and was the son of unmarried parents, and moreover to dispense him to be promoted to all, even holy orders and receive and retain the priory. Patrick's recent petition contained that he caused Thady to be summoned before Patrick Omurchi, abbot of the said monastery, and Thomas, dean of the said church, which two by a definitive sentence made the said collation, and removed Thady etc.; that, although Thady is said to have appealed to the apostolic see, he has not prosecuted such appeal during about four years; and that Patrick obtained the said priory and is in possession. At the said petition (adding that it is alleged that the said Thady had at the time of the pope's said letters made his profession of the said order, and that, on the ground that the said Patrick and Thomas were not in peaceable possession of the said monastery [of Ferns] and deanery, respectively, there is a doubt as to their competence as judges) the pope grants that the collation of the said priory, value not exceeding 40 marks sterling, and its consequences shall hold good from the date of these presents, as if the said Patrick and Thomas had been competent judges, and as if Thady had [not] made his said profession. 5 Non. July. St. Peter's, Rome. (f. 130.)	To Joan Burton, a nun of the monastery of St. Mary, Nuneton, of the order of Fontevraud, in the diocese of Coventry. Dispensation to her, the daughter of a priest and a widow, to hold any conventual dignities, even those of abbess or prioress, administrations and offices, wont to be governed by nuns of the said order. Non. Sept. St. Peter's, Rome. (f. 131d.)	To the bishop of St. Andrews. Mandate, as below. Martin V—upon its being set forth to him by Thomas, [now] a monk, then abbot of the Cluniac monastery of Paisley (de Pasleto) in the diocese of Glasgow, that the late Robert, abbot of Cluny in the diocese of Macon, had by his ordinary authority made him provision of the said monastery, and that in virtue thereof Thomas had partly obtained possession of the rule and administration, and that he had been blessed—confirmed the said provision and himself made him provision. It was afterwards set forth to the present pope by Thomas that pope Martin (at the instance of John de Lythcow, a monk of Paisley, who alleged that he had been despoiled by Thomas of the said rule and administration, and that he had appealed to the apostolic see) committed the appeal to the late John, cardinal priest of St. Laurence's in Lucina, who gave a definitive sentence by which he removed Thomas from the said rule etc. and restored John, who obtained letters of execution of the said, sentence. Subsequently the pope extinguished all suits pending about the said rule etc., annulled the said sentence, and made provision of the said monastery to Thomas, and, with Thomas's consent, granted in commendam to John, motu proprio, for his life or until he should get provision and peaceable possession of the abbatial or other dignity of any monastery, the parish churches, belonging to the abbatial mensa of Paisley, of Dondownalde, with its annexed chapels, and St. Quivox (Sancti Kevoci), and the manor and le manys of Munkton, in the same diocese, exempting John, for the duration of the said commenda, from the jurisdiction of the bishop of Glasgow and the abbot of Paisley and any other judges ordinary. Afterwards, upon Thomas's resignation of the said rule etc., made at the apostolic see by his proctor John de Douglas, priest, of the diocese of St. Andrews, to William, cardinal priest of St. Martin's in Montibus, and the said cardinal's admission thereof, and upon the pope's making provision of the said monastery, thus void, to Richard, [now] abbot thereof, the pope, in order to compensate Thomas, granted and assigned to him for life the fruits etc. of the parish churches of Rosneth and Kilpatrik in the said diocese of Glasgow, and all lands and possessions lying within the bounds of the said parish of Kilpatrik and belonging to the said monastery [above, ƒ. 3]. Seeing, as the recent petition of abbot Richard and the convent contained, that the buildings of the said monastery are so much collapsed that it is doubtful whether it can be repaired in a lifetime, and that the said commenda is very prejudicial to the monastery and its abbot, the pope orders the above bishop to summon the said John and others concerned, and if he find the last made statements to be true, to modify the said commenda in accordance with the monastery's means and the said John's needs, in such wise that the monastery shall feel relief. Mandate to cause John Maclanchi, priest, of the diocese of Limerick, by both parents of noble birth, to be received as a friar of the Trinitarian house of St. James, Adare (de Adara) in the said diocese [of Limerick], the ministership of which is void, and to receive his profession. Indult, at his recent petition (containing that he and his parents, and their descendants in a direct line, are perpetually subject by the yoke of serfdom to a certain noble of the realm of England, and that therefore, in accordance with certain constitutions of the said realm, he cannot be promoted to holy orders or be appointed to dignities, without the said noble's consent) to be promoted to all such orders and to be elected or appointed to any dignities etc. of the said monastery, in which monastery he has made his profession and to which he is bound thereby. Mandate to cause to be received as a monk of the Cistercian monastery of St. Mary, Boyle, in the diocese of Elphin, and to receive the profession of, Thady Macdiarmada, a canon of Elphin, who is the son of an unmarried man of royal stock, and an unmarried woman of a race of barons, related in the third and fourth twofold, and in the fourth degrees of kindred; who was lately dispensed by papal authority on account of the said defect to be promoted to all, even holy orders and hold any benefices with or without cure, compatible with one another; whose progenitors were the founders, and whose parents are the defenders of the said monastery. Dispensation to him (who was formerly abbot of the said monastery, and who, having incurred the enmity of powerful men of those parts, feared that the monastery might suffer in consequence, and therefore, following the counsel of several notable men, freely resigned it into the hands of the father abbot) to hold for life any benefice with or without cure, wont to be held by secular clerks or regular clerks of any order, even if it be a parish church etc., and to resign it, simply or for exchange, as often as he pleases. 8 Id. June. St. Peter's, Rome. (f. 275d.)	To the priors of Athlone (de Innocentia juxta Athluain) and St. John Baptist's, Rinduyn, in the diocese of Elphin, and the official of Elphin. Mandate (the pope having been informed by Magonius Maceochayd Yceallayd, a canon of the Augustinian monastery of St. Catherine, Achdrym Omane, in the diocese of Clonfert, that William Oflannagayn, prior of the Augustinian monastery of St. Mary, Rosscomayn, in the diocese of Elphin, has committed simony and perjury, dilapidated the goods of the said monastery, and neglected to exercise the cure of the parishioners of the church of the said monastery of St. Mary) if the said Magonius, who is the son of unmarried nobles related in the triple fourth degrees of affinity, will accuse William before them etc., as usual, to summon William, and if they find the above to be true, to deprive William, and in that event to collate and assign the said priory, which is conventual and dependent on no monastery etc., and whose value does not exceed 60 marks sterling, to Magonius, if found fit, whom the pope hereby dispenses to receive and hold it. 5 Non. July. St. Peter's, Rome. (f. 302.)	Confirmation as below, at the recent petition of Roger Felford, subprior, and the chapter of the Benedictine church of Coventry. The pope exemplifies the letters Universis ... Ex parte dilectorum, of Roger Coton, prior of the cathedral and regular church of Coventry, dated in the chapter-house of Coventry, 21 August, 1398, and sealed with the seal of the said prior and the common seal of the church of Coventry, whereby prior Coton relates the creation by William Brythwalton, sometime prior, for the benefit of the subprior and chapter, of the office of pittancer, to be held by brethren of the said church, appointed and removed by the subprior and chapter, which creation prior Coton by his said letters ratifies and confirms. The pope hereby confirms the said creation by prior Brythwalton, and its ratification and confirmation by prior Coton, and decrees that the said creation shall be observed in perpetuity. Collation and provision to him, the son of a priest, professed of the said order, and an unmarried woman, of the said priory, conventual, dependent on the monastery of Lochke, of the same order, in the diocese of Elphin, and wont to be governed by canons thereof, value not exceeding 5 marks sterling, which, on its voidance by the resignation of Luke Macgallgali to the father abbot Thady, abbot of the said monastery of Lochke, the said abbot collated to him, in ignorance of the pope's late reservation of all conventual priories, void and to be void, and of which Fergallus, likewise ignorant, in virtue thereof obtained possession, but has not taken any of the fruits; whether it be void as stated, or by the resignation of John Osiridean, or in any other way. He is hereby dispensed on account of the said defect. Vite etc.
