12 Eugenius IV (cont.)

De Prebendis Vacantibus.

1442.
6 Id. Oct.
Florence (f. 54d.)
To the prior of St. Mary's, Luweth, in the diocese of Armagh, and Arthur Mackamail and William Somurwell, canons of Armagh. Mandate (the pope having been informed by Patrick Okinagan, commonly called Okellaig, rector of the parish church or prebend of Ardtrea in the diocese of Armagh, that formerly Henry Ofercaran, priest, of the said diocese, simoniacally bargained with David Macdamm, priest, of the said diocese, for his resignation, in return for a sum of money, of his rectory (afterwards erected into a canonry and prebend of Armagh) of the parish church of Tamlachtaliag in the said diocese, the which was carried out, the said David resigning his said rectory to John, [now] a bishop in the universal church, then archbishop of Armagh, who admitted the resignation and made collation and provision of the rectory, as being thus void, to Henry, who, after paying the said sum, obtained possession of the same, now a canonry and prebend, and still detains it; and that the said Henry is also a notorious fornicator and is involved in divers other crimes [not here specified]) if the said Patrick will accuse Henry before them etc., as usual, to summon Henry, and if they find the above to be true, to declare the said collation and provision null, and in that event to collate and assign the said rectory or canonry and prebend, value not exceeding 14 marks sterling, to Patrick; whether it be void as above, or by the death without the Roman court of Eugenius Olorchan, or in any other way; notwithstanding that he holds the said rectory of Ardtrea, value [likewise] not exceeding 14 marks sterling, which he is to resign upon obtaining that of Tamlachtaliag. Vite ac morum. (B. and Ja. Goyer. | B. viiii. Residuum gratis pro deo. Tertio Id. Octobris Anno Duodecimo. Valven.)
12 Kal. May.
Florence (f. 95d.)
To the bishop of Kilmacduagh, the prior of St. Michael's de Rupe alias de Ballymscelyg in the diocese of Ardfert, and the dean of Ardfert. Mandate to collate and assign to Thady Macrayth, perpetual vicar of the parish church of Clondagad in the diocese of Killaloe (who was lately dispensed, as the son of an abbot of the order of St. Augustine and an unmarried woman, to be promoted to all, even holy orders and hold a benefice even with cure, and whose parents are of noble race) a canonry of Killaloe and the prebend of Cluoyndagad therein and the rectory, of the patronage of laymen, of the united parish churches of Ocormayc in the said diocese, value not exceeding 3 and 10 marks sterling respectively, void by the deaths without the Roman court of Philip Ohuollachan and Odo Omiygyr respectively; summoning and removing Cornelius Ohuercule and Philip Macinyth (rectius Macrayth) (fn. 2) priests, of the said diocese, who have respectively unduly detained possession for more than three years under pretext of collations made to them by authority of the ordinary after the collation had by the Lateran Statutes lapsed to the apostolic see, and on account of whose power Thady has no hope of obtaining justice in the city and diocese of Killaloe; notwithstanding that he holds the said vicarage, value not exceeding 10 marks sterling, and his said illegitimacy, on account of which the pope hereby dispenses him to hold the said canonry and prebend and rectory, and two other benefices with or without cure, compatible with one another, even if canonries and prebends or dignities etc., and to retain all for life, and resign them, simply or for exchange, as often as he pleases, and hold instead five compatible benefices. Vite etc. (B. and Ja. Goyer. | B. xl. Tertio Non. Maii Anno Duodecimo. Valven.)
10 Kal. Sept.
Florence (f. 99d.)
To the prior of SS. Peter and Paul's, Selleskerr'. in the diocese of Ferns. Mandate to collate and assign to Miles Deuros, clerk, of the diocese of Ferns, a canonry of Ferns and the prebend of Kylcom therein, with their annexed parish church of Kylrochane in the said diocese, value not exceeding 6 marks sterling, of which, on their voidance by the death without the Roman court of Thomas Wyote, bishop Robert made collation and provision to him by his ordinary authority, by vigour of which he holds them, but doubts whether the said collation and provision hold good, he not being yet a subdeacon, inasmuch as it appears that a statute of the church of Ferns forbids the holding of the said canonry and prebend and parish church except by one in the order of subdeacon; whether they be void as stated, or because the late John Wythen held them for more than two years without having been ordained subdeacon, or be void in any other way. Dignum etc. Exhibita siquidem nobis. (An. and G. de Elten. | An. xxii. Tercio Kal. Novembris Anno Duodecimo. de Adria.)

[De Regularibus.]

9 Kal. Nov.
Florence (f. 167d.)
To John Welle, a Premonstratensian canon of St. Mary's, Hagneby, in the diocese of Lincoln, S.T.M. Dispensation to receive and retain for life a benefice with cure only, wont to be held by secular or by regular clerks of any order, even if it be a parish church or a perpetual vicarage, or a chantry, or be of the patronage of laymen, and to resign it, simply or for exchange, as often as he pleases. Religionis etc. (B. and Cyprianus. | B. xxviii. Valven.) (Cancelled with strokes, and note in the margin Cassata et alibi registrata, B. [Valven.])

To the abbot of St. Thomas the Martyr's without the walls of Dublin, the official of Meath and Thomas Barby, a canon of Dublin. Mandate (the archdeaconry of Armagh, a non-major dignity with cure, value not exceeding 30 marks sterling, having become void, and ipso facto reserved, by the promotion made by the pope of John, archbishop of Armagh, to that see, and by his consecration performed without the Roman court) to collate and assign it to John River, rector of Black Notle in the diocese of London, B.C.L. an abbreviator of apostolic letters, (fn. 3) who alleges that the said archdeaconry, thus void, was collated to him by royal authority, and that John Whyte, clerk, of the diocese of Armagh, B.C.L. (who is to be summoned and removed, and on account of whose power he has no hope of obtaining justice in the city and diocese of Armagh) has held it without canonical title for more than two years; notwith-standing that River (who was lately dispensed by papal authority to hold for life the said church of Black Notle and any benefice with cure or otherwise incompatible, even if another parish church or a perpetual vicarage or a dignity etc., and to resign them, simply or for exchange, as often as he pleased) holds the said parish church of Black Notle and that of Tamen' (sic) in the diocese of Meath, value not exceeding 24 and 16 marks sterling respectively. Litterarum sciencia etc. (B. and G. de Elten. | B. xx. Quarto Kal. Octobris Anno Duodecimo. Valven.) [See below, f. 285d, and above, p. 42.]

Vite etc. (An. and Ja. Goier. | An. xvi. Residuum pro deo. Septimo Kal. Junii Anno Duodecimo. de Adria.)
5 Kal. April.
